An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Rihm Motors duly petitioned to rezone 2109 University Avenue
located on the northwest corner at Transfer Road from I-2 to I-1 for the
purpose of creating a single zoning lot with an adjacent parcel ; the petition
having been certified by the Planning Division on November 20, 1987 as having
been consented to by at least two-thirds of the owners of the area of the
property to be rezoned, and further having been consented to by at least 67%
of the owners of the property situated within 100 feet of the total contiguous
property within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on December 3, 1988 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on December 4, 1988 and recommended that the City Council approve
the petition; and
WHEREAS, Notices were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the property sought to
be rezoned; and

having considered all the facts and recommendations concerning the petition;
now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 9, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:

Dear Sir:
On December 3, 1987 the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 6 to 0 to approve the rezoning based on
staff findings.
On December 4, 1987 the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on January 21, 1988.

WtiEREAS� Rihm Motor Company� Inc. � file #10224� has petitioned to rezone 2109 West
University Avenue situated on the northwest corner at Transfer Road from I-2 to
I-1, for the purpose of creating a single zoning lot with an adjacent parcel; and
WHEREAS, the Zoning Committee of the Planning Commission on December 3� 1987, held a
public hearing at which all persons present were given an opportunity. to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS� Saint Paul Planning Commission� based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:
1. The applicant's parcel is used for outdoor truck storage and display. The
parcel to the west� zoned I-1, has been purchased and the intent is to expand
the operation onto that parcel.
2. As defined in Section 60.212 for more than one parcel to be developed as a unit,
the zoning district of all parcels must be the same.
3. It is the intent of the I-1 industrial district to accommodate wholesale and
warehouse activities, and industrial operations whose external, physical effects
are restricted to the area of the district and in no manner affect the
surrounding districts in a detrimental way. Trucking facilities are a permitted
use in the I-1 zone.
4. An obscuring fence is a required condition for outdoor storage areas according
to Zoning Code Section 60.613(1), however, since the use is already established
on this property it is considered a nonconforming condition. If, however, the
use changes on this property an obscuring fence for outdoor storage would be
required.
5. The District 11 Plan supports rezoning of I-2 properties to I-1 in this area
because the district believes "that, at some future date, development of heavy
industrial uses would be incompatable with the existing industries in the area."

6. The Comprehensive Plan industrial land use policy objective encourages the
maintenance of industrial land and the efficient use of the land. The rezoning
would create a more logical parcel and allow for more efficient development of
two under-utilized parcels.
7. Rezoning this property would be a logical extension of the I-1 zone on the
northwest side of University Avenue. In addition� Transfer Road to the east and
the railroad tracks to the north provide a natural break between the I-1 and the
I-2 zone.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of Rihm Motor Company� Inc. to rezone property at 2109 West University
Avenue more particularly described as Lot 1, Block 1, Transfer Road Addition, from
an I-2 zoning classification to an I-1 zoning classification is consistent with the
Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
reco�end to the Council of the City of Saint Paul that property located at 2109
West University Avenue be rezoned from I-2 to I-1 in accordance with the petition
for rezoning on file with the Saint Paul Planning Division.

classification on a lot proposed for truck storage and display.
The applicant was present. There was no opposition present at the hearing.
Ms. Freese showed slides of the site and reviewed the staff report with a
recommendation for approval.
Winfield A. Mitchell, 412 Midwest Federal Building� representing the
applicant� stated that the rezoning would allow the applicant to expand his
outdoor truck storage and display business.
Hearing no further testimony, Ms. Morton closed the public portion of the
meeting.
Mr. Repke made a motion to recommend approval of the rezoning to I-1 based on
staff report findings 1 through 7. Mr. Christenson seconded the motion which
passed on a roll call vote of 6-0.
