RESOLVE , that the Council of the City of Saint Paul does
hereby grant the appeal of Gary McGee and does hereby reverse
the decision of the Board of Zoning Appeals on the grounds
that because the owner of the property no longer seeks a variance
is that there are other alternatives for the construction that
is proposed, that there has been no showing of a continuing
and existing hardship and therefore based upon these new facts ,
the decision of the Board of Zoning Appeals was in error; and,
be it
FURTHER RESOLVED, that the appeal of Gary McGee is hereby
granted and the variance heretofore granted by the Board of
Zoning Appeals is hereby rescinded; and, be it
FURTHER RESOLVED, that the City Clerk shall mail a copy
of this resolution to Richard Stauble, Gary McGee, the Zoning
Rdministrator , the Planning Commission and the Board of Zoning
Appeals.

PURPOSE: To consider an appeal of a decision by the Board of Zoning Appeals to
grant a variance of side yard setback for construction of one-car,
attached garage and dining room expansion. The variance reduces the
setback from 7' to 2.5' . (No Building Permit has been issued and no work
has been done on the garage. )

Dear Sir:
On June 14, 1988, the Board of Zoning Appeals approved a variance to reduce the
required side yard setback from 7' to 2.5' at 1905 Field. The next door
neighbor, Gary McGee, is appealing that decision.
The person who applied for the variance, Richard Stauble, wishes to add a one-
car garage to the side of his existing single-family home and later to expand
his dining room. The addition would be 14.5' wide: 10.5' for the garage and
4' for the dining room expansion. (See attached plans. )
Mr. Stauble could build a detached garage in the back yard which does not
require a variance. However, he would prefer to build an attached garage in
order to leave as much of the back yard as green space as possible.
Mr. McGee originally told staff that he did not object to a variance for a 2'
setback and signed a letter saying that. However, he later told the District
15 Council that he was opposed to it. But he signed another letter for the BZA
meeting saying he did not oppose the variance if it was increased to 2.5' . Mr.
McGee filed for an appeal after the BZA approved the variance.

w'HEREAS, Richard Stauble has applied for a variance from the strict application of the
provisions of Section 61.101 of the Saint Paul Lcgislative Code pertaining to side yard
setback in the R-3 zoning distriet; and
WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing on
June 14, 1988, pursuant to said appcal in accordance with the requirements of Section
62.204 of the Legislative Code; and
WHEREAS, tho Saint Paul Board of Zoning Appeals based upon evidence presented at the
public hearing, as substantially reflected in the minutes, made the following findings of
fact:
1. The applicant owns a single-family house at this location. The house does not have a
garagc. However, therc is a 17' wide driveway from the street to the side of the house
and a gravel parking pad along side the house. A tent/camper unit is currently stored
on the gravel parking pad.
2. The applicant wishes to add a three-season porch to the back of the house and an
attached garage to the sidc of the house. The garage would be 14.5' wide and 29' deep.
The front of the garage would be set back 9' from the front of the house. The garage
would have a 2.5' setback from the east side property line.
3. The applicant plans to enlarge his dining room at some time in the future by expanding
4' into the garage space, leaving an 10.5' wide garage space.
4. A detached garage could be built in the backyard with a 3' setback. However, the
. applicant is claiming that placing the garage and the driveway necessary to get to it in
the backyard would result in a hardship in that it is an existing house with an existing
yard which he would like to preservo as green space for his family.
5. The proposed variance is in keeping with the spirit and intent of the code. It will not
impair an adequate supply of light and air to ad jacent property, nor will it alter the
essential character of the surrounding area.
The neighboring house is set back 13' from the side property line and its driveway runs
between the house and the applicant's property. There are no windows on the side of
the neighboring house facing where the garage would be built.
6. The variance, if granted, would not permit any use that is not permitted in the zoning
district where the property is located.
7. The request for variance is based primarily on a desire to fully utilize the site rather
than economic gain.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Board of Zoning Appeals that

recommendation for approval. Highland Area Community Council sent a letter
zequesting a one month layovez to permit time for the applicant and the
neighbor to work out a plan. Four letters were received in support.
Mr. Grais asked the applicant if he had anything to add. Mr. Stauble
submitted letters of support from the neighbors to the Board.
Mr. Beach stated that since the Highland Area Community Council meeting Mr.
Stauble and the neighbor have zeached an agreement of a 2 1/2' setback and
staff agrees.
Ms. Maddox asked Mr. Beach if finding number 2 would then read 2 1/2' , Mr.
Beach replied yes.
Hearing no further testimony, Mr. Grais closed the public portion of the
meeting.

The Highland Area Community Council (HACC) met on June 9, 1988 and
reviewed the variance application of Richard Staubel 1905 Field Avenue
to permit the construction of a garage with a 2' sideyard setback {east side
of lot),. The neighbor to the east of the applicant 1903 Field opposed
the variance request. Mr. Staubel requested an opportunity to work
with his neighbor to develop a plan that would satisfy his concerns.
The board recommended that the issues be laid over for a month to permit
time for Mr. Staubel and Mr. McGee work on a plan.
