WHEREAS , the Planning Commission of the City of Saint
Paul at its meeting on August 26 , 1988 , approved a site plan
for a parking lot to be located at Selby and Arundel Streets
in the City of Saint Paul , the parking lot to be developed
by the Housing and Redevelopment Authority of the City of Saint
Paul and the Port Authority of the City of Saint Paul ; and
WHEREAS , Sarah Rubinstein, 442 Dayton Avenue , Saint Paul ,
Minnesota, 55102 , appealed this decision of the Planning Com-
mission to the 5aint Paul City Council pursuant to the provisions
of the Saint Paul Legislative Code alleging that the notice
of hearing mailed to property owners on behalf of the Planning
Commission was not in compliance with the provisions of the
Zoning Code and therefore the Planning Commission' s hearing
was defective ; and
WHEREAS, the City Council did, on September 22 , 1988 ,
conduct a public hearing on the appeal as filed by Sarah
Rubinstein, at which time the Council heard from all interested
parties and having considered the matter does hereby
RESOLVE, that the Council of the City of Saint Paul based
upon the following findings of fact, does hereby deny the appeal
made by Sarah Rubinstein and does hereby uphold the decision
made by the Planning Commission in this matter. The facts
on this matter as found by the City Council are as follows :
(1 ) The Housing Authority and Port Authority submitted
a site plan to the Planning Commission for review and approval
pursuant to the provisions of. Section 62. 108 .
(2) The provisions of Section 64. 300 provide that the
Planning Commission shall consider site plans and shall conduct
a hearing on the proposed site plan and are required to provide

written notice of the time and place of the public hearing
to all owners of record of property located within 350 feet
of the proposed site .
(3) That a notice was mailed to property owners within
350 feet of the proposed site and the notice stated that the
hearing would be held before the Planning Commission at its
meeting on August 26, 1988 and the location given in this notice
was the Council Chambers located on the 3rd floor of the City
Hall and Court House.
(4) That the Planning Commission did in fact hold a public
hearing on the proposed site plan on August 26 , 1988 at its
regular meeting time but the hearing was held on the 13th floor
of the City Hall Annex. Upon being notified of the error in
the location set forth in the notice, staff of the Department
of Planning and Economic Development positioned themselves
at the City Council Chamber door for the purpose of notifying
people that the correct location of the hearing was in the
City Hall Annex.
( 5) That Sarah Rubinstein, the appellant in this matter ,
went to the City Council Chambers at the noticed time for the
public hearing and upon observing that the doors were locked
obtained information advising her that the hearing was in fact
being conducted in the City Hall Annex. The appellant then
did appear at the Planning Commission public hearing and was
permitted to present her views at this hearing.
(6) That the City, through its Department of Planning
and Economic Development, the Planning Commission, and the
office of City Clerk, did not receive complaints from any other
party concerning the error in the Planning Commission notice
or complaining that they were not given an opportunity to appear
at the Planning Commission hearing to present their views .
(7) That the Planning Commission and staff of the Department
of Planning and Economic Development did take reasonable steps
to notify interested parties of the correct location of the
Planning Commission hearing as soon as they were notified of
the error in the notice.

(8) That the proposed parking lot at Selby and Arundel
Streets has been the subject of many other public hearings
held both by the Planning Commission of the City of Saint Paul ,
the Heritage Preservation Commission of the City of Saint Paul
and the Saint Paul City Council and therefore sufficient and
adequate public exposure of this proposed parking lot has been
provided.
(9) That the appellant has not shown that she has in any
manner been deprived of her opportunity and right to present
her views to the Planning Commission on this proposed site
plan and therefore has not established that she has in fact
suffered any injury because of the defect in the notice of
hearing as mailed out on behalf of the Planning Commission.

of this resolution to Sarah Rubinstein, the Zoning Administrator
and the Planning Commission.

WHEREAS , the Planning Commission of the City of Saint

Dear Sir:
On August 26, 1988, the Planning Commission approved with conditions the site
plan for the Arundel Street parking.
An appeal was filed by Sarah Rubinstein on September 8. The appeal is based
on the fact that the public hearing notices listed the wrong location for the
hearing. (The notices said that the meeting would be in the Council Chambers
rather than on the 13th floor of the City Hall Annex.)
The appeal is scheduled to be heard by the City Council on September 22, 1988.
Please contact me by September 21 if any Council member would like slides
presented at the public hearing.
I have attached information on situation involving the hearing notices and
also an update on revisions to the plan based on conditions previously
attached by the Planning Commission and City Council.

The appeal of the decision by the Planning Commission to approve
the Arundel Street parking lot is based on the fact that the
hearing notices gave the wrong location for the meeting . The
notices which should have told people to go to the 13th floor of
the City Hall Annex instead told them to go to the City Council
Chambers .
This situation is covered by the Municipal Planning Act of Min-
nesota. It states that "failure to give mailed notice to in-
ividual property owners , or defects in the notice shall not in-
validate the proceedings . �rovided a bona fide attempt to com�ly
with this subdivision has been made . " (Section 462 . 357 Subd 3)
In this case , Planning staff did not realize that a mistake had
been made until the Planning Commission meeting was under way.
As soon as we learned about it we sent someone down to the Coun-
cil Chambers to tell anyone who showed up there where the meeting
was .
Planning staff has not received any calls or letters from in-
dividuals saying that they were unable to attend the meeting.
The individual who filed the appeal was eventually able to attend
the meeting after checking in the Mayor' s office .
Planning staff regrets that this mistake was made and caused some
people inconvenience . However , the provisions of the Municipal
Planning Act are quite specific in dealing with this situation,
and staff recommends that the Council deny the appeal and uphold
the decision of the Planning Commission.

regulations in one district may differ from those in other districts. The ordinance
embodying thae regulations shall be known as the zoning ordinance and shall consist
of text and maps. A city may by ordinancc extend the a.pplication of its zoning �
regutations to unincorporated territory located within two miles of iu limits in any .
direction,but not in a county or town which has adopted zoning regulations;provided
that where two or morc noncontiguous municipalities have boundaries less than four
miles apart, each is authorizcd to control the zoning of land on its sidc of a line
equidistant between the two noncontiguous municipaliucs unless a town or county in
thc affected area has adopted zoning regulations. Any city may thereafter enforce such
regulations in the area to the same extent as if such property were situated within its
corporate limiu, until the count}• or town board adopts a comprehensive zoning

Subd. 2. General requirements. At an}•time afier the adoption of a land use plan
for the municipality,the planning agency, for the purpose of cam•ing out the policies
and goals of thc land use plan, may prepare a proposed zoning ordinance and submit
it to the governing body with its recommendations tor adoption. Subject to the
requirements of subdivisions 3, 4 and 3, the governing body ma}•adopt and amend a
Zoning ordinance by a two-thirds vote of aIl its members. If the comprehensi�e
municipal plan is in conQict with the zoning ordinance, the zoning ordinance super-
sedes the ptan.
Subd. 3. Public hearings. No zoning ordinance or amendment thereto shall be
� adopted until a public hearing has been held thereon by the planning agency or by the
governing body. A notice of the time, place and purposc oC the h�aring shall bc
3 published in the official newspaper of the municipality at least ten days prior to the day
� of tht hearing. When an amendment involves changes in district boundaries affecting
an area of five acres or less,a similar notice shall be mailed at least ten days before the

Subd. 4. Amendments. An amendment to a zoning ordinance may be initiated
by the governing body,thc planning agcncp,or by petition of aRected propeny owners
as defin�d in the zoning ordinance. An amendment not initiated by the planning
agency shall bc referred lo the planning agency,if there is one,for study and repon and
may not be acted upon by the governing body until it has received the recommendation
of the planning agency on ihe proposed amendment or until 60 days have elapsed lrom
th�date of reference of the amendment without a repon by the planning agcnry.
Subd. S. Amendmen� certain cities of the fint class. The pro�isions of this
subdivision apply to cities of the first ctass. In such cities amendmenu to a zoning
ordinance shalt be made in conformance with this scaion but only after there shall have
been filed in the office of the city clerk a written consent of the owners of two-thirds

REVISIONS TO THE ARUNDEL STREET PARKING IAT 9/15/88
Six conditions were attached to the approval of the lot by the Planning
Commission and the City Council. The current plan meets all of these
conditions.
The Planning Commission attached four conditions on their approval of the site
plan.
l. The Public Works Sewer Division must give fin81 approval of the
stormwater management plan.
The stormwater management plan has been approved by Public Works.
2. The developer must grant an easement to the St. PauZ Water Department
for a relocated water main.
It now appears that the water main will not be relocated so a new
easement is not be needed.
3. The developer must work with the City Forester to save and transplant as
many trees as possible.
A large tree spade will be used to move the existing trees along Arundel
to the new planting islands in the center of the parking lot. The
existing trees along Arundel are approximately 6" in diameter. Trees of
this size can successfully be transplanted although the drought of this
summer may reduce their chance for survival.
4. Pedestrisn access must be improved between the Zot and the Se1by
sidewaZks along the sides of the Arundel 1ot entrance or near the
entrance.
Connections between the lot and the Selby sidewalk have been added to
the plan.
The City Council added two conditions that the developer make good faith
efforts at the following:
5. The planting islands in the center of the lot should be moved so that
trees pZanted in them wi11 be more in line with the existing boulevard
trees on Arundel.
The planting islands have been moved out. In order to keep the same
number of parking spaces, a row of cars will be parked on the inside of
the islands along the main north-south drive lane.
6. Historic style Zight fixtures should be used throughout the 1ot.
Two modern "shoe box" fixtures shown on the earlier plan have been
replaced with four of the historic style fixtures. Two "shoe box"
fixtures will be used at the back of the lot since they will not shine
into the properties across the alley like the historic style fixtures
would if they were place�here.

I wish to appeal the decisions of the St. Paul Planning
Commission hearing of August 26, 1988. All property owners
within 350 feet of the property under discussion were not
properly notified of the time, date, and location of the hearing.
The notice mailed to property owners contained the right time
(10:00 A.M.) and date (August 16, 1988) , but the wrong location.
The location was listed as City Council Chambers, 3rd Floor City
Hall, St. Paul; the actual hearing was on the 13th floor of the
City Hall Annex. This lapse is in direct contravention of
hearing regulations.
I found the hearing because I asked for help in the mayor's
office. Jean, the mayor's secretary, made several phone calls
and finally determined that I should go the the llth floor of the
City Hall Annex. The staff there said there was an error in the
notice and sent me to the 13th floor where I found the hearing
already in progress. When city planning staff became aware of
the error, they attempted a patchwork remedy of sending someone
over to the City Council Chamber to see if anyone was there; no
one was.
When I spoke at the hearing I said that I felt that it was an
invalid public hearing because there was improper notice given to
the property holders. I asked that the matter be tabled until
proper notice could be given. It was not.
The regulation regarding notification has not been applied
equally to all citizens; business owners and city staff received
an accurate notice and homeowners did not. Homeowners were
therefore denied free access to the hearing process. Because
property owners were not properly notified of the hearing, I ask
that the minutes of the hearing be erased, the motion to approve
the site plan be set aside, and a new hearing be scheduled.

WHEREAS, the Saint Paul Housing and Redevelopment Authority and the Saint Paul Port
Authority have submitted a site plan to the Planning Commission for review which
calls for creating 45 new parking spaces by combining two existing parking lots at
Selby and Arundel by utilizing the vacated Arundel Street right-of-way; and
WHEREAS, the commercial area at Selby and Western has undergone a revitalization
during the 1980's. Building on the earlier success of the Dakotah Building, three
new major developments have been done in the area. On the southwest corner of Selby
and Western, the old Angus Hotel building has been restored as Blair House with
retail space, restaurants and condominiums. Immediately to the west is Hill Plaza,
a new building with commercial space and condominiums. On the northwest corner is
Cathedral Hill, a mix of existing buildings and new construction, with a variety of
retail, offices and restaurants; and
WHEREAS, this redevelopment has caused an increase in off-street parking required
for the new uses. Parking demand for the projected uses has been determined to be
about 270 spaces under the requirements of the Zoning Code; and
WHEREAS, the developers, the neighborhood and City staff have been working to find
the needed parking:
June, 1984 - Virginia was vacated between Dayton and Selby to provide additional
parking. Initially a parking ramp was proposed for this location but a ramp
proved to be financially unworkable.
February, 1987 - The HRA reached an agreement with the developers to provide 225
parking spaces for the projects and make a good faith effort to find an
additional 45 spaces. The HRA, which will front end the cost of developing the
270 spaces, will be paid back by the developers.
September, 1987 - With the ramp on Virginia Street no longer a realistic option
in the near future, the City Council approved a rezoning to P-1 to permit the
expansion of the existing Virginia Street parking lot. This brought the total
number of parking spaces provided under the HRA agreement to 225. (7-0)

December, 1987 - A District 8 Task Force reviewed a number of alternatives for
providing additional parking and recommended the Arundel Street location.
(However, the full District 8 Council did not support the task force
recommendation.)
April 14, 1988 - The Heritage Preservation Commission recommended that vacation
of Arundel Street be denied. (4-0-1)
July 7, 1988 - The City Council approved the vacation of Arundel Street for the
purpose of expanding the existing parking lots. (7-0)
July 14, 1988 - The Heritage Preservation Commission denied site plan for
Arundel Street parking lot. (7-1)
August 30, 1988 - The City Council is scheduled to hear the appeal of the
Heritage Preservation Commission's denial of the Arundel Street site plan; and
WHEREAS, the site plan for the Arundel Street parking lot provides 45 new parking
spaces and would meet the HRA's obligations under the 1987 parking agreement. The
plan calls for using the vacated Arundel Street right-of-way and reorganizing the
spaces in the existing parking lots so the space is used more efficiently; and
WHEREAS, section 62.103 of the Zoning Code says that in order to approve a site plan
the Planning Commission must find that it is consistent with the following:
a. The City's adopted Comprehensive PZan and development plans for sub-areas of
the City.
Since 1982, the St. Paul HRA and Port Authority have been actively involved
in attempting to restore the historic Selby and Western commercial area.
Approximately $20 million has been invested in the area so far. Despite the
successful renovation, parking remains a need for the area. When Cathedral

Hill and Blair House were built before the turn of the century, parking was
not a consideration. Today, however, parking is absolutely necessary to
attract commercial tenants and to comply with City zoning requirements.
b, Applicable ordinances of the City of Saint Paul.
The proposed parking lot meets all applicable ordinances. Parking lot are
permitted in the B-2 zoning district. The site plan meets all zoning
requirements for setbacks, landscaping and layout.
c. Preservation of unique geological, geographic or historically significant
characteristics of the city and environmentally sensitive areas.
When the Heritage Preservation Commission reviewed this plan they were
concerned about losing the historic grid pattern of the area streets.
Planning staff shares this concern but feel that the plan has a number of
design features to make it compatible with the historic character of the
area:
- The plan calls for a 4' wrought iron fence, a formal hedge and 13 shade
trees along Selby Avenue. The lot would be setback 7' from the sidewalk.
(The current lot has no fence and the plantings along Selby are low
junipers which do not screen the lot. There are 8 shade trees now along
Selby. The current setback for the lots are 6' and 10' .)
- Nine shade trees would be planted in landscaped islands in the lot,
including 7 trees in the vacated Arundel right-of-way. (There are
currently 7 shade trees in the lot, including 5 in the Arundel right-of-
way. These trees would be removed. None of the trees to be removed are
mature trees. )

- The new driveway to the parking lot would be in located in the vacated
right-of-way for Arundel Street to strengthen the continuity of Arundel
Street. Z�ao existing curb cuts would be closed.
- The old fashioned street lights on Arundel would be saved and used in the
proposed parking lot.
The vacation of Arundel Street has a reversion clause which says that the
street will be reopened if enough parking is found elsewhere for the
developments so that the 45 spaces created are no longer needed. There is
also a "sunset" clause attached to the vacaton: the City Council must
review the situation by 3/15/90 and if no action is taken the vacation would
expire on 5/31/90.
d. Protection of adjacent and neighboring properties through reasonable
provision for such matter as surface water drainage, sound and sight
buffers, preservation of views, light and air, and those aspects of design
which may have substantial effects on neighboring land uses.
The parking lot would meets these requirements. The lot was changed to meet
earlier concerns about access for emergency vehicles and snow storage.
e. Creation of energy-conserving design through landscaping and Zocation,
orientation and elevation of structures.
Shade trees in and around the lot will provide cooling shade in the summer.
f. Safety and convenience of both vehicular and pedestrian traffic both within
the site and in relation to access streets, including traffic circulation
features, the locations and design of entrances and parking aress within the
site.

The plan Traffic Engineering Section of Public Works has reviewed the site
plan and determined that it meets these requirements. The lot will have a
single driveway on Selby which will be adequate to handle anticipated
traffic. The internal layout and dimensions of the lot meet the
requirements.
g. The satisfactory avsilebility and capacity of storm and sanitary sewers,
including solutions to any drafnage problems in the area of development.
The sewer plan has been reviewed by the Sewer Section of Public Works. As
this report is being written, the plan is acceptable but some final
technical details remain to be resolved before final approval is given. The
plan would not create problems if in the future Arundel Street was reopened.
h. Sufficient Zandscaping, fences, wa11s and parking necessary to meet the
above objectives.
The landscaping and screening of the lot along Selby will be improved as
described in finding c. Landscaping at the rear of the lot will also be
increased to better screen it from the property across the alley: 31 Amur
Maple will be added to the existing 12 resulting in a spacing of 8' apart.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission approves the site plan
for expansion of the existing parking lots at Selby and Arundel subject to the
following conditions:
l. That the Public Works Sewer Division grants final approval of the stormwater
management plan;
2. That the developer grant an easement to the St. Paul Water Department for the
relocated water main;
3. That the developer work with the City Forester to save and transplant as many of
the trees as possible; and
4. That pedestrian access be improved between the lot and the Selby sidewalks along
the sides of the Arundel lot entrance or near the entrance.

I am responding to Tom Mogren's August 22, 1988 memo to Ken Johnson on the
vacated Arundel Street HRA parking lot. We accept your suggestion to offset
the water main around the proposed islands. We will be going to the HRA board
on September 7, 1988 requesting the 10 foot easement that you identified.
Our plans are to start construction on this parking lot in October of this
year. Obvioixsly, we still need to coordinate our activities and I will be
having our architect and engineering staff from PED contacting you shortly.
