An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
the reof.
WHEREAS, pursuant to Minnesota Statutes 462.357 and 64.400 of the Legislative
Code, the Saint Paul Planning Commission initiated a rezoning of the University
Avenue/TH 280 Redevelopment District to rezone I-2 and RM-2 areas to I-1 for
the purpose of bringing zoning into agreement with the Redevelopment Plan
adopted for that area; and
`
WHEREAS, subsequent to the Commission's actions, the proposed rezoning was
consented to in a petition by the owners of at least 67% of the area of the
property to be re-zoned and by the owners of at least 67% of the parcels of
property situated within 100 feet of the total contiguous property within one
year preceding the date of the petition, and the petition was certified by the
Planning Division on October 4, 1988; and
WHEREAS, the Zoning Committee on October 13, 1988 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, the Planning Commission considered the rezoning petition at its
meeting held on October 21, 1988 and recommended that the City Council approve
the petition; and
WHEREAS, notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 15, 1988 and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the property
sought to be rezoned; and

WHEREAS, a public hearing before the City Council , having been conducted on
November 1, 1988 where all interested persons were heard, and the Council
having considered all the facts and recommendations concerning the petition;
now, therefore,
The Council of the City of Saint Paul Does Ordain: '
SECTION 1
That the Council of the City of Saint Paul does hereby amend the Saint Paul
Zoning Ordinances by amending the zoning classifications for the area contained
within the following boundary description and as shown on the attached zoning
map of the City of Saint Paul No. 9, as incorporated by reference in Section
60.301 of the Saint Paul Legislative Code:
Beginning at the intersection of the center lines of T.H. 280 and
Territorial Road proceeding northwest along the centerline of
Territorial Road to the west city limits; then north along the west
city limits to the intersection of the west City limits with the
southern boundary of Section 29, Town 29 Range 23; then north 971.2
feet along the west City limits to the property line of the
Northwest Potato Facility (TCW Corporation) (Property ID #'s
292923230003 and 292923230004); then proceeding east, 48.96 feet,

Dear Sir:
This re-zoning was initiated by the Planning Commission as provided under
section 62.400 of the Saint Paul Zoning Code. On October 13, 1988, the Zoning
Committee of the Planning Commission held a public hearing onthe1Committeeng
There was no testimony. At the close of the public hearing,
voted 7-0 to approve the rezoning based on the staff findings.
On October 21, 1988 the Planning Commission upheld the Zoning Committee's
recommendation with a unanimous vote.
This rezoning is scheduled to be heard by the City Council on November 1, 1988.

incoxporation of the land area into a new, high quality,

Mr. Grochala showed slides of the area and reviewed the staff report with a
recommendation of approval.
Ms. Hirte asked if there was a response from District 12. Mr, Grochala
replied that District Council 12 voted to approve the rezoning at their
October 12 meeting.
Mr. Repke made a motion to recommend approval of the rezoning based on staff

A. PURPOSE: To rezone the area north of Territorial Road and West of TH 280 from
I-2, Heavy industry and RM-2, multiple-family, to I-1, Light industtry so that
the zoning for the northern portion of the Westgate Office/Industrial Center
will be consistent with the adopted redevelopment plan, and allow development of
a new office/research/showroom facility.
B. SUFFICIENCY: A Petition was declared sufficient by the Planning Division on
October 4, 1988; Forty-nine parcels were eligible, 33 parcels required, and 36
parcels signed.
C. PARCEL SIZE: 55 acres
D. EXISTING LAND USE: Approximately 53 acres of industrial, trucking terminal, and
vacant land; and 2.4 acres formerly residential land. The area is approximatley
908 vacant, having been cleared for new office / industrial development.
E. SURROUNDING LAND USE: Industrial, office and highway and rail transportation
uses; and KSTP studios and broadcasting towers.
F: BACKGROUND: The 1987 University Avenue / T.H.280 Redevelopment Plan provided a
framework for the Port Authority of the City of Saint Paul to initiate
redevelopment of the industrial area west of T.H. 280 and north of University
Avenue. That plan called for the redevelopment of the area as a modern mixed
use industrial and commercial office development. The redevelopment plan
identifies two areas of I-2 and RM-2 zones which are recommended for
consideration for rezoning to I-1, Light Industrial. This zone would permit the
changes in land use proposed by the Redevelopment Plan.
In response to the redevelopment plan and a request from the District 12
Planning Council, the Planning Commission initiated this action in order to
consider necessary rezonings for the site ( PC Resolution 86-126) . Initially a
40-acre study approach was taken because of the large size of the parcel.
However, review of the necessary number of parcels affected by the change in
zoning indicated that signatures could be practically obtained. With that
information, consent signatures were obtained for over 67$ of the parcels
affected by the change.
G: FINDINGS:
1. The area to be rezoned is approximately 55 acres.
2. Existing Planning Reports and Comprehensive Plan elements direct that the area
under consideration be redeveloped and rezoned appropriately.
The District 12 "University Avenue Raymond to TH 280 Development Strategy
Report" recommended that the area north of University Avenue and west of TH 280
be redeveloped for new office/research light industrial park.
The BRW report "University Avenue - TH 280 Redevelopment Study" , a report
commissioned by the Port Authority and the City of Saint Paul, recommends the
rezoning of the redevelopment area north of Territorial Road from I-2 and RM-2
to I-1.

Staff Report
The Adopted Redevelopment Plan for the University Avenue - TH 280 area also
identifies the need to rezone the area north of Territorial Road to I-1.
3. The proposed rezoning will make redevelopment of commercial properties possible
while protecting the new development area from inappropriate intrusion of
undesirable uses permitted in the I-2 zoning district.
4. The RM-2 zoned area was a residential enclave surrounded by transportation and
industrial uses. Removal of the housing sites and incorporation of the land
area into a new, high quality, industrial/office park development is consistent
with and implements key elements of the adopted Redevelopment Plan and is

G. STAFF RECOI�lENDATION:
Based on findings 1 through 4, staff recommends that the zoning code be amended
by rezoning to I-1 the property in the University Avenue / TH 280 Redevelopment
District north of Territorial Road as shown on the attached Proposed Rezoning
Map, and property boundary description:
Beginning at the intersection of the center lines of T .H. 280

WHEREAS, The city of Saint Paul, its Housing and Redevelopment Authority and the Port
Authority have begun a redevelopment study of the portion of the city west of Trunk
Highway 280 and north of University Avenue, and
WHEREAS, District 12 Community Council developed a Strategy for the Development of the
West 280 area calling for the redevelopment of the area with industrial / research / office
land uses, and
WHEREAS, the existing I-2 heavy industrial zoning of most of the study area seems
inappropriate for the types of uses that the redevelopment plan may suggest, and
WHEREAS, re-examining the present zoning is an appropriate parf of the redevelopment
study,
THEREFORE, BE IT NOW RESOLVED: that the Planning Commission of the City of Saint
Paul initiates a 40-acre zoning study of the area of Saint Paul west of Trunk Highway 280
and north of University Avenue and south of the Northern Pacific line of the Burlington
Northern Railroad in District 12, and
BE IF FURTHER RESOLVED, that the Commission directs zoning staff to participate in
the redevelopment plan, but wait for its conclusions before recommending changes in the .
zoning for the 40-acre study area.
