Paul Park Acre Lots , according to the plat thereof on file and of record in the Office of the Register of Deeds , Washington County, Minnesota and WHEREAS , the conveyance was conditioned on a Zoological Garden being developed on the site and if a Zoological Garden was not constructed, ownership of the site was to pass to Washington County on condition that a first class park be constructed on the site; and WHEREAS , the conveyance further provided that if Washington County did not accept the tract of land subject to the foregoing condition, it was to pass to the City of Saint Paul for the development of a first class park; and WHEREAS, the conveyance provided finally that if neither Washington County nor the City of Saint Paul accepted the site subject to the foregoing conditions , then the parcel would pass to the City of Newport, Minnesota; and COUNCIL MEMBERS Requested by Department of: � Yeas Nays Dimond �� In Favor Goswitz Rettman sche;be� _ Against BY Sonnen Wilson Form Approved by City At orne Adopted by CounciL Date � Certified Yassed by Council Secretary BY � By A►pproved by iVlavor: Date _ Approve y Mayor for Submission to Council By BY � ��I� `� '��,j!J -2,- WHEREAS, by resolution adopted June 3 , 1975 the Board of Commissioners , Washington County acce�ted the property for development as a first class park, but in 1988 , the Washington County Parks Director advised the Saint Paul Parks and Recreation Division that the City of Newport was interested in acquiring the property for park development and that Washington County would relinquish its interests under the conveyance in favor of the City of Newport should the City of Saint Paul do the same; and WHEREAS , the City Council referred this matter to the Community and Human Services Committee which has explored the feasibility of acceptance by the City of Saint Paul of the conveyance and the willingness of the City of Newport to accept the conveyance and develop a park on the property should Saint Paul relinquish its i:rr.terest under the conveyance; and WHEREAS , it appears that Newport wishes to obtain the property for development as part of its City Park System and has obtained a grant commitment from the Newport Lions Club to assist park development of the property; and WHEREAS , it appears that the intentions of Gordon and May Bailey and the public interest will best be fulfilled and served if Saint Paul relinquishes its interest under the conveyance and Newport accepts the property and proceeds with its develop- ment in accordance with the conditions of the conveyance; now therefore, be it RESOLVED, that the Council of the City of Saint Paul foregoes any and all interest in developing a first class parlc on the parcel and agrees with Washington County that the City of Newport, Minnesota, should be the owner of the property; and be it further WHITE - CITV CLERK PINjC - FINANGE GITY OF SAINT PAUL F1eci1N0. /l ��/`5 j�j ^ CANARV - p.EPARTMENT BLUE - MAVOR Council Resolution Presented By Referred To Committee: Date Out of Committee By Date -3- RESOLVED, that in order to carry out the intent of this Resolution the proper City officers are hereby authorized on behalf of the City of Saint Paul to execute and deliver to the City of Newport a quit claim deed to the above-described property transferring any and all interest the City of Saint Paul have therein under the Bailey conveyance subject to a condition subsequent that should the City of Newport or the County of Washington fail to develop the property as a first class park in accordance with the terms of the conveyance, then the property shall revert to the City of Saint Paul .
