WHEREAS, Laura Shanley has submitted the attached proposed lot split for City
Council approval ; and
WHEREAS, the Departments of Planning and Economic Development and Public Works
have reviewed the proposed split for 329 East Wheelock Parkway, as described on
the attached survey; and
WHEREAS, the proposed split meets the requirements of Section 67.304 of the
Zoning Code, except for the minimum lot frontage requirement of 50 feet for the
northerly lot, Tract A; Tract A will have 49 feet in width; and
WHEREAS, the City Council on September 1 and 15, 1988, held public hearings to
determine the advisability and necessity for the granting of variances from the
strict application of the provisions of Section 61.101 of the Zoning Code; at
which hearing all persons present were given an opportunity to testify; and
WHEREAS, following said public hearing, the City Council made the following
findings of fact:
1. The intent of chapter 67.100 is met;
2. The granting of the variance will not be detrimental to the public
safety, health or welfare or injurious to other property or improvements
in the neighborhood in which the property is located;
3. The conditions upon which the request for a variance is based are unique
to the property for which the variance is sought and are generally not
applicable to other property;

BE IT FURTHER RESOLVED, that a copy of this resolution will be mailed by the
City Clerk to the applicant at 329 East Wheelock Parkway, Saint Paul , 55101,

A. PURPQ,��: To split a parcel into two single family residential lots;
northerly lot requires a variance for lot width.
MINIMUM LOT WIDTH REQUIREMENTS: In an R-3 district, 50' lot frontage
required, new lot would have 49.00 feet.
B. SITE & AREA CONDITIONS: The parcel is comprised of three 40' lots and 10' of
an additional lot; the total lot area is 16,370.6 square feet. The parcel
slopes slightly toward the street from the west and there are mature trees on
the property. A detached garage now located on the northern area of the
parcel will be removed when a new house is constructed. A single family house
is located in about the middle of the parcel.
The two lots being created will be able to meet lot size standards of 6,000
square feet. The northerly lot will have 6,117 square feet and the southerly
lot will have 10,252 square feet.
C. FINDINGS:
1. City staff have reviewed the proposed split and found it to be in conformance
with the subdivision regulations 67.304, with the exception of minimum lot
width. Other standards of the district can be met by this proposal.
2. The City Council may grant a variance from the subdivision regulations when
compliance would create an unusual hardship to the development of the land,
and based on findings as specified in section 67.703 of the zoning code.
These findings are as follows:
a. The intent of the (subdivisfon) chapter is met;
The intent of the subdivision chapter is to provide for the orderly and
economic development of land; this lot split and variance will meet that
intent.
b. The granting of the varience wi11 not be detrimental to the public safety,
health or welfare or injurious to other property or improvements in the
neighborhood in which the property is Zocated;
The proposal will conform with the land use patterns of the district.
c. The conditions upon which the request for a varisnce is based sre unique to
the property for which the variance is sought and are generally not
appl�cable to other property;
The variance is required because the parcel is composed of three platted
lots and about 10 feet of an additional lot. The applicant intends to
create two single family residential lots from this parcel.

As can be noted from the attached area map, there are a variety of lot
widths in this particular area zoned R-3. Some lots directly to the south
are below the required width of 50' but have adequate total lot square
footage. This is a similar situation with the applicant's proposal.

PURPOSE: To review a lot split with variance for property located at 329 E.
Wheelock Parkway.
STAFF RECOMMENDATION: Staff recommends approval.
Dear Sir:
Attached please find the application, survey and staff report for the Laura
Shanley lot split with variance. This application has completed all the
required city department reviews and is in compliance with city subdivision
standards with the exception of lot width for Tract A.
The subdivision ordinance requires that lots are 6,000 square feet and 50' wide
for property in the R-3 zoning district. The applicant proposes separating her
parcel into two lots, each which would exceed the lot size requirement; the
northerly lot would be one foot short in lot width however and therefore a
variance is required.
