Madden, 1876 Gluek Lane, on behalf of Volunteers of America made application to the Board of Zoning Appeals for a variance from the strict application of the pro- visions of Section 62. 104. 3 of the Saint Paul Zoning Code per- taining to the requirement that off-street parking facilities be no further than 300 feet from the building in which they intend to serve in a B-3 General Business Zoning L�is�crict for property located at 905 East Seventh Street , Saint Paul , Minne- sota; and WHEREAS, following a public hearing conducted by the Board of Zoning Appeals with notice to affected property owners , the Board of Zoning Appeals by its Resolution No. 10351 dated September 13 , 1988 , denied the application for variance based on the following findings and conclusions made by this said Board: (1 ) The applicant wishes to establish a community resi- dential facility at 905 East 5eventh Street. He is proposing to provide a�proximately 31 off-street parking spaces 'by using two properties in the area. These properties are approximately 450 feet and 1600 feet respectively from the building to '�e used for the community residential facility. (2) The Zoning Code requires one off-street parking space for every two residents of the community residential facility. The Zoning Code further requires that parking must be within 300 feet of the building which it is intended to serve , measured from the nearest point of the building to the nearest point of the off-street parking lot. The previous use was allowed to operate without parking because it was established before the City had parking requirements. (4) Volunteers of America had previously applied for a Special Condition Use Permit for its program in November 1987. This application was denied by the Planning Commission and also denied by the City Council on May 19, 1988. ( 5) The applicant has indicated that he has entered into a purchase agreement for the two properties for the proposed parking lots. The first located at896 Beech Street is 450 feet from the proposed community facility and the second lot, 785 East Seventh Street, is located 1600 feet from the proposed facility. (6) To grant a variance the Board of Zoning Appeals must determine that the proposed variance is in keeping with the spirit and intent of the Code , is consistent with the health, safety, comfort, morals and welfare of the inhabitants of the City, and that the proposed variance will not impair an adequate supply of light and air to adjacent properties . The proposed variance does not meet these requirements . The requirement that parking be within 300 feet is based on a reasonable as- sumption about how far people will walk to a parking place and these lots considerably exceed that distance. The area in question already suffers from a shortage of parking and granting the variance would worsen the existing problem. The District 4 chapter of the Comprehensive Plan provides "limited parking and circulation as a severe problem in the vicinity of the East Seventh commercial strip. Off-street parking is often filled with employees who cannot park on the streets because of time limitations . These limitations discourage customers from shopping in the area. Furthermore , internal circulation is hampered by parked vehicles along streets . It is estimated that the Seventh Street commercial strip area is short approximately 150 parking spaces . " (7 ) The plight of the applicant is due to circumstances not unique to this property. Buildings in older commercial areas dating back to the era of the street car were often built with little or no off-street parking. 2. . - �- . ��-�� (8 ) The site of the proposed facility can be put to other reasonable uses under the strict provisions of the Code. The previous use as a facility for mentally retarded had a parking shortage of 12 spaces which were grandfathered in. This shortfall could be applied toward meeting the parking requirements for permitted uses in the B-3 District that do not have addditional parking requirements as a condition for a Special Condition Use Permit . These uses include office, retail and storage. WHEREAS , pursuant to the provisions of Section 64. 205, the Volunteers of America, 5905 Golden Valley Road, Minneapolis , Minnesota, 55422 , filed with the City Council their appeal from the decision of the Board of Zoning Appeals requesting that a hearing be held to determine whether the Board had com- mitted any error of fact or procedure ; and WHEREAS , acting pursuant to the provisions of Section 64. 205 through 64. 208 , and upon notice to appellant and other affected property owners , a public hearing was duly conducted by the City Council on September 29, 1988 , where all interested parties were given an opportunity to be heard; and WHERERS , the City Council , having heard the statements made and having considered the application, the report of staff, the minutes and resolution of the Board of Zoning Appeals , does hereby make the following determination: RESOLVED, that the Council of the City of Saint Paul does hereby find and determine that the Board of Zoning Appeals did not commit any error of fact or procedure in this matter and the Council does hereby affirm the decision of the Board and concur in the findings made and determined by said Board; and, be it FURTHER RESOLVED, that the appeal of Volunteers of America be and is hereby denied; and, be it 3. BOARD OF ZONING APPEALS DECISION: Deny (5-0) August 9, 1988 I STAFF RECOMMENDATION: Deny SUPPORT: None at the hearing OPPOSITION: 7 people spoke at the hearing and 3 letters � Dear Sir: I On August 9, 1988, the Board of Zoning Appeals held a public hearing to consider a parking variance for a Community Residential Facility to serve ex-offenders to be operated by Volunteers of America. Under the variance all of the required parking for the building would have been provided by two remote parking lots which are located 450' and 1600' from the building to be used as a Community Residential Facility. (A variance is required because the Zoning Code allows remote parking lots to be used for required parking only if they are within 300' of the building they are to serve. ) The Board of Zoning Appeals voted 5-0 to deny the variance based on the distance between the lots and the building and the fact that the area already has a parking problem. Volunteers of America has appealed the decision based on the fact that the people using the lot would be residents of the Community Residential Facility and so could be required to park in the lots and also that the residents would be gone during the day when the area's parking problem is more critical. The appeal is scheduled to be heard by the City Council on September 22, 1988. Please contact me by September 21 if any Council member would like slides presented at the public hearing. T't^is is precisely the pattern reflected in VOA' s present program which operates in South Minneapolis. Based upon the two incorrect assumptions ' isted above, it �s the opinion of the applicant that the Board of Zoning Appeals errcred in its decision. Furthermore, the majority of the testimony heard at the August 9th hearing focused unreasonably on the nature of the proposed program rather than the issue of parking, which was the subject of the hearing. Therefore, �the public testimony given did not indicate significant concerns about the proposed parking plan . � �� ._l �.-r.� CITY OF SAINT PAUL BOARD OF ZONING APPEALS RESOLUTION ZONING FILE NUMBER: io3s1 DATE: September 13, 1988 WHEREAS, Tim Madden for Volunteers of America has applied for a variance from the strict application of the provisions of Section 62.104.3 of the Saint Paul Legislative Code pertaining to the requirement that off-street parking facilities be no farther than 300' from the building they are to serve in the B-3 zoning district; and WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing on August 9, 1988, pursuant to said appeal in accordance with the requirements of Section 62.204 of the Legislative Code; and WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence presented at the public hearing, as substantially reflected in the minutes, made the following findings of f act: 1. Volunteers of America Minnesota wishes to establish a community residential facility serving adult male correction residents. The facility would provide housing and transitional services for clients being released from federal correction programs. There would be a maximum of 60 residents. The applicant says offenders that have committed sex crimes or have been habitually violent are not accepted in the program. The minimum length of stay would be approximately 90 days. 2. Bill Nelson of Volunteers of America told planning staff that based on a similar facility they operate in Minneapolis, they expect that roughly half of the residents would have cars. During the week the clients would leave the building in the morning to go to work or school. They would have to return and check in between 4 and 7 P.M. A third of the residents would have to stay at the facility for the evening. The rest would be able to leave for the evening but would have to say where they were going. (How late the residents could stay out would depend on how they were doing in the program.) All the residents would spend the night at the facility. On the weekend most of the clients would stay at their homes and would not be at the facility. 3. The three-story structure was originally built as a clothing factory in 1915. In 1967 it was remodeled to serve as a community residential facility for mentally retarded individuals and served up to 120 residents in the past. It closed in June 1988 at which time it was serving 24 residents. The operator of this program, Dungarvin, retains ownership of the building. 4. The Zoning Code requires one off-street parking space for every two residents of a Community Residential Facility. This requirement is stated two times in the Zoning Code. It is in the list of general parking requirements (Section 62.103 Subd 6 (2n))and it is also given as one of the conditions which must be met for a Special Condition Use Permit for a Community Residential Facility (Section 60.423 (3e)). The Z�ning Code also requires that parking must be "within 300' of t�:e building which it is intended te serve, measured from the n�arest point c�f the buiiding to th� nearest point of :he off-street parking lot." 5. As a practical matter, parking was not a problem since the men�ally retarded residents did not have cars. 6. Volunteers of America first applied for a Special Condition Use Permit for its program for ex-offenders in November 1987. (The Zoning Code states that if the "licensing, purpose, size or location" of a Community Residential Facility changes a new Special Condition Use Permit must be obtained. In this case the use was changing from mentally retarded individuals to ex-offenders and the number of residents changed.) Volunteers of America proposed to meet the parking requirements by providing 17 spaces in a parking lot next door. However, this lot was part of a parcel occupied by a vacant bank office and Volunteers was only able to obtain a short term lease which could have been canceled by the owner with 60 days notice. The Planning Commission found that this arrangement did not meet the requirements for providing parking and voted to deny the Special Condition Use Permit on April 8, 1988. Volunteers appealed this decision to the City Council which denied the appeal on May l9, 1988. 7. Since the appeal was denied, the owners of the property have entered into purchase agreements for two properties in the area. The first (869 Beech Street) is located 450' from the building. Staff walked to the lot from the building in just over 2 minutes. The route to the lot is through a commercial area. The property to the south of the lot is residential. Staff has reviewed the plan for the lot and found that 11 cars could be parked there. The lot is currently occupied by a house which would be moved or torn down. The second lot (785 East 7th Street) is located 1600' from the building. It took staff 5.5 minutes to walk to the lot. The route is along East 7th Street past commercial property. The area around the lot is primarily commercial but there is a church and school to the north and a few houses a half block to the west. Planning staff determined that the lot could hold 22 cars. 8. If both of these lots were used there would be 31 parking spaces, enough for a Community Residential Facility of 62 residents. 9. To grant a variance the Board of Zoning Appeals must make the following findings: a. The proposed variance is in keeping with the spirit and intent oJ the code and is consistent with the health, sajety, comJort, morals and weljare oj the inhabitants oJ the city oj Saint Paul; and The proposed variance will not impair an adequate supply oj light and air to ad jacent property, nor will it alter the essential character of the surrounding area or unreasonably diminish established property values within the surrounding area. The proposed variance does not meet these findings. The requirement that parking be within 300' is based on a reasonable assumption about how far people will walk to a parking place and these lots considerably exceed that distance. (The 7th Street lot is more than 5 times farther than what the Code allows.) It is reasonable to assume that people will use on-street parking rather than the assigned lots if they are too far away. This area already suffers from a shortage of parking and granting this variance would worsen the existing problem. The District 4 chapter of the Comprehensive Plan says "Limited parking and circulat;on is a severe problem in the vicinity of the East Seventh commerc;al strip. Off-st*eet parking is often filled with employees who cannot park on the streets because of time limitations. These limitations discourage custur„ers £r�:r. shcp�ing in ihe area. F�rthermore, intetnal circulation is hampered by parked vehicles along streets. It is estim�ted that the Seventh Street com:r,ercial strip area is sh�rt ap�rqximateiy S SQ ��rking spaces." b. The plight of the landowner is due to cdreumstances unique to his property, and these circumstances were not created by the landowner. The situation here is not unique to this property. Buildings in older commercial areas dating back to the era of the street car were often built with little or no off-street parking. c. The property cannot be put to a reasonable use under the strict provisions oj the code. There are uses for the property which would not require a variance of parking standards, or at least not such an extreme variance. Paul , MN 55102 Dear Members : Due to a previous commitment I am unable to attend the public hearing next Tuesday, but want to express my strong opposition to the proposal to operate a group home for exoffenders in the neighborhood . There has been a tendency to overburden urban neighborhoods in St . Paul with inadequately supervised group homes dealing with people who need close supervision in order to protect the local community. This is just another example of that problem. While I support efforts to provide residential community settings for the mentally and physically handicapped because they do not threaten the residential community and deserve our more serious concern , that is not true for those who have violated our laws .
