An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof. `
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Minnesota Automobile Dealers Association duly petitioned to
rezone the south 20 feet of 282 Sherburne Avenue located on the south side
between Galtier and Farrington from RT-1 to B-3 for the purpose of expanding
an existing office building at 277 University Avenue; the petition having been
certified by the Planning Division on June 17, 1988 as having been consented
to by at least two-thirds of the owners of the area of the property to be
rezoned, and further having been consented to by at least 67� of the owners of
the property situated within 100 feet of the total contiguous property within
one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on July 14, 1988 conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on July 22, 1988 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
August 13, 1988 and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the
property sought to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
August 25, 1988 where all interested persons were heard, and the Council
having considered all the facts and recommendations concerning the petition;
now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 20, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 282 Sherburne Avnue being more particularly
described as the south 20 feet of Lot 4, Block 2 Chamber's Addition
be and is hereby rezoned from RT-1 to B-3.
Section 2.
This ordinance shall take effect and be in force thirty (30) days
from and after its passage, approval and publication.

Dear Sir:
On July 14, 1988, the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petitioner testified. At the close of the
public hearing, the Committee voted 4 to 0 to approve the rezoning based on
staff findings.
On July 22, 1988, the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on August 25, 1988.
Please notify me by August 24, 1988 if any member of the City Council wishes to
have slides of the site presented at the public hearing.

WHEREAS, Minnesota Automobile Dealers Association, file #10323, has petitioned to
rezone the south 20 feet of the lot at 282 Sherburne Avenue situated on the south
side between Galtier and Farrington from RT-1 to B-3 for the purpose of allowing the
expansion of an existing office building at 277 University Avenue; and
WHEREAS, the Zoning Committee of the Planning Commission on July 14, 1988. held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul I.egislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the ainutes,
made the following findings of fact:
1. The applicant, IYlinnesota Automobile Dealers Association� has an existing office
building located at 277 University and would like to construct an addition on
the north side of the building. To provide space for the addition, they are
proposing to split off the southern 20 feet of a paicel located to the immediate
north of the office building and rezone this new parcel from RT-1 to B-3. A
garage located on this lot will be re�oved to allow the building expansion, but
the single family residence will be remain on the remainder of the original lot.
2. Zoning Code Section 60.212 requires that if more than one parcel is to be
developed as a unit, the zoning district of all parcels must be the same. The
office building is a permitted use in a B-3 zoning district, but not in a RT-1
district. Therefore, the proposed 20 foot parcel would have to be rezoned to
B-3 to allow the expansion.
3. The District 7 Plan discourages commercial encroachment into the residential
area on south side of Sherburne Avenue. The proposed rezoning is sensitive to
this Distzict Plan goal in that the residence will remain on Sherburne.

4. The rezoning request is consistent with both housing and economic development
objectives of the city. The proposed lot split and rezoning will enable a
business to expand and preserve a single family house. The Economic Development
element of Comprehensive Plan, encourages the city to find ways to assist
business Lo expand and the St. Paul Tomorrow report affirms the need to preserve
the city's single family housing.
5. If the rezoning is granted, the applicant must have a site plan approved prior
to constructing the addition.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of Minnesota Automobile Dealers Association to rezone property at 282
Sherburne Avenue more particularly described as the South 20' of Lot 4, Block 2,
Chamber's Addition, from a RT-1 zoning classification to B-3 zoning classification
is consistent with the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Council of the City of Saint Paul that property located at 282
Sherburne Avenue be rezoned from RT-1 to B-3 in accordance with the petition for

A. PURPOSE: To the allow the possible expansion of an existing office building at
277 University.
B. SUFFICIENCY: The petition was declared sufficient by the Planning Division on
June 17, 1988; twenty-one parcels eligible, 14 parcels required, 14 parcels
signed.
C. PARCEL SIZE: The existing parcel has 44' of frontage on Sherburne and a depth
of 127.75' for a total lot area of 5,588 square feet. The applicant has applied
for a lot split of the parcel. The lot split, if granted would create one 44'
by 107.61' parcel with a total of 4,734 square feet (Lot B) and a smaller 40' by
20' parcel totaling 800 square feet (Lot A) that would be attached to the parcel
to the south. The rezoning request is for Lot A, the smaller parcel.
D. EXISTING LAND USE: A garage is located on Lot A and a single family residence
is on Lot B.
E. SURROUNDING LAND USE:
North and West: Residential, RT-1
South: Commercial, B-3
East: Commercial, B-3 - 1 lot; Residential, RT-1 - beyond
F. ZONING CODE CITATION: 60.541. Intent. The General Business District is
intended to provide sites for more diversified types of businesses than those in

G. FINDINGS:

Dear Ms. Morton:
The Minnesota Automobile Dealers Association is a trade associa-
tion which provides a variety of business related and fraternal ser-
vices to 575 franchised new automobile and truck dealers throughout
the state of Minnesota. MADA and its divisions sponsor a number of
insurance plans as well as a dealer license bond and pension program.
MADA Services markets a wide assortment of business forms and promo-
tional items for dealers' use. This letter is in support of a rezon-
ing petition recently filed with the St. Paul Zoning Office.
MADA owns the property at 277 University and also the properties
at 276 and 282 Sherburne Avenue. MADA has owned all of these proper-
ties and has been a resident on University Avenue for the last ten
years. In order to expand offices and storage space, MADA is contem-
plating extending its building with a two-story brick addition 20
feet back to the north towards Sherburne Avenue. (see the enclosed
hand-drawn map)
With respect to zoning and subdivision, MADA is seeking to fill
in the northwest corner of the 277 University property in order to
make an almost square lot zoned B-3 . MADA is not contemplating push-
ing commercial zoning further north towards Sherburne Avenue than it
already is on the University avenue property.
As the current dealer President of MADA, I would appreciate
your considered decision and hopefully favorable determination and
recommendation on this zoning petition.

I represent the Minnesota Automobile Dealers Association in a
zoninq petition to rezone a small 20 ' x 40' plot from a Residential
to a General Business B-3 classification. The Minnesota Automo-
bile Dealers Association is a trade association which represents
