RESOLVED, that upon the petition of the Port Authority of
the City of Saint Paul, per Finance Department File No. 14-1988 ,
those parts of Wall Street, Wacouta Street, Fifth Street , Sixth
Street and the alley in Block 6, Whitney and Smith' s Addition to
St. Paul , bounded by Seventh, Fifth, Wall and Wacouta,
hereinafter described, be and the same are hereby vacated and
discontinued as public property.
The vacated area is described as follows:
Parcel "A"
All that part of Wacouta Street adjoining Lots 7, 8 and
9, Block 6, Whitney and Smith's Addition to St. Paul
that is described as follows:
Beginning at the most Westerly corner of Lot 9, said
Block 6, thence Southeasterly, along the Southwesterly
line of said Lots 7, 8 and 9 and its Southeasterly
extension for a distance of 150. �87 feet; thence
Southwesterly at right angles for a distance of 0.05
feet; thence Northwesterly, parallel with the
Southwesterly line of said Lots 7, 8 and 9, for a
distance of 150. :87 feet; thence Northeasterly for a
distance of 0.05 feet to the point of beginning.
Subject to a Skyway Agreement dated September 10, 1985,
and filed February 2, 1986 , as document 2303432 .
Parcel "B"
All that part of the alley in Block 6, Whitney and
Smith' s Addition to St. Paul that is described as
follows:

�1'he vacation shall be subject to the following
conditions:
1 . That the vacation be subject to all the terms and
conditions of Chapter 130, codified ��Iarch 1, 1981, of
the Saint Paul Legislative Code, as amended.
2. That the petitioner, its successors and assigns shall
pay $1 ,405 . 00 as compensation for the vacation which is
due and payable within 60 days of the publication date
of this resolution.
3 . 1'hat the land described above is being vacated to
accommodate building encroachments and that upon
removal , reconstruction, alteration, demol�ition or <
otherwise nonexistence of the encroaching buildings the ���

vacated land shall revert to the City of Saint Paul as
street right-of-way without cost or charges to the City.
4 . That a permanent utility easement be retained within the
vacated areas to protect the interest of Northern States
Power Company.
5. That a permanent utility easement be retained within the
vacated area to protect the interest of Continental
Cablevision.
6 . That the petitioner , its successors and assigns , by
acceptance of the terms and conditions of this vacation,
agree to idemnify, defend and save harmless the City of
Saint Paul, its officers and employees from all suits,
actions or claims of any character brought as a result
of injuries or damages received or sustained by any
person, persons , or property on account of this
vacation, or petitioner ' s use of this property,
including but not limited to a claim brought because of
any act of omission, neglect or misconduct of said
petitioner or because of any claims or liability arising
from any violation of any law or regulation made in
accordance with the law whether by the petitioner or any
of its agents or employees.
7 . That the petitioner , it successors , and assigns shall
within 60 days of the publication date of this
resolution file with the City Clerk an acceptance in
writing of the conditions of this resolution and shall
within the period (s) specified in the terms and
