The Fraternity house has bezn there for over seventy years. Tnis
ilouse was originaily �uili: as a fraternity house. There are
seven to eight hundred members. At this point, Mr. Geoffrey
brought up a point, that he felt should be considered. wt-�en
rulin�� on this �ase. In 1983 or 1984 the City inspected the
hause for the very first. time and did a major inspection. There
were several paaes of vioiati�ns and were told that the
violations must be corrected, to be in compliance with the codes.
At that time a $36, OD17. 00 laan was taken from the National

were requested. At that tirne thPre was no mention of the bath
situation. When the building was reinspected this past spring,
anly then was the building cited for this violation, if the city
had cited the violation at the first inspection the cost would
have been cheaper. There are 12 people livinq in the house.
This is a three story building, there are people living on the
second and third floor. There is one sink on the third floor; in
the second floor bathroom, there is one shower. one urinal . one
stool toilet, and two sinks. Also, in the basement there is one
shower and one stool . The first floor is where every one lives,
like a family atmosphere. Mr. Geofft-ey feels that it is fair,
not unreasonable, to request a variance to allow 16 people, given
the current number of bathrooms in the house. The estimates, to
cornply with code. would be to remove one of the rooms to install
a bathroom and the cost is between $ 15,OOt7.0U to $20,000. 00.
If the t�c�ard were to grant a variance for approximately 6 to
9 months , which is basically the school term, to allow 16 persons
giving the National Fraternal Organization some time to come up
with some money to do all necessary work.

1Q would be allowed. This seems to be the narm for the city to
aliow. The Sorority house that is just a couple of de�rs from the
Fraternity House has two bathrooms and ten person living in tr�e
building. There has been a survey taken of some of the other
variance granted to Fraternity houses in the city, and the ratio
is about 5 1 /2 persons per bath. If the variance is granted with
a density of 16 persons , it would be the highest the Baard and
City Council has ever granted. If this item is returned to City
Council for ratification approving 16 persons, it wili not be
a�proved.

The Fraternity house has bezn there for over seventy years . inis
i-�ouse was originaily buiit as a fraternity house, if-�ere are
seven to eight hundred members. At this point, Mr. Geoffrey
broughi� up a point, that he felt should be considered. when
ru 1 i n�a on th i s case. I n 198.� or 1984 the C i tv i ns�ected ti-�e
hause for the very fiirst time and did a ma�or inspection. There
were severai pages of violations and were told that the
violations m�st be corrected, to be in compliance with the codes.
At that time a $36, OGU. OU laan was taken from the National
Fraternal Orginization to cornply with all the requirements as
were requested. At that time there was no mention of the bath
situation. When the building was reinspected this past spring,
aniy then was the building cited for this violation, if the city
had cited the violation at the first inspection the cost would
have been cheaper. There are 12 people living in the house.
This is a three story building, there are people living on the
second and third floor. There is one sink on the third floor; in
the second floor bathroom, there is one shower . one urinal , one
stool toilet, and two sinks. Also, in the basement there is one
shower and one stool . The first floor is where every one lives,
like a family atmosphere. Mr. Geoffrey feels that it is fair,
not unreasonable, to request a variance to ailow 16 peopie, given
the current number of bathrooms in the house. The estimates, to
comply with code. wouid be to remove one of the rooms to install
a bathroom and the cost is between �1S,a00. 00 to $2G,000. 00.
If the �oard were to grant a variance for approximately 6 to
9 months, which is basically the school term, to allow 16 persons
giving the National Fraternal Organization some time to come up
with some money to do all necessary work.

also parking problems . Zoning Code allows only 4 unrelated adults ir�
a single family dwelling. Health codes related to baths , only
allow 5 unrelated adults, and there is only one legal bath in the
house. If the City allows a variance for the basement bathrooms ,
even though there are no sleeping rooms on this floor , thEn only
1Q would be allowed. This seems to be the norm for the city to
allow. The Sorority house that is just a couple of doors from the
Fraternity House has two bathrooms and ten person iiving in tr�e
building. There has been a survey taken of some of the other
variance granted to Fraternity houses in the city, and the ratio
is about 5 1 /2 persons per bath. If the variance is granted with
a density of 16 persons, it would be the highest the Baard and
City Council has ever granted. If this item is returned to City
Council for ratification approving 16 persons, it will not be
approved.

the fact that the kitchens are smaii and have limited counter space.
PROCEEDINGS: Mr. Otness stated that this is a 258 unit building
in the Highland area. It was built in 1939. The appellant has
managed the building for 30 years. Fire Prevention cited the
buiiding for not having a third outlet in the kitchen. These
kitchens are very small . The building is being remodeled.
The building is concrete construction, therefore, making it
difficult to add additional outlets.

Pat Fish, from Fire Prevention stated that 1n some cases it was
allowed to have every third floor door unlocked, an assurance
that the peaple do not have to walk down to first floor. One
option would be to leave the doors locked from the stairwell side
and have a timed alarm systern that if the alarm system does sound
the door would automatically open.
The appellant is requesting an extension of time to update the
alarm system and install hold open devices on fire doors. If
the Timed Alarm System is instalied, then additional time is
need, so as to request money in the budget for July of 1989.

Because of our involvement in rainleader disconnection , our
council has now become interested in the matter of rainleader
variances.
Our organization knows of at least two individuals who are very
much unsatisfied with the city process for giving variances from
the city ' s rainleader disconnection requirement . These two
people were denied variances by staff and appealed that decision
to the Board of Appeals and Review which heard these matters
September 14. They are not at all satisfied with that hearing
and now wish to have their variance request decided by the City
Council . While there do not appear do be clear procedures for an
appeal to City Council , it seems logical that the City Council
should have the ultimate authority and responsibility to decide
whether or not a variance to the city � s disconnecrtion
requirement should be allowed .
The Board of Appeals and Review approved their September 14
minutes at their October meeting. r1y understanding is that the
actions of this board now need to be approved by the City
Council and are likely to be on your agenda within a week.
At least the two individuals I have spoken to intend to be
present at the City Council meeting where these minutes are
approved . They assume that due process will require a public
hearing at that time .

Dear Mr. Scheibel:
I am a member of the Beta Kappa Corporation, which owns the
Theta Chi Fraternity House located at 823 North Snelling. At
the November lst meeting with the St. Paul City Council, the
variance which we requested and which has been approved by the
St. Paul Board of Appeals & Review will come on the agenda. The
variance basically gives the Fraternity one year to comply with
the City Housing Codes regarding the number of occupants per
bathroom in the Fraternity House. I believe Council Member Kiki
Sonnen may be opposed to this variance.
If the City Council takes action adverse to our organization,
we would like the opportunity at the Council Meeting to state tbe
reasons why we believe this variance is reasonable and appropriate.
I have included herein a copy of a letter which I sent to Mr.
A1 Olson several weeks ago which further outlines the variance
and our request to be heard if adverse action is taken.

I am a member of the Beta Rappa Corporation, which owns the
Theta Chi Fraternity House located at 823 North Snelling. We
have been in the process of getting a variance from the bathroom
requirements contained in the City Building Codes. On May 10,
- 1988, we appeared before the St. Paul Board of Appeals & Review
and were granted a variance which would allow us to count our
downstairs bathroom under the Code and would grant us a variance
to 8 people per complete bathroom (16 total allowed in house) .

of Public Health. At these meetings it became apparent to us
that Councilmember Sonnen would oppose any variance which would

Councilmember Sonnen opposes the higher limit although, as far
as we have been informed, the house complies with all other building
and zoning codes to allow 16 people to resic7e at the house - other
than the bathroom situation.
On September 14, 1988, we again appeared in front of the
St. Paul Board of Appeals & Review. At that time we were granted
a variance to allow us to have 16 people at the house for a period
of one year while we remodel the bathrooms to comply with the
code. We are under the impression that Councilmember Sonnen will
continue to oppose this variance. Therefore, we would like to
have an opportunity to plead our case to whatever committee or
board will be deciding whether to recommend granting this variance
at the City Council level. From my conversations with the City
Attorney's Office, I am under the impression that under normal

WHEREAS, Section 5 . 03 of the St. Paul City Charter and
Section 3 . 04 of the Administrative Code authorize the City
Council, upon request of the City Attorney, to appoint special
counsel and provide compensation therefor in cases of special
and unusual circumstances; and
WHEREAS, Antonio Bernard Brown has brought suit in Ramsey
County District Court against the City of St. Paul and Officer
Patrick Scott alleging, inter alia, that Officer Scott while in
the scope of his employment intentionally shot the plaintiff and
that the City of St. Paul was negligent in the hiring, training
and retention of Officer Scott; and
WHEREAS, the City Attorney has explained the need for the
hiring of outside counsel anc? has reques-ted same; now, therefore,
be it
RESOLVED, that by virtue of the aforesaid special and unusual
circumstances, the law firm of Jardine, Logan and O'Brien be
retained to represent and defend Officer Scott in said litigation;
and, be it
FURTHER RESOLVED, that the defense will be directed by senior
partner Pierre N. Regnier, whose billing rate is $98 per hour and
such other members of the firm as he may request to assist him,
� each at their regular hourly billing rate, but never to exceed
the rate of $98 per hour; and be it
FURTHER RESOLVED, that the total fee shall not be in excess
of a reasonable fee having reference to the appropriate provisions
of the Code of Professional Responsibility; and, be it
