WHEREAS, the Council of the City of Saint Paul by Ordinance No. 17485 approved
August 20, 1987 initiated a moratorium on the granting of permits for drive-up
windows for restaurants pending completion of studies of possible amendments
to the City's zoning regulations; and
WHEREAS, section three of the ordinance provides for extension of the
ordinance beyond August 20, 1988 by resolution in the event such extension is
required to complete said studies and/or amend the zoning code; and
WHEREAS, it is apparent that the studies of the Planning Commission and
deliberations of the City Council to consider amendments to the zoning code
will require additional time;
NOW, THEREFORE, BE IT RESOLVED, that the City Council extends the restrictions
enacted by Ordinance No. 17485 prohibiting the issuance of any permit to
establish a drive-up window in a restaurant located in any zoning district
except the B-3 zoning district for a period of one (1) year, or until the
completion of studies and deliberations of the Planning Corrnnission and City
Council , and the enactment of new regulations if deemed appropriate, whichever
occurs first.

RE: Moratorium on Permits for Drive-up Windows in Restaurant
Attached for your review and consideration is a draft resolution extending the
current moratorium on the granting of permits for drive-up windows in
restaurants in all but the B-3 zoning districts beyond its expiration date of
August 20, 1988. Section 3 of Ordinance No. 17485 provides for extension of
the moratorium by resolution for up to eighteen months in the event that
Planning Commission studies and City Council deliberations concerning new
rules are not completed prior to the expiration date mentioned above.
By experience you are aware that the regulation of the food service industry,
and particularly the fast-food business, is complex. Our staff has studied
the industry and its regulation both here and in other cities, in considerable
depth during the past year and is in the final stages of developing workable
and equitable zoning definitions and regulations for restaurants in Saint
Paul. At present we anticipate that the schedule for review and action on
this study is as follows:
1. Zoning Committee review and recommendation
to Planning Commission 09/15/88
2. Planning Commission review and set date of
public hearing 09/23/88
3. Release draft study for public review 09/26/88
4. Planning Commission public hearing 11/18/88
5. Zoning Committee final review and recommendation 12/O1/88
6. Planning Commission adoption of resolution 12/09/88
7. Forward final draft to Mayor and City Council
for action 12/15/88
8. City Council action O1/15/89

Based on this schedule we believe that an extension of the current moratorium
as noted in the attached resolution would be appropriate.
