PROCEEUINGS: Mr . Stockman. Attorney at Law representing Mr .
Evenson is requesting a waiver of the vacant building fees ,
because of financial hardship.
Steve Roy, stated that the building is a single i=amily building
that is vacant. (Picture5 were passed arounci) . The building was
condemned in 1964. It has been unoccupied for 24 years. Vacant
Building Urdinance. states that a building that is unoccupied for
over a year- must be registered as a vacant building. 7here are
two parts to the registration of a vacant building. ( 1 . ) a fee of
$ 100. 00 Per quarter has to be paid and (2. ) plans for the rehab
of the building. The building has no plumbing. A permit was
taken out to repair the porch. At present there are no plans to
rehab the building.
Mr. Carey, stated that the case was before the board in 5eptember
? 987 , at that time the request for a waiver was denied.
The building does not generate any income, it is used as an
extension to the home. It is used as a storage piace.
Mr. Stockman expiained that a few things have been done to the
buildinq which were, a new roof, the porch has been removed and
the building was painted.

that the Board cor�sider granting a variance with the provision
that there be no more than 10 living in the house and that the
basement bathroom be approved for use within this variancE.

SUtiJECI-: Appelllant is appealing the orders regarding the repair
ofi the exterior walls and windows, as per letter dated July 8,
l988, because of financial hardship.
PROCEE�INVS: Mr. �olden statecl that he has taken out two
mortgages on the property. There is very little equity in the
house. The Appellant met on the 26th of July with NED, having
filled out an application and paid the $325. 00 fee to have an
appraisal , so as to refinance the huuse. h1r. Gc�ld�n stated that
he has spoken to Mr. Carr from PEU about loan and should have a
decision by the end of September as to the status of the laan.
Mr. Votel , trom the Fublic Health Division stated that he saw no
problem with tt�e Board grantinq as extension of time for Mr.
Golden.
BOARU ACTIUN: Motion made by David Schultz to deny the variance
instead give the appeltant an extension of time until November,
1988 to bring Exterior wails and windows and associated building
parts into compliance. Seconded by Robert Viering. MO"fION

has been working with Pat Fish, from Fire Prevention and Ms. Fish
has suggested that installing one Key Box on the center building
posting a notice as to the location of the Key Box in case of an
emergency. Pat Fish advised the Appeilant to send a check along
with an application to the Fire Department . this must be signed by
the Fire Marshall and mailed to California to obtain a Key Box.
BOARD ACTIUN: Motion made by Dave Schultz to deny the request for
a variance on the Key Box, instead grant an extension of time 30
days (September 9, 1988) to compiete the installation of the Key
Box on the Center Building with the provision that a sign be

PRUCEEUINGS: 7he Appell�nt owns the building. He operates a gun
shop. The shop specializes in reloading shells , consequently,
there is powder in the building. The powder is non-propellant.
Fire Prevention is requesting that ail flammables, explosive
powder, be removed from the basement.
Sherry Webb, from Fire Prevention addressed the issue on smoking
in the building. because of the powder that is stored in the
building.
Mr. Johnson stated that the Fire Department wants to allow only

he sells more than 2U pounds per day, the average is about 40
pounds. The appellant carrries 53 different kinds.
The Fire Department wants Placard on the building. Mr. Johnson
understands this to mean that the "Fire Fighters do not fight
this fire". Appeliant is requesting to keep 100 pounds in the
shop and will store the rest away from the building.
Sherry Webb, from Fire Prevention stated that State Code 8
Legislative Codes classify Black Smokeless Powder (Smokeless
Propeliants) as a Class B explosive. If more that 100 pounds is
transported in a car, than the Appellant is required by Department
of Transporation (DOT) to Placard.
A shop (according to code) is allowed to have 100 pounds on the
premises, 20 pounds on display and the rest (80 pounds) stored in
magazines.

Ms . Webb, informed the Board that the Building has four (4)
a�artments above the shop.
The reason for the placard on the building is that the Fire
Fiahters are notil=ied that explosives are contained in the
building.
The powder is in small containers , not bulk containers .
