i WHEREAS, CMC Heartland has approached the City with an offer to sell 164.5 acres, more or less, of vacant land,
z known as Pigs Eye Yazd, lying to the north of Pigs Eye Lake as described on Exhibit `A", attached hereto; and
a WHEREAS, the Department of Pazks and Recreafion has proposed purchasing the said Pigs Eye Yazd for use as open
5 space;and
� WHEREAS, the negoUated sale price of $630,000.00 being fair and reasonable value, the Valuation Engineer has
s recommended the purchase of said Pigs Eye Yazd at the agreed sale price, and
io WHEREAS, $100,000.00 had been provided in the 1998 CIB Budget for purchase of the said Pigs Eye Yard; and

WHEREAS, on December 23, 1998 the Council approved CF# 98-ll22, providing an addiuonal $530,000 for the
purchase of the said Pigs Eye Yard;
is NOW TIIEREFORE BE IT RESOLVED, that, as set forth in the purchase agreement, the proper City officials ue
i6 hereby authorized and directed to pay to CMC Heartland Partners the sum of $630,000.00 for the purchase of the said
n Pigs Eye Yard, $100,000.00 to be hansferred from Capital Projects Funds and $530,000.00 to be transferred from the

CMC Heartland, approached the City with an offer to sell this property to the City.

by overlaying the property with clean till.

i WHEREAS, CMC Heartland has approached the City with an offer to sell 164.5 acres, more or less, of vacant land,
z known as Pigs Eye Yazd, lying to the north of Pigs Eye Lake as described on Exhibit `A", attached hereto; and
a WHEREAS, the Department of Pazks and Recreafion has proposed purchasing the said Pigs Eye Yazd for use as open
5 space;and
� WHEREAS, the negoUated sale price of $630,000.00 being fair and reasonable value, the Valuation Engineer has
s recommended the purchase of said Pigs Eye Yazd at the agreed sale price, and
io WHEREAS, $100,000.00 had been provided in the 1998 CIB Budget for purchase of the said Pigs Eye Yard; and

WHEREAS, on December 23, 1998 the Council approved CF# 98-ll22, providing an addiuonal $530,000 for the
purchase of the said Pigs Eye Yard;
is NOW TIIEREFORE BE IT RESOLVED, that, as set forth in the purchase agreement, the proper City officials ue
i6 hereby authorized and directed to pay to CMC Heartland Partners the sum of $630,000.00 for the purchase of the said
n Pigs Eye Yard, $100,000.00 to be hansferred from Capital Projects Funds and $530,000.00 to be transferred from the

Beginning at a point on the north line of the Southwest Quarter of
