South 89 degrees 52 minutes 38 seconds East a distance of 12.92 feet to the northwest corner of

That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the Ciry to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Said utiliry
easement shall be subject to the following conditions:
a. No buildings, structures, uees or any temporary structure, material storage, fisture, or any
other objects that will prohibit normal access to utiliry facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the Ciry from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restorauon
and costs of such unprovements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Works.
e. The petiuoner, its successors and assigns shall indemnify, defend, and save harmless the
City of Saint Paul, its officers, agents, employees, and servants from all suits, actions, or
claims which shall arise from any injuries ar damages received or sustained by any break
in any service pipe or connection in said reserved easement arising out of or resulting
from any acuon or negiigence of the peuuoner, its employees, agents, or business
invitees.
That a permanent u6lity easement shall be retained within the vacated area on behalf of the City
of Saint Paul, Board of Water Commissioners subject to the following restrictions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
other object that will prohibit normal access to water facilities for maintenance purposes

of Northern States Power Company.
That a permanent easement shall be granted by the owner(s) of I,ot 17, Woodford Pazk Addition,
to the owner(s) of Lot 18, Woodford Park Addition, over the entire vacated area accruing to said
Lot 17, for a sewer service connection belonging to said Lot 18.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or ciaims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or peUtioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the peritioners or any of their agents or employees.
21 7. That the petitioners, their successors and assigns shall, within 60 days of the effecuve date of this
22 resoluuon, file with the City Clerk an acceptance in writing of the condirions of this resolution
23 and shall, within the period(s) specified in the terms and condiuons of this resolution, comply in
24 all respects with these terms and conditions.

I am requesting a date of Apri17, 1999 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of Pleasant Avenue,
north of Otto Avenue and West of Lexington Parkway, allowing the petitioners to fence
in this excess right-of-way area when it accrues to their properties.
The utiliries and usual City offices with rights to the area being vacated have a11
responded to our inquiries regarding the proposed vacation. Their responses are with the
resolution as it is being routed for signatures. The resolution is currenUy awaifing Peter
Hames' signature.
I have attached a copy of the green sheet, the Council Resolution, and a map of the area
to be vacated. Please let me l�ow if there is anything else you might need far this.

The additional area that we are petitioning for includes the area added to Don's
lot (716 S. Lexington Pkwy.) and my lot (1460 Pleasant Ave.) by the redirection
of Pleasant Avenue some years ago. This area was added to Don's original lot,
now bounded by sidewalks on the South (Otto street sidewalk) and West
(Lexington street sidewalk). The addition to my lot is now bounded by the
sidewalk to the West (Lexington street sidewalk), our North lot line, adjacent to
Pleasant.
We request this are for the following reasons:
• Recreational use — would like to errect a chain link fence to enclose the yard
for pets.
• Protect gardens.
• Privacy.
Any reasonable interest the city has to maintain systems lying below, within, or
above this land wilf be accomidated.

We have reviewed the surveys submitted and approve the legal descriptions for
inclusion in the vacation resolution.
Also, please note that in addition to the permanent utility easement required over
the entire vacated area, a private easement shalf afso be necessary. The owner of
Lot 17 shall grant an easement to the owner of Lot 18, over the entire vacated area
accruing to Lot 17, for a sewer service connection belonging to Lot 18. See attached.

The Water Utility has a 12-inch and 6-inch water main in that part of Pleasant Avenue proposed for
vacaCion. To provide for continued access to our facility, the Water Utility requires an easement be
retained over the entire part of Pleasant Avenue being proposed far vacation.
Restrictions within the azea are as follows:
1. No buildings, structures or trees aze permitted within the easement area, or any
temporary struchu•e, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water UCility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petirioner's works or improvements be removed or
damaged as a result of Water Utility operat3ons, all removal, replacement or
modification costs shall be borne solely by the petitioner.
4. That the petitioner, its successors and assigns shall fu11y indemnify, defend and
save harmless the Boazd of Water Commissionexs, its officers, agents, employees
and servants from a11 suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negiigence of the peritioner, its employees, agents or business invitee.

That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the Ciry to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Said utiliry
easement shall be subject to the following conditions:
a. No buildings, structures, uees or any temporary structure, material storage, fisture, or any
other objects that will prohibit normal access to utiliry facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the Ciry from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restorauon
and costs of such unprovements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

claims which shall arise from any injuries ar damages received or sustained by any break
in any service pipe or connection in said reserved easement arising out of or resulting
from any acuon or negiigence of the peuuoner, its employees, agents, or business
invitees.
That a permanent u6lity easement shall be retained within the vacated area on behalf of the City
of Saint Paul, Board of Water Commissioners subject to the following restrictions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or

Lot 17, for a sewer service connection belonging to said Lot 18.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or ciaims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or peUtioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the peritioners or any of their agents or employees.
21 7. That the petitioners, their successors and assigns shall, within 60 days of the effecuve date of this
22 resoluuon, file with the City Clerk an acceptance in writing of the condirions of this resolution
23 and shall, within the period(s) specified in the terms and condiuons of this resolution, comply in

I am requesting a date of Apri17, 1999 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of Pleasant Avenue,
north of Otto Avenue and West of Lexington Parkway, allowing the petitioners to fence
in this excess right-of-way area when it accrues to their properties.
The utiliries and usual City offices with rights to the area being vacated have a11
responded to our inquiries regarding the proposed vacation. Their responses are with the
resolution as it is being routed for signatures. The resolution is currenUy awaifing Peter
Hames' signature.
I have attached a copy of the green sheet, the Council Resolution, and a map of the area

The additional area that we are petitioning for includes the area added to Don's
lot (716 S. Lexington Pkwy.) and my lot (1460 Pleasant Ave.) by the redirection
of Pleasant Avenue some years ago. This area was added to Don's original lot,
now bounded by sidewalks on the South (Otto street sidewalk) and West
(Lexington street sidewalk). The addition to my lot is now bounded by the
sidewalk to the West (Lexington street sidewalk), our North lot line, adjacent to
Pleasant.
We request this are for the following reasons:
• Recreational use — would like to errect a chain link fence to enclose the yard
for pets.
• Protect gardens.
• Privacy.

Also, please note that in addition to the permanent utility easement required over
the entire vacated area, a private easement shalf afso be necessary. The owner of
Lot 17 shall grant an easement to the owner of Lot 18, over the entire vacated area
accruing to Lot 17, for a sewer service connection belonging to Lot 18. See attached.

The Water Utility has a 12-inch and 6-inch water main in that part of Pleasant Avenue proposed for
vacaCion. To provide for continued access to our facility, the Water Utility requires an easement be
retained over the entire part of Pleasant Avenue being proposed far vacation.
Restrictions within the azea are as follows:
1. No buildings, structures or trees aze permitted within the easement area, or any
temporary struchu•e, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water UCility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petirioner's works or improvements be removed or
damaged as a result of Water Utility operat3ons, all removal, replacement or
modification costs shall be borne solely by the petitioner.
4. That the petitioner, its successors and assigns shall fu11y indemnify, defend and
save harmless the Boazd of Water Commissionexs, its officers, agents, employees
and servants from a11 suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negiigence of the peritioner, its employees, agents or business invitee.

That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the Ciry to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Said utiliry
easement shall be subject to the following conditions:
a. No buildings, structures, uees or any temporary structure, material storage, fisture, or any
other objects that will prohibit normal access to utiliry facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the Ciry from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restorauon
and costs of such unprovements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or ciaims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or peUtioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the peritioners or any of their agents or employees.

The additional area that we are petitioning for includes the area added to Don's
lot (716 S. Lexington Pkwy.) and my lot (1460 Pleasant Ave.) by the redirection
of Pleasant Avenue some years ago. This area was added to Don's original lot,
now bounded by sidewalks on the South (Otto street sidewalk) and West
(Lexington street sidewalk). The addition to my lot is now bounded by the

inclusion in the vacation resolution.
Also, please note that in addition to the permanent utility easement required over
the entire vacated area, a private easement shalf afso be necessary. The owner of
Lot 17 shall grant an easement to the owner of Lot 18, over the entire vacated area
accruing to Lot 17, for a sewer service connection belonging to Lot 18. See attached.

The Water Utility has a 12-inch and 6-inch water main in that part of Pleasant Avenue proposed for
vacaCion. To provide for continued access to our facility, the Water Utility requires an easement be
retained over the entire part of Pleasant Avenue being proposed far vacation.
Restrictions within the azea are as follows:
1. No buildings, structures or trees aze permitted within the easement area, or any
temporary struchu•e, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water UCility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petirioner's works or improvements be removed or
damaged as a result of Water Utility operat3ons, all removal, replacement or
modification costs shall be borne solely by the petitioner.
4. That the petitioner, its successors and assigns shall fu11y indemnify, defend and
save harmless the Boazd of Water Commissionexs, its officers, agents, employees
and servants from a11 suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negiigence of the peritioner, its employees, agents or business invitee.
