Troje, Sr. , President, for the premises ;cnown as the Horseshoe Bar, 574 Rice Street, Saint Paul, are hereby suspended for a period of 5 consecutive days, beginning and ending on the following dates: September 25, 1988 through September 29, 1988 This Resolution and the action taken herein are based upon the facts contained in the attached police reports which support the allegations contained in the preliminary notice dated August 15, 1988, all of which are attached to and made part of this Resolution. Such facts are not contested by the licenseholder, as evidenced by the attached letter of Mr. John E. Daubney, attorney for the licenseholder. Troje, Sr. RICOM, Inc. dba Horse Shoe Bar 574 Rice Street St. Paul , Mn. 551P13 RE: Horse Shoe Bar , 574 Rice Street Dear Mr. Troje: The Vice Unit has given me reports containing inform ation which could lead to action by the Saint Paul City Council against your intoxicating liquor and other licenses. The allegations in summary form are that you have sold liquor to minors on August 5, 1988 . If you do not dispute the allegations or facts, and agree that a violation accurred , but want to have an opportunity to speak to the Council to argue for the lightest possible penalty under all the circumstances , please call me at 298-5121 to work out the procedures . On the other hand, if you contest the allegations or dispute the facts, I will take the necessary steps to schedule a hearing before an independent hearing examiner and provide you with a proper notice of hearing so you will know when and where to appear , and what the basis for the hearing will be. Troje, Sr. , at the Horseshoe Bar in connection with an allegation of sale of liquor to minors on August 5, 1988 . It is the custom and practice at the Horseshore Bar to have a per- son at the door checking I .D. ' s when customers enter and to prevent patrons from leaving the establishment carrying alcoholic beverages. This policy was in force and effect on August 5, 1988 , but this was an extremely busy evening and, unfortunately, the patrons in question did enter and did purchase an alcoholic beverage (beer) . Under these circumstances, a Hearing before an Administrative Law Judge is not requested although the license holder would wish to appear for the Counsel at the time sanctions are being considered to explain the extenuating circumstances.
