WHEREAS, Sharon Jo Thell has submitted the attached proposed lot split for City
Council approval ; and
WHEREAS, the Departments of Planning and Economic Development and Public Works
have reviewed the proposed split for 1961 and 1963 Nokomis, as described on
the attached survey; and
WHEREAS, the proposed split meets the requirements of Section 67.304 of the
Zoning Code, except for the minimum lot size requirements of 5,000 square feet;
each lot will have 4,716 square feet if split; and that the westerly lot
contains a residence that is 1.4 feet from the rear property line rather than
25 feet as required; and
WHEREAS, the City Council on September 1, 1988 held a public hearing to
determine the advisability and necessity for the granting of variances from the
strict application of the provisions of Section 61.101 of the Zoning Code; at
which hearing all persons present were given an opportunity to testify; and
WHEREAS, following said public hearing, the City Council made the following
findings of fact:
1. The intent of chapter 67.100 is met;
2. The granting of the variance will not be detrimental to the public
safety, health or welfare or injurious to other property or improvements
in the neighborhood in which the property is located;
3. The conditions upon which the request for a variance is based are unique
to the property for which the variance is sought and are generally not
applicable to other property;

4. The literal interpretation of the provisions of this chapter would
deprive the applicant of rights commonly enjoyed by other properties in
the same zoning district;
5. The special conditions and circumstances are a result of both residences
being built over 40 years ago and do not result from the actions
of the applicant; and
6. Because of the particular natural surroundings, shape or topographical
conditions of the specific property involved, unusual hardship to the
owner would result, as distinguished from mere inconvenience, if the
strict letter of these regulations were carried out.
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the
lot split for 1961 and 1963 Nokomis Avenue, with variance for minimum lot size
for both lots and for rear yard setback for the westerly lot; and
BE IT FURTHER RESOLVED, that a copy of this resolution will be mailed by the
City Clerk to the applicant at Route 1, Box 159T, Somerset, Wisconsin, 54025,
and to the Zoning Administrator.

PURPOSE: To consider approval of a lot split with variance for property located
at 1961 and 1963 Nokomis (north side between Bush and Iroquois) .
STAFF RECOMMENDATION: Approve
Dear Sir:
On September 1, the City Council will hold a public hearing on the above
captioned item. City Council review is necessary because the applicant is
creating two single family lots, each already containing a single family
residence but requiring a variance for lot size; the westerly parcel needs an
additional variance for rear yard setback.
No change in actual configuration of building to lot will occur with this
proposal but the lots will be able to be put into separate ownership.

S. STAFF INVESTIGATION AND REPORT: DATE: 8/26/88 BY: Donna Datsko
A. PURPOSE: To split a parcel into two residential lots; variance required for
minimum lot size for each lot and for rear yard setback for the westerly lot.
MINIMUM LOT SIZE AND SETBACK REOUIREMENTS: 5,000 square feet required, 4,715
and 4,716 square feet provided; rear yard setback: 25' required, 1.4' given.
B. SITE & AREA CONDITIONS: Lot size: 94.31' x 100; 9,431 square feet total.
C. HISTORY: This parcel contains two small single family residences. The
smaller of the two is 1.4' from the rear property line. It was built in 1947,
23 years after the ad�acent residence was constructed. According to the
appraiser's records, this small structure was built for the property owner's
son and did not have plumbing installed until 1954.
D. FINDINGS:
1. The applicant's proposal would not change the existing, long-standing
configuration of buildings on the lot but would enable each existing residence
to have separate ownership.
2. City staff have reviewed the proposed split and found it to be in conformance
with the subdivision regulations 67.304, with the exception of minimum lot
size and rear yard setback for the westerly structure.
3. The City Council may grant a variance from the subdivision regulations when
compliance would create an unusual hardship to the development of the land,
and based on findings as specified in section 67.703 of the zoning code.
These findings are as follows:
a. The intent of the (subdivision) chapter is met;
The intent of the subdivision chapter is to provide for the orderly and
economic development of land. This lot split will not provide any additional
opportunity for development but will allow separate residential ownership.
b. The granting of the variance wi11 not be detrimental to the public safety,
health or welfare or injurious to other property or improvements in the
neighborhood in which the property is located;
The proposal will not alter the status quo.
c. The conditions upon which the request for a variance is based are unique to
the property for which the variance is sought and are generally not
applicable to other property;
The variance is required because the parcel is composed of a single, large
platted lot which already contains two separate dwellings.
d. The literal interpretation of the provisions of this chapter would deprive
the applicant of rights commonly enjoyed by other properties in the same
zoning district;
The lot already contains two dwellings; nothing would be added or taken away
by this lot split.
e. The special conditions and circumstances do not result from the actions of
the applicant;
The structures on this lot are both over 40 years old.

f. Because of the particular natural surroundings, shape or topographical
conditions of the specific property involved, unususl hardship to the owner
would result, as distinguished from a mere inconvenience, if the strict
letter of these regulations were carried out.
If the strict letter of these regulations were carried out, the lot could
not be split for separate ownership.
D. STAFF RECOMMENDATION: Based on staff findings, staff recommends the approval of
the proposed lot split with variance for minimum lot size and for rear yard
setback for the westerly parcel.
