� Section 1.
� That Section 60.532 of the Saint Paul Legislative Code be amended by
adding new clause (g) to read as follows:
(g) Colleges, universities, and seminaries, and other such institutions

to a more than 10% gain in the number of employees, staff, or

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That Section 60.532 of the Saint Paul Legislative Code be amended by adding
new clause (g) to read as follows: .
(g) Colleges. universities. and seminaries. and other such institutions of

(i) dormitories or other group student housing shall not be permitted
within the district;
(ii) when an institution is established in the district. the institu-

Section 62.102(g)(2)(e) . The institution shall be required to
vrovide additional parking svaces onlv when the minimum number of

Districts
At the Planning Commission's May 27 public hearing, a representative of Concordia
College and the Chamber of Commerce spoke for the proposed amendment and a
representative of the Merriam Park Community Council spoke against the amendment.
Merriam Park's views are attached.
In response to Merriam Park's views, staff makes the following comments:
(1) Allowing schools to locate in business and industrial areas can benefit an area
by putting vacant property to use.
(2) Spin-off effects such as students patronizing local merchants can benefit
business areas.
(3) Allowing schools to expand in business areas can help reduce development
pressure from school campuses in residential areas.
(4) The proposed amendment will not change whether schools may lease or buy property
in zoning districts in which they are permitted.
(S) Parking demand for school use can be higher than some other business. The
important thing is to require that schools provide parking to meet the demand
� when they are established. The amendment does this.

On May 25, 1988, the Merriam Park Community Council unanimously passed
the following motion regarding changing the zoning code to allow non-profit
schools in business and industrial zones:
"that the Merriam Park Community Council strongly opposes the
proposed zoning change for the following reasons:
1) The tax base of St. Paul is important for everyone
in the city, and allowing not-for-profit schools
in business and industrial zones means taxable
businesses will be forced to compete With non-taxable
operations for locations. As it is, non-profit
schools may lease buildings for their operations.
This practice works, without removing potential
taxable development.
2) Parking requirements for school proqrams can be greater
than many other businesses. For-profit businesses
may have to compete with school programs for parking
' space if a trend is encouraged for non-profit schools
to lxate in business and industrial zones".

WHEREAS, the Planning Co�ission on November 7, 1986, initiated a 40-acre study of
colleges, universities, and seminaries for the purpose of amending the Zoning Code;
and
WHEREAS, the Zoning Committee of the Planning Commission reviewed a suggested
amendment and recommended a public hearing; and
WHEREAS, pursuant to Minnesota Statutes 462.375(5) , the Planning Co�ission held a
public hearing on the proposed amendment at its May 27� 1988 meeting; and
WHEREAS, the Planning Co�ission has determined:
1. That the number of real estate descriptions affected by the amendment renders
the obtaining of written consent impractical;
2. That a survey of an area in excess of 40 acres has been made;
3. That a determination has been made that the amendment to the Zoning Code
proposed is related to the overall needs of the community, to existing land use,
and to plans for futuze land use; and
4. That pursuant to State Statutes proper notice of the hearing was given in the
Pioneer Press and Dispatch on May 6, 13, and 20, 1988.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission recommends approval of
the Zoning Code amendment attached hereto in the 40-acre study proposing to permit
colleges, universities, and seminaries in B-2, B-3, I-1, and I-2 districts and
directs the Planning Administrator to forward the study and this resolution to the

COLLEGE ZONING II
40-ACRE STUDY
(Colleges, Universities, and Seminaries
in B-2, B-3, I-1 and I-2 Districts)

Purpose. The purpose of this 40-acre zoning study is to amend the zoning
code text so as to allow non-profit colleges, universities, and seminaries
in the B-2, B-3, and I-1 districts.
Back�round. Metropolitan State University intends to move from downtown
to the old Saint John's Hospital site in Dayton's Bluff.
The Port Authority has a purchase agreement to acquire the 9.2 acre site
from Healtheast. The Authority has also negotiated an agreement with the
State to deed it a three acre parcel fronting on Mounds Boulevard (parcel
1) and to grant it an option to acquire a five acre parcel on both sides
of Maria (parcel 2) . The Authority also will sell to private parties a
one acre parcel fronting on East Seventh for commercial use (parcel 3) .
After the Authority demolishes the existing building on parcel 1, the
State will construct a new building to house an Administrative and Student
Service Center and some classrooms. On parcel 2 the State will retain the
parking lots and reuse both existing buildings for Metropolitan State
University and Lakewood Community College. (Maps 1 and 2 show the site
and proposed reuses; Attachment A describes in greater detail the
Authority's agreements.)
The B-2 district is the most appropriate zone for the uses proposed for
the site. A significant component of the University use will be office
use. The B-2 district gives flexibility to the University to rent some of
the space to non-school office users if it wishes. The B-2 district will
also allow neighborhood commercial and office use along East Seventh
Street.
At this time, non-profit colleges, universities, and seminaries are not
allowed in a B-2 district. However, the College Zoning II 40-Acre Study
proposes these schools be permitted uses in the B-2, B-3, I-1 and I-2
districts. The study's reasons for allowing them in the districts is
given below.
40-Acre Study. "Currently, non-profit college, university, and seminary
, uses are only allowed as special condition uses in residential zones and
as permitted uses in the downtown business zones (B-4 and B-5) . Many of
the uses associated with colleges, universities, and seminaries, such as
classrooms, student activity centers, parking facilities, etc. , are
similar to uses currently permitted in the B-2 and B-3 neighborhood
business zones. Among the uses permitted now in these zones are business
schools, non-academic colleges, and trade schools operated for profit.

There appears to be no significant difference in terms of land use and
impact on ad,joining properties between non-profit colleges, universities,
and seminaries, and for-profit business schools, trade schools, and non-
academic colleges. Therefore, it is logical that the non-profit
institutions be allowed as a permitted use in the B-2 and B-3 neighborhood
commercial zones along with for-profit schools. In addition, all B-3
permitted uses are allowed in the I-1 (light industry) and [I-2] zones, so
non-profit colleges, universities, and seminaries would be allowed uses in
I-1 [and I-2] along with for-profit schools. In order to protect the
existing character of development in these zones, college, university, and
seminary uses should be subject to the same area, bulk, and yard setback
requirements established in the Code for these zones, rather than the
requirements found in residential zones for these uses."
"[This recommended amendment] also affects parking. The general parking
requirement for colleges, universities, and seminaries is based on the
number of students, employees, and dormitory beds. To determine
compliance with this requirement, annual monitoring of student, employee,
and dormitory bed levels at each of the schools is needed. Annual
reporting of this information to City staff is a required condition for
colleges, universities, and seminaries as special condition uses in
residential zones. Monitoring of parking standard compliance will be ,just
as difficult for these uses in the B-2, B-3, . . . I-1 [ , and I-2] zones
where they would not be special condition uses. To insure parking
standard compliance in these zones, each school should be required to
annually report changes in students and employees to City staff as a
reauired condition for a permitted use in the B-2, B-3, . . . I-1
( , and I-2] zones. "
"A final impact of [the recommended amendment] that must be considered is
the effect on the regulation of fraternities, sororities, and dormitories.
Currently, the Code allows these uses on a campus or within 250 feet of a
campus property line. The intent of [the recommended amendment] is to
allow college uses in business zones, but not to allow group student
housing to locate near it in adjacent residential neighborhoods.
Therefore, the Code should be clarified to allow fraternities and
sororities only within 250 feet of a campus boundary as defined in a
special condition use permit issued for a post-secondary institution in a
residential zone. Further, group student housing, such as dormitories,
fraternities, and sororities, is not an appropriate use in conjunction
. with colleges, universities, and seminaries in neighborhood business or
industrial zones, and should be specifically excluded from these zones."
Staff Recommendation. Staff recommends that the zoning code be amended to
permit non-profit colleges, universities, and seminaries to locate in B-2,
B-3, I-1, and I-2 districts. The proposed amendment, attachment B, is in
slightly different form than that proposed in the College Zoning II 40-
. Acre Study, draft dated November 5, 1987.

Metropolitan State Universtty, an upper divisio� member of the Minnesota Stafie
University System, was established in 1971 to serve the educational needs of
adults in the Twin Cittes Metropolitan Area, where the needs were not served
by existing educationai institutions. The University, which ts accredited by
the Canmission on Institutions of Higher Education of the North Central
Association vf Coileges and Schoois, offers three degree programs - an
tndividualized Bachelor of Arts, a Bachelor of Arts in Nursing and a Master ot
Management and Administratlon. The Untversity a�nttted its first students in
1972. The University has grown steadily since that time and has acquired a
national reputation for its successtul approach to high qusilty adult
education. Metropolitan State University cooperates with the other members of
tfie Minnesota State Un(�ne�sity System and has established relationships with
many I xal and state educatlonal institutions, particularly community colleges
� � and area vocational technical schools.
Metropolitan State University has three main ciassroom centers located in
Saint Paul and Minneapolis. In addition, the University uses existing space
in community facilities, public and private schoois, hospitals and government
aenters throughout the Metropolitan Area to provide for centrally !xated and
easlly accessible classroan space for its students. In 1985/1986 over 42� of
the ciassroan space utilized by Metropolttan State Unlversity was donated.

Port Authorlty staff has been working with Metropolitan State University sfnce
July of 1987, when we first met rith them to discuss their need for a new
Admintstrative Center. The University currentiy leases in excess of 32,000
square feet in the Metro Square Office Building in Downtown St. Paul . In
November of 1987 and January of 1988, the University�s need for space became a
more publicized issue as a result of the City of Mtnneapolis attempting to
lure the University out of Saint Paul . The result of the much publici2ed
effort to relocate Metropolitan State University was that the State Untversity
System Tssued a Request for Proposals to the City of Saint Paul and to
Minneapolis. The Port Authority Korked closely with the Mayor�s Office and
staff of the City's DeparFment of Planning and Economic Development to respond
to the State University System's formal Request for Proposals to locate the
AdministratTve and Student Services Center for Metropolitan State University.
As a result of these efforts, on January 28, 1988, the State University Board
u�anim�usly voted to recommend the Saint John's Hospital site on Saint Paui 's �
Near Eastside as tfie location for the new headquarters center for Metropolitan
State University.
3. TERMS aF MREEIrEtrT
The Saint Paul Port Authority has been negotiating with officers of
HealthEast, and has reached agreement with HealthEast for the acquisttlon of
the 9.2 acre Saint John's Hospital site. in addition, terms have been reached
with the State University System to give the State approxtmately three acres
of this site for 51.00 whict� satisfies the State's request for free land for
new Untversity development. Agreement has also been reached Nith the State of
Minnesota to sell an additional parcel of approxirr�tely five acres of land to
the State for further University expansion. �

. - Under the terms of the proposed Purchase Agreement, the �
Port Autfiority wouid acqutre the 9.2 acre site from HealthEast for �51.3 �
militon in cash, or 31.5 miilTon tf payment was tendered over an 18�
month period. The Purchase Agreement would be spectfically contingent
upon Legislative approva.l of the Satnt John�s Hospttai site for the
location of the Metropolttan State University Administration and Student
Services Center, and� the commitment of funds for design, plann(ng and ,
engtneering of the facility durTng 1988 Legtslative session. The
agreement to purchase the site would expire on June 30, 1988, o� upon
negative Legislative action regardi�g the Saint John's site for
Metropoittan State University provided, however, that at its option the
Port Authority could raive the condttion for Legisiattve approval of the
stte, and proceed with the acquisition, and further provided that the
Port Authority and HealthEast can extend the closing deadline beyond
June 30 if it is mutually agreeable.

B. SALE TA STATE � MINNESdTA
Under the agreements negotiated with the State of Minnesota, State
University Board System, the Port Autho�ity would transfer tltle to a
parcel within the site of approximately three acres fronting Mounds
Boulevard between Sixth and Seventh Streets, where the current main
hospital compiex is located. In addition, the Port Authority would
grant the State of Minnesota an option to acquire additional parcels of
approximately five acres, which include the existing A and C hospital
buildings and the entire parking lot East of Maria Avenue. The price
for this additional property would be E1.3 million if the State
exercised its option immediately upon transfer of title to the initiai
parcel , and 51.5 miilion if• the State exercised that option within a
three year period. .
C. DEi�1 T I ON OF THE MA I N HOSP 1 TAL LbMi�l_DC
Under the terms of the negotiations with the State of Minnesota, the
Port Authority Nould at its expense demolish the main hospTtai complex
(B Butiding), as weil as remove minor amounts of asbestos casing from
the heating pipes in the A and C wings. To unde nrrite the costs of this
demolition, the Port Authority would seil its interest Tn the two smali
buiidings located on the remaining one acre parcei fronting East Seventh
Street between Mounds Boulevard and Maria. The preliminary estimates
for this demolition work are between 5600,000 and E700,000. The Port
Authority wili recover as much of this amount as possible from the sale

Dear President Scheibel and Council Members:
On June 10, 1988, the City Planning Commission adopted a resolution
recommending that the zoning code be amended to permit non-profit
colleges, universities, and seminaries in B-2, B-3, I-1, and I-2
districts. The Commission held a public hearing on the proposed amendment
on May 27, 1988. A copy of the resolution and a staff report are
attached.
The Commission proposes that non-profit schools be permitted in B-2, B-3,
I-1, and I-2 districts because they are similar to other uses currently
permitted, such as for-profit schools. The amendment will require the
schools to provide one off-street parking space for each three students '
and staff and does not permit dormitories, sororities, or fraternities in
the districts.
At the public hearing, two people spoke in favor of the proposed amendment
and one person representing Merriam Park spoke against. Merriam Park's
views and staff comments are attached.
The proposed amendment was part of the College Zoning II, 40-Acre Study.
That study, undertaken by the Planning Commission's College Zoning
Committee, will be making recommended zoning changes to the special
condition use regulations of colleges, universities, and seminaries in
residential districts later in the year. The proposed amendment is being
brought forward at this time so that the move of Metropolitan State
University to the old Saint John's Hospital site can go forward.
