Abstract Property. �E'.AS, based u�pon the records in the Ramsey County Recorder's Office on March 28, 1988 the follawing persons are awners, interested garties or responsible parties of the S�.ibject Property. The awners are Paul G. Bramsen, 1591 S�mtit Avenue, St. Paul, Minnesota 55105; Jtzclith L. Brarnsen, 1591 Sunnit Avenue, St. Paul, Minnesota 55105 (Paul and Judith Bramsen are husband and wife) . Other claimants of an interest in the Subject Property include Western State Bank of St. Paul; St. Paul 503 Development Carrp�any; 9ma11 Business Achninistration; Edward T. Foster; and Dawn M. Wf�tFAS, no action has been taken regarding co�pliance with the July 13, 1988 notice arul order, and as a result the Division of Public Health requested that a public hearing be scheduled to take place on Tuesday, Septgnber 27, 1988 for the City Council to consider the advisability and necessity of ordering the correction of the nuisance condition or in the alternative consider the demolition and re.mpval of these buildings; arid WEIEREAS, the above referenced awners, interested parties and responsible parties have been personally served notice of the time and purpose of the Septelnber 27, 1988 hearing before the Council; WEIEREAS, a hearing was held before the Saint Paul City Council on Sep�nber 27, 1988 and all testimony ar�l evidence was considered by the Council. NOW, TFffi2EF'OiRE, BE IT RESOLVED that based upon all of the testimony and evidence presented at the September 27, 1988 hearing, the Saint Paul City Council hereby adapts the follawing Findings and Order concerning the stn�ctures at 591 Selby Avenue: 1. That in Septeird�er, 1981, the l�uildings located on the Subject Property were determined to be vacant and open to access. The lxxildings have remained vacant and have been either open or boarded since September, 1981. 2. That since Septeinber, 1981, the City of Saint Paul has on nim►erous occasions issued orders to the awners to make these buildings secure ar�l not accessable. On many occasions, because of the inaction on the part of the awners, the City has had to hire a private contractor to make the buildings secure ar�l not open to access. 3. That the awners of the Subject Property have repeatedly failed to register and pay the vacant building fee for this progerty as required by City Ordinance. 4. That there are naw and have been since September, 1981, multiple exterior Housing Code or B�.iilding Code violations in existance at the Subject Property. 5. That the awners, interested parties and responsible parties of these str�tures are as previously stated in this Resolution. These ir�lividuals have been properly served notice of the September 27, 1988 hearing concerning these b�iildings. 6. That on July 13, 1988 an Ab�aridoned Building Notice was sent to the owners, interested parties and responsible parties ordering these persons within fourteen f14) days from the date of the notice to either demolish the buildings or make repairs and correct the list of deficiencies. 7. That the order of July 13, 1988 has been disregarded by the awners, interested parties and responsible parties. � � �� � � ������ . 8. That the one and one-half story wood frame single family Y�use and detached garage located on the Subject Property are abandoned buildings under Section 45.01, Sixbd. 1, of the Saint Paul Legislative Code in that they are "a building or portion thereof which has st.00d unoccupied for longer than one (1) year" ar�l during that period of time have been either "unsecured" or "boarded" or have had "mazltiple exterior Housing Code or Building Code violations". 9. That the one and one-half story woud frame single family house and detached garage located on the Subject Property are a nuisance as defined wlder Saint Paul Legislative Code Section 45.02, Subd. 11, in that they are abandoned b�zildings located in the City of Saint Paul that have created a dangerous or unhP.althy condition or which threaten the public peace, health, safety or sanitary condition of the City or which are offensive or have a blighting influence on the camunity. 10. That the costs of abat�nent of this nuisance are estimated to exceed twoo thousand dollars ($2,000.00) or the abatement inv�olves d�alition of a }�uilding other than a stn�cture accessory to a residential building. ORDER The Saint Paul City Council hereby makes the follawing order: 1. The above referenced owners, interested parties and responsible parties ar�l their assigns shall make the Subject Property safe and not detrimental to the public peace, health, safety, and welfare and remove its blighting influence on the coaYmanity b�y rehabilitating these �zildings and correcting those deficiencies set forth in the list previously referenced in accordance with all applicable codes and ordinances, or in the alternative by dgmlishing the buildings and filling the site in accordance with all applicable codes and ordinances. The rehabilitation or dgr�olition of the building must be c�leted within thirty (30) days of the date of mailing of this resolution. 2. If the above corrective action is not ccxnpleted within the thirty (30) day time period, the proper City officials of the City of Saint Paul are hereby authorized to take whatever steps are necessary to demolish these buildings and fill the site and charge the costs iricurred against the Subject Property pursuant to the provisions of Section 45.08 of the Saint Paul Legislative Code. 3. In the event the buildings are to be denalished by the City of Saint Paul, all personal property or fixtures of any kind which shall unreasonably interfere�with the d�alition and r�r�oval shall be removed from the buildings by the owners, interested parties and responsible parties by the end of the thirty (30) day time period. If the personal property is not so rgnoved, the City of Saint Paul shall r�nove and dispose of such property and fixtures as is provided by law.
