An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, John and Helen Regenold duly petitioned to rezone the �
northwest corner of Idaho and Arundel (approximately 435 Idaho) from RM�to
P-1 for the purpose of constructing a parking lot the petition having been
certified by the Planning Division on July 13, 1988 as having been consented
to by at least two-thirds of the owners of the area of the property to be
rezoned, and further having been consented to by at least 67% of the owners of !
the property situated within 100 feet of the total contiguous property within i
one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on August 18, 1988 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section i
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on August 26, 1988 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City ori
September 10, 1988 and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the
property sought to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted onl
September 22, 1988 where all interested persons were heard, and the Councill
having considered all the facts and recommendations concerning the petition�
now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 4, as �
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at approximately 435 Idaho being more particulalrly
described as the east 118 feet of Lot 5, Block 3 Edwin N. Ware's
Cumberland Addition Plat 1 be and is hereby rezoned from RM-1 to P-l.i
Section 2.
This ordinance shall take effect and be in force thirty (30) days fro�m
and after its passage, approval and publication.

On August 18, 1988, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 6 to 0 to approve the rezoning ba�sed on
staff findings. !
On August 26, 1988, the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on September 22,
1988. Please notify me by September 21, 1988 if any member of the City douncil
wishes to have slides of the site presented at the public hearing.

WHEREAS, Jack and Helen Regenold, file #10344, have petitioned to rezone t e
northwest corner'of West Idaho Avenue and Arundel (approximately 435 West daho
Avenue) from RM-1 to P-1 for the purpose. of constructing a parking lot wit a 20 car
garage and 12 surface spaces to be used by an existing apartment building o the
east (429 West Idaho Avenue) ; and
WHEREAS, the Zoning Committee of the Planning Commission on August 18, 198 , held a
public hearing at which all persons present were given an opportunity to b heard
pursuant to said application in accordance with the requirements of Sectio 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented t its
Zoning Committee at the public hearing as substantially reflected in the m nutes,
made the following findings of fact: �
1. The applicant proposes to construct a parking area to serve the existi g 30 unit
building to the east (429 West Idaho Avenue) . A total of 32 spaces wo ld be
provided: 20 in a large garage which would have doors on both the nor h and
south side and 12 surface spaces along the north edge of the site.
2. The apartment building was constructed in 1968 and currently provides 33 parking
spaces: 12 garage spaces and 21 surface spaces_ Under the present zo ing code
parking requirements, a 30 unit building would be required to provide 5 off-
street parking spaces. Since the building was constructed prior to th adoption
of the current parking standards, the parking shortfall of 12 spaces is
considered legal nonconforming.
3. The applicant states that the apartment market has changed since the b ilding
was constructed and today most apartment dwellers are requesting garages. In
fact, there are six tenants on the waiting list for the 12 existing ga ages.

4. The apartment is located in an RM-2 zoning district. The parcel in question is
zoned RM-1, a more restrictive district. Section 62.104(3) requires th t off-
street parking facilities for nonresidential uses (a) be on the same zo�iing lot,
(b) in a P-1 vehicular parking district, or (c) within the same or less
restrictive zoning district as the principal use. So, to allow parking for the
apartment on this parcel, it must be rezoned RM-2 or P-1. The applicant is
petitioning for the P-1 district.
5. The P-1 parking district is intended to permit the establishment of off street
parking facilities to be used solely for off-street parking of private assenger
vehicles as a use incidental to a principal use. The applicant's petit on is
for incidental parking.
6. .Establishing a P-1 zoning district requires a review of eight conditions as .set
forth in Section 60.723; these conditions and the applicant's ability t� meet
them are as follows: '
a. The parking facility sha1l be accessory to and for use in connection with
one or more businesses.
The parking facility is intended solely for the use of the existing
apartaent building at 429 West Idaho Street.
b. The parking facility sha11 not be used during hours when the princi a1 use
is not in operation. During such periods the parking facility sha11 be
inaccessible for public use.
The parking facility is accessory to a residential use and therefore, access

to the lot is necessary on a 24-hour basis.
c. The parking facility sha11 be used solely for parking of private pas'Isenger
vehicles and sha11 not be used as an off-street Zoading area.
The applicant has stated parking is the sole intended use.

B. SUFFICIENCY: The petition was declared sufficient by the Planning Division on
July 13, 1988; 37 parcels eligible, 25 parcels required, 30 parcels signed.
C. PARCEL SIZE: A lot split application has been filed by the applicant. tChe
proposed parcel has 118' of frontage on West Idaho and 120' on Arundel f r a
total lot area of 14,160 square feet.

F. FINDINGS:
, 1. The applicant proposes to construct a parking area to serve the existing 30 unit
building to the east (429 West Idaho Avenue) . A total of 32 spaces would be
provided: 20 in a large garage which would have doors on both the north and
south side and 12 surface spaces along the north edge of the site.
2. The apartment building was constructed in 1968 and currently provides 33 parking'
spaces: 12 garage spaces and 21 surface spaces. Under the present zoni g code
parking requirements, a 30 unit building would be required to provide 45 off-
street parking spaces. Since the building was constructed prior to the doption
of the current parking standards, the parking shortfall of 12 spaces is
considered legal nonconforming. .
3. The applicant states that the apartment market has changed since the bui ding
was constructed and today most apartment dwellers are requesting garages In
fact, there are six tenants on the waiting list for the 12 existing gara es.
4. The apartment is located in an RM-2 zoning district. The parcel in question is
zoned RM-1, a more restrictive district. Section 62.104(3) requires that off-
street parking facilities for nonresidential uses (a) be on the same zoning lot,
(b) in a P-1 vehicular parking district, or (c) within the same or less
restrictive zoning district as the principal use. So, to allow parking �for the
apar�t��ent on this parcel, it must be rezoned RM-2 or P-1. The applicant is
pe�itioning for the P-1 district.

5. The P-1 parking district is intended to permit the establishment of off-Istreet
parking facilities to be used solely for off-street parking of private p ssenger
vehicles as a use incidental to a �r�ncipal use. The applicant's petiti�n is
for incidental parking.
6. Establishing. a P-1 zoning district r�quires a review of eight conditions as set
forth in Section 60.723; these conditions and the applicant's ability to meet
them are as follows:
a. The parking facility sha11 be accessorp to snd for use in connectiori with
one or more businesses.

b. The parking facility sha11 not be used during hours when the principal use

I
I firid this hearing my opportunity to voice my concern regarding
on street parking along Cumberland Avenue, which parallels Arundel St�eet
and is perpendicular to West Idaho. I
It has been my concern for some time that emergency vehicles do not have
adequate access to my home for the following reasons: I
1. Cumberland Avenue permits parking on both sides of the
street, therefore narrowing it so only one vehicle can I
pass through at one time.
2. Arundel Street is not completed through to Larpenteur Avenuel.
3. Cohansey Street is only wide enough to accomodate one vehiclle
at a time.
4. Makubin Street along Elmhurst Cemetery is not paved. I
I feel the zoning committee should address whether the building of ga�rages
could alleviate parking congestion along Cumberland Avenue, therefore
improving access to my home for emergency vehicles.
I propose that one side of Cumberland Avenue, preferably the west si�}e,
be designated as 'NO PARKING' . The west side of Cumberland runs inf�"ont
of the apartment building for which these garages are being builte I
It is my hope that aithough I cannot attend this hearing, my concernlwill
be heard, and my proposal taken into consideration. I

5. The P-1 parking district is intended to permit the establishment of off-st�lreet
parking facilities to be used solely for off-street parking of private passenger
vehicles as a use incidental to a principal use. The applicant's petitio� is
for incidental parking.
6. Establishing a P-1 zoning district requires a review of eight conditions as set
forth in Section 60.723; these conditions and the applicant's ability to m�eet
them are as follows:
a. The parking facility sha11 be accessory to and for use in connection w�th
one or more businesses.
The parking facility is intended solely for the use of the existing
apartment building at 429 West Idaho Street. I
b. The parking facilitp sha11 not be used during hours when the principalluse
is not in operation. During such periods the parking facility sha1Z b�
inaccessible for public use.
The parking facility is accessory to a residential use and therefore, �ccess
to the lot is necessary on a 24-hour basis.
c. The parking facility sha11 be used solely for parking of private passenger
vehicles and sha11 not be used as an off-street Ioading ares. I

The applicant has stated parking is the sole intended use. �
d. No commercial repair work or service of any kind, or sale or displap
thereof, sha11 be conducted in such parking facility. I
The applicant states that the tenants are not allowed to store inopera�le
vehicles or repair vehicles on the parking lot.
e. No signs of any kind, other than signs designating entrences, exits and�
conditions of use, shall be maintained on such parking facilitp. I
No signage is planned for the site.
f. No building other than that for the shelter of attendants sha1Z be ereclted
