WHEREAS , the Housing and Redevelopment Authority of the
City of Saint Paul applied for a building permit to construct
a 200 space parking lot on the south side of Selby Avenue at
Arundel Street, the proposed parking lot being located in the
Historic Hill Heritage Preservation District; and
WHEREAS , the Heritage Preservation Commission, following
a public hearing, on July 14, 1988 pursuant to its Resolution
No. 893 � denied the permit application made by the Housing and
Redevelopment Authority of the Ci�y of Saint Paul based on
their finding that:
(1 ) The proposed parking lot does not protect the unique
architectural character of the Historic Hill District and is
not compatible with the historic character or pattern of the
area.
(2) The proposed parking lot destroys the public space
of the street and does not maintain a wall of enclosure for
the public street. Landscaping does not respect 'che street
as a public room. Boulevard trees are not main'cained. The
separation between the automobile corridor and the rest of
the streetscape is not maintained.
( 3) The proposed parking breaks the rhythm of building
to open space. The directional emphasis of the proposed parking
lot is monotonous and horizontal and does not relate to the
directional emphasis or rhythm of adjacent structures.
(4) The proposed parking lot does not maintain the rhythm
and directional emphasis of the street and destroys the existing
rhythm of building to open space.
(5) The proposed parking lot introduces a scale that is

WHEREAS , the Housing and Redevelopment Authority, acting
pursuant to Section 73. 07(h) duly filed its appeal to the City
Council from this decision of the Heritage Preservation Com-
mission and the City Council having conducted a public hearing
on August 30, 1988 where all interested parties were given
an opportunity to be heard, the Council does now hereby
RESOLVE , that the Council of the City of Saint Paul does
hereby reverse the decision made by the Heritage Preservation
Commission in this matter and does hereby grant the appeal
made and filed on behalf of the Housing and Redevelopment Author-
ity of the City of Saint Paul ; and
WHEREAS , the Council of the City of Saint Paul in granting
this appeal , does hereby request that the staff of the Housing
and Redevelopment Authority, if feasible , make a good faith
effort to relocate the trees and to improve the lighting so
as to meet the Heritage Preservation Commission guidelines ;
and, be it
FURTHER RESOLVED, that the City Clerk shall mail a copy
of this resolution to the Housing and Redevelopment Authority
of the City of Saint Paul , the Heritage Preservation Commission
and the Zoning Administrator.

RE: Appeal of Heritage Preservation Commission's (HPC) Decision to Deny
Building Permit for Proposed HRA Arundel Street Parking Lot
Dear President Scheibel and Members of the City Council:
On July 14, 1988, the HPC denied an HRA building permit application for a
proposed 199 space parking lot on the south side of Selby Avenue at Arundel
Street. The proposed parking lot is part of the February 17, 1987, Parking
Agreement with the developers of Blair Arcade, Cathedral Hill, and Hill Plaza
under which the HRA is to provide 225 parking spaces and make a reasonable
good faith effort to acquire and construct 45 additional parking spaces. The
proposed Arundel Street lot would provide the additior�al 45 parking spaces.
HRA staff is requesting the Saint Paul City Council reverse the HPC denial and
allow the issuance of a building permit for this project.
The grounds for requesting this appeal are as follows:
1. Most of the testimony heard by the HPC against this building permit was
either directly or indirectly related to the vacation of Arundel Street.
Despite the fact that on July 5, 1988, the Saint Paul City Council
approved the vacation of Arundel Street, there are some neighborhood
individuals who are attempting to use the site plan review process as a
way of negating the street vacation.
2. The HPC disregarded its own staff and Design Review Committee's
recommendation for approval of the site plan. HPC staff and the Design
Review Committee based their recommendation on the fact that there is
only one Design District Guideline relating to the construction of
parking lots. That guideline, Section C-2 Garages and Parking, states
"Parking spaces should be adequately screened from the street and
sidewalk by landscaping" . The HPC, however, went beyond that single
guideline and inconsistently applied general guidelines that had no
direct relationship to the proposed project.
3. The HPC is being inconsistent in its design review process. On January
6, 1988, the HPC approved the site plan for 147 parking space Virginia
Street lot. That lot, which was also developed in a vacated street
right of way, had less landscaping treatment than the Arundel Street
lot. Nevertheless, the Arundel Street site plan was denied.
HRA staff is asking the Saint Paul City Council to expedite this appeal as

soon as possible. HRA staff would like to start construction on this parking
lot this fall so that the parking spaces will be available for the holiday
shopping season.

WHEREAS, the Saint Paul Heritag� Preservation Commission is authorized by Chapter 73
of the Saint Paul Legislative Code to review building permit ar�lications for exterior
alterations, new construction or demolition on or within designated Heritage Preservation
Sitcs or Heritage Prescrvation Districts; and
WHEREAS, the Saint Paul Housing and Redevelopment Authority has applied for a
building permit to construct a 200 space parking lot on the south side of Selby Avenue at
Arundel Street; and
VVHEREAS, the proposed parking lot is located in the Historic Hill Heritag� Preservation
District; and

WHEREAS, the Design Guidelincs for the Historic Hill Heritage Preservation District �'
include thc foliowing:

l. Section D. Restoration states, "All work should be of a character and quality that '�
maintains the distinguishing features of... the environment"
�
2. Section C. New Construction states, "What is essential for new construction in the �
Historic Hill area is the maintenance of the scale and quality of design"
3. Section C. IX. Landscaping statcs, "Typically open space on the Hill is divided into
public, semi-public and private spaco. The public space of the street and sidewalk is
often distinguished from the semi-public space of the front yard by a change in grade,
a low hedge or visually open fence. The buildings, landscaping elemcnts in front
yards, and boulevard trees together provide a "wall of enclosure" for the public street
"room." Gencrally, landscaping which respects the street as a public room is
cncouraged"
4. Section C. IX. Landscaping also states, "The city should maintain boulevard trees when
at all possible. The boulevard trees mark a separation between the automobile corridor
and the rest of the streetscape."
S. Section C. IX. Rhythm and Directioaal Emphasis states, "The existencc of uniform
narrow lots in the Historic Hill naturally sets up a strong rhythm of buildings to open
- space. Historically any structure built on more than one lot used vertical facade
elements to maintain and vary the overall rhythm of thc street rather than interrupting
the rhythm with a long monotonous facade. The directional expression of new
construction should relate to that of existing ad jacent structures."
WHEREAS, thc Saint Paul Heritage Preservation Commission, based upon evidence
presented at their July 14, 1988, public hearing on said permit application, made the
following findings of fact:

1. The proposed parking lot does not protect the unique architectural character of the
Historic Hill District and is not compatibie with the historic character or pattern of
the area.
2. The proposed parking lot destroys the public spacc of ihe street and does not maintain
a wall of enelosure for the public street. Landscaping does not respect the street as a
nublic room. Boulevar� t*ees are not maintained. The separation between the

3. The proposed park�ng breaks thc rhythm of building to open space. 'Th� directional
emphasis of the proposcd parking lot is monotonous and horizontal and does not relate
to the dir�ctional emphasis or rhythm of adjacent structures.
4. The proposed parking lot does not maintain the rhythm and directional emphasis of
the street and destroys the existing rhythm of building to open space.
5. The proposed parking lot introduces a scale that is larger and more suburban in
character.
NOW, THEREFORE, BE IT RESOLVED, that based upon the above findings the Heritage
Preservation Commission denies the application for a building permit to construct the
proposed parking lot on the south side of Sclby Avenue at Arundel Street; and
BE IT FURTHER RESOLVED, that the Heritage Preservation Commission recommends the
following changes before any new design proposal is submitted to the Heritage
Preservation Commission for review:
l. The existing boulevard trees should be preserved;
2. The appearance of th� scparation between the automobile corridor and the streetscape
should be preserved; and
3. The lighting design be revised to reflect the historic character of the district; and
BE IT ALSO RESOLVED, that the Hcritage Prescrvation Commission recommends that the
city work with neighborhood organizations and individuals in order to meet thc district
guidelines and address their concerns.
