RESOLVED, that upon the petition of James A. Stolpestad, per
Finance File No. 4-1987 , that part of the alley lying adjacent to
Walsh Park as platted in West End Addition and bounded by
Edgcumbe Road, Albion, Lexington, and i�Iontreal hereinafter
described, be and the same is hereby vacated and discontinued as
public property.
All that part of the alley lying between Block 1,
�dgcumbe Place Addition to the City of Saint Paul , Ramsey
County, i�iinnesota , and Walsh Park as dedicated in the
plat of West End which lies westerly and southerly of the
southerly extension of the most easterly line of Lot 4 of
said Edgcumbe Place Addition and lies westerly and
southerly of the northeasterly extension of the
southeasterly line of said Walsh Park; and lies
northerly and easterly of the southeasterly extension of
the northeasterly line of Lot 5 of said Edgcumbe Place
Addition.
Subject expressly to the following terms and conditions :
1. That the vacation be subject to all the terms and
conditions of Chapter 130 , codified March 1, 1981, of
the Saint Paul Legislative Code, as amended.
2 . That the petitioner , his heirs and assigns shall pay to
the City $1 ,560 as compensation for the half of the
alley which will accrue to Lot 4 , Block 1, Edgcumbe
Place Addition as a result of this vacation. Said
compensation is due and payable within 60 days of the
publication date of this resolution.

3 . 'I�hat the City Council hereby authorizes the proper City
officials to convey by Quit Claim Deed any and all
interests the City may have to the other half of the
vacated alley which will accrue to the City of Saint
Paul , Division of Parks & Recreation by operation of
this resolution for the additional consideration of
$1 , 560 . `Phe Division of Parks & Recreation has
indicated it has no need for this part of the vacated
alley and has approved that it be conveyed to the
petitioner. The Quit Claim Deed shall specify that it
is subject to all terms and conditions of this
resolution. The legal description of the property to
be conveyed is as follows :
All that part of the southerly, southeasterly
and easterly one-half of the vacated alley as
originally platted in West End and adjoining
Walsh Park described as follows:
All that part of the vacated alley lying between
131ock l, Edgcumbe Place Addition to the City of
Saint Paul , Ramsey County, I�innesota , and Walsh Park
as dedicated in the plat of West End which lies
westerly and southerly of the southerly extension of
the most easterly line of Lot 4 of said Edgcumbe
Place Addition and lies westerly and southerly of
the northeasterly extension of the southeasterly
line of said Walsh Park; and lies northerly and
easterly of the southeasterly extension of the
northeasterly line of Lot 5 of said Edgcumbe Place
Addition.
4 . That a permanent sewer easement be retained on behalf of

the City of Saint Paul, Department of Public Works on ,
over, and across the most easterly 15 feet of the
vacated alley which lies westerly of and parallel to the
southerly extension of the most easterly line of Lot 4 ,
Block 1, Edgcumbe Place Addition and lies westerly of
and parallel to the northeasterly extension of the
southeasterly line of Walsh Park in V�est End . This
permanent sewer easement shall be subject to the
following conditions :
a. No buildings, structures or trees are permitted
within the easement area nor any temporary
structure , material storage, fixture or other
objects that will prohibit normal access to sewer
facilities for maintenance purposes .
b. No change from the existing grade is permitted
without written permission from the Director of the
Department of Public Works.
c. No change in surfacing within the easement area is
permitted without written permission from the
Director of the Department of Public Works .
d. That the petitioner, his heirs and assigns shall
indemnify, defend, and save harmless the City of
Saint Paul, its officers, agents, employees, and
servants from all suits, actions , or claims which
shall arise from any injuries or damages received or
sustained by any break in any service pipe, or
connection in said reserved easement, arising out of
or resulting from any action or negligence of the
petitioner, its employees, agents, or business
invitees .
5. That a permanent easement be retained within the vacated
area to protect the interest of Continental Cablevision.
6 . That the petitioner , his heirs and assigns shall extend
the drainage swale along the existing dedicated easement
located in Lots 3 , 4 and 5, Block 1, �.dgcumbe Place
Addition, from the southeasterly line of Lot 6 of said
Addition to the southeasterly line of said Lot 3 . That
the petitioner, his heirs and assigns shall also extend
the drainage swale along the existing easement ,
dedicated in Edgcumbe Place Addition, which is centered
along the southeasterly line of said Lot 3 . These
drainage swales shall be subject to the following
conditions :
a . The petitioner , his heirs and assigns shall pay all
costs and expenses for the construction of the
drainage swales . �
b. The drainage swales shall be constructed in the same "��
manner and dimensions as the section or shaping of ��

the swale that is already existing along the
dedicated easement in Lot 6, Block 1 , Edgcumbe Place
Addition .
c. That the drainage swales shall be constructed by
November 1, 1988 .
d. �rhat these drainage swales shall be constructed in
accordance with all applicable codes and ordinances
and shall be subject to the approval of the Sewer
Engineer, Department of Public Works.
7 . '1'hat the petitioner , his heirs and assigns shall , at his
own expense, place additional fill over the sanitary
sewer constructed under Ordinance Permit #138 to serve
the plat of Edgcumbe Place Addition so that the ground
surface is not less than six feet from the top of the
existing sewer pipe. Placement of this additional fill
shall be completed by November l, 1988 , and shall be
subject to the approval of the Sewer Engineer,
Department of Public Works .
8. That the petitioner, his heirs and assigns shall provide
temporary erosion control silt fencing for all excavated
areas subject to the approval of the Department of
Public Works .
9. That the petitioner , his heirs and assigns shall deliver
a letter of credit in the amount of $5 ,000 to the City
of Saint Paul within 60 days of the publication date of
this resolution for the payment of a forty foot (40 ' )
drainage pipe extension in Walsh Park for the purpose
of intercepting natural spring water. The terms of such
letter shall be subject to the approval of the City
Attorney's Office. The petitioner understands and
acknowledges that the payment of $5, 000 for this
drainage pipe is a necessary condition for the approval
of this vacation only, and is necessitated by
petitioners proposed use of the property to be vacated
and the use of adjoining property.
In the future, assessments may be levied against
properties owned by petitioner , his heirs and assigns in
this area for separation of the sanitary sewer system
and the creation of a storm water sewer system. This
$5 ,000 charge is in no manner related to any future
assessments that may be levied for these other
improvements.
10 . `Phat the petitioner , his heirs and assigns , by
acceptance of the terms and conditions of this vacation,
agree to idemnify, defend , and save harmless the City of
Saint Paul, its officers, and employees from all suits ,
actions , or claims of any character brought as a result
of injuries or damages received or sustained by an � ��

Gentlemen:
I have been asked to represent that neighbors who appeared at a
meeting yesterday in connection with the vacation of property
abutting Walsh Park.
From the information which they are able to give me, it appears
that the Petitioner has not furnished sufficient information to
enable either the Council or the neighbors to determine his reason
for requesting the vacation as it relates to the existing plat.
It appears that the plat which is now of record is being changed
and that change is not made a part of these proceedings .
The copy of a proposed plat which is attached to the notice sent
to the Highland Area Community Council shows only a portion of the
total. It does not identify in any meaningful way the lots and
blocks wr,ich are to be a part of that plat.
Without this information, it appears to me that it is impossible
for either the Council or the neighbors to make an informed judg-
ment as to Mr . Stoplestad' s petition nor is it clear from his
petition where the property now designated as alley originally
came from.
In any event, since this is presently city property, it does not
seem appropriate the City should be giving up its interest in
property which is more appropriately a part of the park.
I have a prior commitment for the time of the hearing, and I have
requested this letter be presented in my behalf with the request

that the matter be tabled for an appropriate period of time so
that a complete examination can be made of all of the records to
determine what objection should be made to the proposed vacation.
It would appear to me that an appropriate delay of 30 days would

We, the Department of Fire and Safety Services have reviewed
your plans.
Theland recommendedfor vacation bordering "Walsh Park" is unimproved
land consisting of trees and brush. The whole area including
Dawson Park is unimproved with no access. The area is all trees
and brush and any fire fighting would be done on foot. Unless
the city plans on developing this park in the future, vacation
would not make any difference for fire fighting.

maintenance of the existing sewer described as lying over the easterly 15 feet of the
proposed alley vacation. See the attached map. The usual conditions must apply over
this easement area.
A 15 foot wide permanent sewer easement must be retained for the protection and
maintenance of the proposed sewer to be constructed along the easterly extension of
the common lot line between lots 4 and 5, Block 1, Edgcumbe Place Addition
described as lying over the westerly 15 feet of the proposed alley vacation. See the
attached map. The usual conditions must apply over this easement area.
The petitioners plan to construct a new sanitary sewer along the common lot lines as
indicated above. An easement must be deeded to the City for sewer purposes in a
manner and form approved by the City Attorney and to the satisfaction of the Sewer
Engineer of the Department of Public Works.
The vacation of this portion of the existing alley right-of-way will create a dead-end
situation over the remaining alley around Walsh Park. Due to the extreme terrain factor
of the property in this area a turn-around will not be required.
Therefore, the Department of Public Works has no objections to the proposed vacation,
subject to the easements and conditions as indicated above.

Continental Cablevision presently has cable attached to
poles in the alley adjacent to Walsh Park. This cable
may pass through the portion of the alley designated for
vacation; it is difficult to ascertain the exact relation
of the poles and aerial lines to the platted alley at this
location. I have enclosed a copy of the print of the
area with the poles and lines shown approximately.
If, in fact, the lines do pass through the vacated area,
we will have no objection to the vacation if we can
maintain an easement for the lines as long as the poles
remain in their current position.

PETITION FOR VACATION OF PART OF PUBLIC ALLEY
TO: President and Members of Saint Paul City Council
The undersigned hereby petition the City of Saint Paul
(the "City" ) as follows:
1. Petitioners James A. Stolpestad and Merrie W.
Stolpestad, husband and wife, 658 Montcalm Place, Saint Paul,
Minnesota, own Lot 4, Edgcumbe Place Addition, Saint Paul,
Minnesota.
2. Petitioners Terrence E. Troy and Isabel A. Troy,
husband and wife, 1594 Edgcumbe Road, Saint Paul, Minnesota, hold
a mortgage on �ot 4, Edgcumbe Place Addition.
3. The City of Saint Paul, as the owner of Walsh Park,
West End Addition to Saint Paul, is the only other property owner
abutting those parts of the alley described below to be vacated
other than the petitioners.
' 4. Petitioners request the City to vacate that part of
the unimproved public alley located adjacent to and South and
Easterly of Lot 4, Edgcumbe Place Addition, between Lot 4 and
Walsh Park, West End Addition to Saint Paul, more particularly
described as follows:
That part of the alley located in Hlocks 11
and 15, West End Addition to Saint Paul, lying
Southerly and Easterly of the following
described line ( "Line A" ) : Commencing at the
Southeasterly corner of Lot 4, Edgcumbe Place
Addition, thence North 75 degrees 25 minutes
36 seconds West a distance of 181.96 feet,
thence South 65 degrees 44 minutes West a
distance of 55.60 feet, thence South 10
degrees 50 minutes West a 3istaace c€ 25.55
feet and there terminating; lying Northerly
and Westerly of a line drawn to, Southerly and
Easterly of, and 30 feet distant from Line A;
lying Westerly of the Southerly extension of
the Easterly line of Lot 4; and lying
Northerly of the Easterly extension of the
Northerly line of Lot 5, Edgcumbe Place
Addition.
5. Petitioners request that the full 30 foot width of
the vacated alley accrue to Lot 4 and that any costs relating to
the vacation of that part of the alley located adjacent to Lot 4
be paid by petitioners James A. Stolpestad and Merrie W.
Stolpestad.
