appellants and explained the procedure, stating that what the
Board does is recommends action to the Citv Council .

The Frat�rnity house has been there for over seventy years. ihis
P�ouse was �riginaliy buiit as a fraternity nousz. "�here are
seven to eight hundred members. At thi5 point. Mr . Geoffrey
brouaht up a point , that he felt shouid be considered. when
rulin�a on this case. ?n 1983 or 1984 the City inspected tr�e
house for the very first. time and did a ma�or inspection. There
were several pages of violatians and w�re told tr�at L-he
violations must be corrected, to be in compliance with the codes.
At that time a $36, ODU. OU laan was taken from the National
Fraternal Orginization to comply with all the requirements as
were requested. At that time there was no mention of the bath
situation. When the building was reinspected this past spring,
�nly then was the building cited for this violation, if the city
had cited the violation at the first inspection the cost would
havz been cheaper. There are 12 people livinq in the house.
This is a three story building, there are people living or� the
second and third floor. There is one sink on the third floor; in
the second floor bathroom, there is one shower . one urinal , one
stool toilet , and two sinks . Also, in the basement there is one
shower and one stool . The first floor is where every one lives,
like a family atmosphere. Mr. Geoffrey feels that it is fair,
not unreasonabie, to request a variance to allow 16 people, given
the current number of bathrooms in the house. The estimates , to
compiy with code. would be to remove one of the rooms to install
a bathroom and the cost is between � 15,UOO. Ot� to $24,OOU. 00.
If the baard were to grant a variance for approximately 6 to
9 months, which is basically the school term, to aliow 16 persons
giving the National Fraternal Organization some time to come up
with some money to do all necessary work.

a neiahborhoad, particularly around Colleges . This makes rnore of
d party like atrnospner�e, increases crime in the nei �hborhoods .
also parkina problems . Zoning Code allows only 4 unrelated adult5 in
a single family dweliing. Health codes related to baths, only
allow 5 unretated adults, and there is only one legal bath in the
house. if the City allows a variance for the basement bathrooms ,
even thouah there are no sleeping rooms on this floor , then only
! Q would be allowed. This seems to be the norm for the city to
a11ow. The Sorority house that is just a couple �f doors from the
Fraternity House has two bathrooms and ten person living in tr�e
building. There has been a survey taken of some of the other
variance granted to Fraterr�itY houses in the city, and the ratio
is about 5 1 /2 persons per bath. If the variance is granted with
a density of 16 persons, it would be the highest the Board and
City Council has ever granted. If this item is returned to City
Council for ratification approving 16 persons , it will not be
approved.

PROCEEDINGS: Mr. Otness stated that this is a 258 unit building
in tf�e Highland area. It was built in 1939. The appeliant has
managed the building for 30 years. Fire Prevention cited the
building for not having a third outlet in the kitchen. These
kitchens are very small . The building is being remodeled.
The building is concrete construction, therefore, making it
difficult to add additional outlets.

allowed to have every third floor doar unlocked, an assurance
that the peop) e do not have to walk down to first floor. OnE
option would Ge to leave the doors locked from the stairwell side
and have a timed alarm systern that if the alarm system does sound
the door would automatically open.
The appellant is requesting an extension of time to update the
alarm system and install hold open devices on fire doors. If
the Timed Alarm System is installed, then additional time is
need, so as to request money in the budget for July of 1989.
