BE IT RESOLVED, that, upon the peuuon of 7ames Denno, as documented in Finance Department
File Number 20-1948, public properties hereinafter described are hereby vacated and disconflnued as
public property.

7 that part of Hoyt Avenue lying westerly of a line running from the southeast corner of Lot 1, R.
S C. Witt Additian to a point on the north line of Block 1, Morton's Addition distant 3015 feet
9 easterly of the northwest comer of Lot 19, said Block 1, and easterly of the southeast line of the
10 Minnesota State Bike Trail (formerly the right-of-way of the Soo Line Railroad Company).

12 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
13 Saint Faul Legislative Code as amended, and to the following conditions --'

That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the City of Saint Paul, Depar(ment of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same ar any part thereof. Said utility
easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary stmcture, material storage, fixture, or any
other objects that will prohibit normal access to utility faciliues for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements sha11 be the sole responsibiliry of the petitioner, iYs
successors and assigns in the event the City exercises its reserved easement rights.

2 the City of Saint Paul, its officers and employees from all suits, actions or claans of any character
3 brought as a result of injuries or damages received or sustained by any person, persons or
4 property on account of this vacation or petiuonezs' use of this property, includinn but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
6 because of any claims or liability arising from any violation of any law or regulation made in
7 accordance with the law, whether by the petitioners or any of their agents or employees.

10 resolution, file with the City Cierk an acceptance in writing of the conditions of this resolution

The Department of Public Works has completed a review ofi the above referenced
vacation proposal. This is an unimproved street with an existing 3'-6" sanitary sewer
in Hoyt Avenue that turns southwest into a 4' sewer in a 35' easement across Lot 15
and along the railroad. A three foot vacation was requested in 1997 to cover an
existing garage encroachment. It was determined the 3 foot vacation would not
adversely affect our sewer and we did not object to that request.
Now, the same petitioner, 1 assume, is requesting the entire street west of Hoyt be
vacated for a proposed garage expansion. The Department of Public Works is
recommending denial of this request due to the presence of the existing sewers in
Hoyt Avenue and the easement crossi�g Lot 15. No turther vacation of this right-of-
way beyond the 3 foot strip for the existing encroachment will be considered.
For your information, I've included a copy of our sewer records for this area.

That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the City of Saint Paul, Depar(ment of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same ar any part thereof. Said utility
easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary stmcture, material storage, fixture, or any
other objects that will prohibit normal access to utility faciliues for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements sha11 be the sole responsibiliry of the petitioner, iYs
successors and assigns in the event the City exercises its reserved easement rights.

That a permanent utility easement shall be retained wathin the vacated azea on behalf of the City
of Saint Paul, Board of Water Commissioners subject to the following restrictions:
a. No buildings structures, trees or any temporary structure, material storage, fixture, or
ather object that will prohibit normal access to water faciliries for maintenanca purposes
will be permitted within the easemettt area,.

The Department of Public Works has completed a review ofi the above referenced
vacation proposal. This is an unimproved street with an existing 3'-6" sanitary sewer
in Hoyt Avenue that turns southwest into a 4' sewer in a 35' easement across Lot 15
and along the railroad. A three foot vacation was requested in 1997 to cover an
existing garage encroachment. It was determined the 3 foot vacation would not
adversely affect our sewer and we did not object to that request.
Now, the same petitioner, 1 assume, is requesting the entire street west of Hoyt be
vacated for a proposed garage expansion. The Department of Public Works is
recommending denial of this request due to the presence of the existing sewers in
Hoyt Avenue and the easement crossi�g Lot 15. No turther vacation of this right-of-
way beyond the 3 foot strip for the existing encroachment will be considered.
For your information, I've included a copy of our sewer records for this area.

That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the City of Saint Paul, Depar(ment of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same ar any part thereof. Said utility
easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary stmcture, material storage, fixture, or any
other objects that will prohibit normal access to utility faciliues for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements sha11 be the sole responsibiliry of the petitioner, iYs
successors and assigns in the event the City exercises its reserved easement rights.

The Department of Public Works has completed a review ofi the above referenced
vacation proposal. This is an unimproved street with an existing 3'-6" sanitary sewer
in Hoyt Avenue that turns southwest into a 4' sewer in a 35' easement across Lot 15
and along the railroad. A three foot vacation was requested in 1997 to cover an
existing garage encroachment. It was determined the 3 foot vacation would not
adversely affect our sewer and we did not object to that request.
Now, the same petitioner, 1 assume, is requesting the entire street west of Hoyt be
vacated for a proposed garage expansion. The Department of Public Works is
recommending denial of this request due to the presence of the existing sewers in
Hoyt Avenue and the easement crossi�g Lot 15. No turther vacation of this right-of-
way beyond the 3 foot strip for the existing encroachment will be considered.
For your information, I've included a copy of our sewer records for this area.
