WHEREAS, Section 1981 of title 42 of the United States Code
mandates that all persons shall have the same right to make and
enforce contracts as is enjoyed by white citizens; and
WHEREAS, in 1976, the Supreme Court in Runyon v. McCrary
decided that Section 1981 prohibits discrimination by private
individuals and corporations and allows people to seek damages for
racial discrimination in private business dealings generally; and
WHEREAS, Ruizyon v. McCrary has proven to be a landmark civil
rights case, resulting in more comprehensive protection against
racial discrimination in employmerit, housing, education and other
areas; and
WHEREAS, on April 25, 1988, the Supreme Court voted 5-4 in
the case of Patter��n v. McLean Credit Union to reconsider Runyon
v. McCrary with the possibility of overruling this landmark
civil rights case; and
WHEREAS, 60 United States Senators, 119 Members of the House
of Representatives, 47 state attorneys general, the American Bar
Association, more than 100 civil rights, religious, and civic
groups have urged the Supreme Court not to overrule Runyon v.
McCrary, an important civil rights decision; and, now, ,
THEREFORE, BE IT RESOLVED, that the St. Paul City Council
urges the Supreme Court not to overrule Runyon v. McCrary and to
uphold Section 1981 of Title 42 of the United States Code of
1976; and
BE IT FURTHER RESOLVED, THAT the St. Paul City Council
endorses and supports the Minnesota Runyon Coalition demonstra-
tion on October 12, 1988, the day the Supreme Court has scheduled
oral ar uments.
