RESOLVED, that upon the petition of the United States Postal
Service per Finance file no . 24-1987 , that part of the alley in
Block 14 , of Denslow' s Rearrangement of Lots 5 , 6, 7, 8, 9 , 10 ,
11 , 12, Block 2, Lots 9 , 10 , 11 , 12 , 13 , 14 , 15 , 16 , 17 , 18 , 19 ,
Block 3 , and Lot 11 , Block 4 , Cruickshank' s Garden Lots , and that
part of the alle� in Block 6 , Lorena Park bounded by Etna ,
Reaney, Birmingham, and Minnehaha hereinafter described , be and
the same are hereby vacated and discontinued as public property.
That the vacated area be described as follows :
All of the alley in Block 14 , Denslow' s Rearrangement of
Lots 5 , 6 , 7 , $, 9 , 10 , 11 , 12, Block 2, Lots 9 , 10 , 11 ,
12, 13 , 14 , 15 , 16 , 17 , 18 , 19 , Block 3, and Lot 11 ,
Block 4 , Cruickshank ' s Garden Lots , and also all of the
alley in Block 6, Lorena Park, Saint Paul , Minnesota
1 . That the vacation be subject to all the terms and
conditions of Chapter 130 , codified March 1 , 1981 , of
the Saint Paul Legislative Code, as amended .
2. That the petitioner , its successors , and assigns shall
pay the City of Saint Paul a $500 administrative fee
for this vacation which is due and payable within 60
days of the publication date of this resolution .
3 . That the petitioner , its successors, and assigns shall
grant the City of Saint Paul a 40-foot permanent
easement for sewer purposes by Quit Claim Deed , subject
to the approval of the Department of Public Works and
the City Attorney' s Office , over , under , and across the
land described as follows:

Division and Block 14 , Denslow' s Rearrangement of
Lots 5 , 6 , 7 , $ , 9 , 10 , 11 , 12 , Block 2 , Lots 9 , 10 ,
11 , 12 , 13 , 14 , 15 , 16 , 17 , 18 , 19 , Block 3 and Lot
11 , Block 4 , Cruickshank ' s Garden Lots , the
centerline of which is described as follows :
Commencing at the southeast corner of said Block 6;
thence South $9 degrees 17 minutes 01 seconds West ,
assumed bearing, along the south line of said Block
6 a distance of 0 . 52 feet to the point of beginning
of the centerline to be described ; thence North 06
degrees 19 minutes 04 seconds West , 278 . 41 feet to a
point on the north line of said Block 6 and said
centerline there terminating .
4 . That a 40-foot permanent utility easement be retained
within the vacated alley of said Block 6 , Lorena Park to
protect the interest of the Metropolitan Waste Control
Commission which is described as follows :
A 40 . 00 foot permanent easement for public utility
purposes over , under and across that part of the vacated
alley of said Block 6, Lorena Park 1}ring from 25 . 00
feet left and 15 . 00 feet right of the following
described centerline :
Commencin� at the southeast corner of said Block 6 ;
thence South $9 degrees 17 minutes O1 seconds West ,
assumed bearing , along the south line of said Block 6
a distance of 39 . 64 feet to the point of beginning of
the centerline to be described ; thence North 12
degrees 01 minutes 04 seconds West , 282 . 63 feet to a
point on the north line of said Block 6 and said
centerline there terminating .
5 . That the petitioner , his heirs , and assigns , by
acceptance of the terms and conditions of this
vacation , agree to indemnify, defend and save harmless
the City of Saint Paul , its officers and employees from
all suits , actions or claims of any character brought
as a result of injuries or damages received or
sustained by any person , persons , or property on
account of this vacation or petitioner ' s use of this
property including but not limited to a claim brought
because af any act of omission , neglect , or misconduct
of said petitioner or because of any claims or
liability arising from any violation of any law or
regulation made in accordance with the law whether by
the petitioner or any of its agents or employees .

6 . That the petitioner , his heirs , and assigns , shall
within 60 days of the publication date of this
resolution file with the City Clerk an acceptance in
writing of the conditions of this resolution and shall
within the period ( s ) specified in the terms and
conditions of this resolution comply in all respects
with these terms and conditions.
7. Based upon utility easement Certificates of Intended
Non-Use filed voluntarily on behalf of the Department
of Public Works , Northwestern Bell Telephone Company,
the Water Utility, Continental Cablevision , District
Energy Saint Paul and Western Union and made a part
hereby by this reference and filed in the office of the
Citv Clerk of Saint Paul , the City for itself and on
behalf of these corporations and Departments waives the
right to utility easements in that portion of the
vacated area , described as follows:
Easement rights being released by Northwestern Bell
Telephone , Northern States Power Company , Water
Utility, Continental Cablevision , District Energy and
Western Union .
All of the alley in Block 14 , Denslow ' s
Rearrangement of Lots 5 , 6 , 7 , 8, 9 , 10 , 11 , 12 ,
Block 2, Lots 9 , 10 , 11 , 12 , 13 , 14 , 15 , 16 , 17 ,

Cruickshank ' s Garden Lots , and also all of the
alley in Block 6 , Lorena Park , Saint Paul ,
Minnesota
