An Ordinance repealing Chapter 58 of the Saint
Paul Legislative Code and reenacting a new
Chapter 58 which provides for the establishment
of a program dealing with the installation of a
hard wired smoke detector in single family
dwellings and the monitoring thereof.
THE COUNCIL OF THE CITY OF 5AINT PAUL DOES ORDAIN:
Section 1 .
Definitions. For the purpose of this chapter, the following
terms shall have the meanings ascribed to them in this section.
"Smoke detector" means a device designed for the
detection of smoke and listed by an approved testing
agency for smoke detection purposes .
"Hard wired" means direct wiring into a dwelling' s
electrical system in a permanent manner , and includes
wiring into an existing electrical junction box which
is energized at all times , in a manner that would
prohibit occupancy interruption of elec�rical power

"Single family dwelling" means a building designed
exclusively for and occupied exclusively by one family.
"Department" means the department of fire and safety
services of the City of Saint Paul .
"Trui,h in Housing Disclosure Report" means the written
and signed evaluation of the dwelling in question
by a person certified pursuant to Section 189 . 08 ,
made in the form prescribed by Section 189. 04.

"Owner" means the fee owner, contract for deed purchaser
or other buyer of the single family dwelling as indicated
on the certificate of real estate value on file with
the Ramsey County Auditor.
Sec-�ion 2 .
Installation Requirement. A sinqle family dwelling in the City
of Saint Paul built prior to January 1 , 1973 , shall be equipped with
one operating hard-wired smoke detector. This obligation shall
commence within 60 days of notification by the department.
The installation and maintenance of the smoke detector shall
be the responsibility of the owner and shall be done in accordance
with the provisions of this chapter and all applicable codes and
ordinances.
A germit for installation and inspection of the smoke detector
shall be required in accordance with the provisions of Chapter 33
oi the Saint Paul Legislative Code.
Section 3 .
Location of Detector. The smoke detector shall be mounted on
the ceiling or wall at a point centrally located in a corridor or
area giving access to rooms used for sleeping purposes .
Ceiling mounted smoke detectors shall be located as close to
the center of the ceiling as possible, but not within six inches
of a wall.
Wall mounted smoke detectors snall be mounted on a wall within
12 inches of the ceiling, but not closer than six inches from the
intersection of the wall and ceiling.
Section 4 .
Enforcement. The department shall, at least monthly, cause
to be examined such Truth-in-Housing Disclosure Reports for
single-family dwellings as may ha��e been filed for compliance.

with the requirements of this chapter. If any Report, reflects
noncompliance, then the Department shall issue a written order to
the owner which shall contain the following:
(1) The address of the single-family dwelling as listed
on the Truth-in-Housing Report.
(2) The requirement that a hard-wired smoke detector must
be installed on the premises within a specified period
of time.
(3) The installation of the smoke detector must be made
in compliance with applicable codes and ordinances .
(4) The scheduled date of inspection for purposes of deter-
mining compliance with this chapter.
(5) The penalty for failure to comply with this chapter
in a timely manner.
As further enforcement measureso the City of Saint Paul will:
(1) Via its department of fire and safety services develop
a public education campa�gr. to inform residents of the
requirements of this chapter.
(2) Develop programs designed to encourage voluntary in-
stallation of hard-wired smoke detectors.
(3) Use its best efforts to develop a plan to reduce the
financial burden of installation costs to homeowners
in hardship cases .
(4) Use all means legally available to assure compliance
with this chapter.
Section 5 .
Inspections; Right of Entry. The department shall be authorized
to enter a dwelling at any reasonable time for the purpose of
enforcing the provisions of this chapter. The owner shall give the
department free access to such dwelling or premises

at all reasonable times for the purpose of such inspection.
If the owner refuses to consent to the inspection, a search
warrant may be obtained in accordance with Section 299F .09
of the Minnesota Statutes and Section 2. 107 of the Minnesota
Uniform Fire Code.
Sec�cion 6.
Penalty. Any person violating any provision of this chapter
is guilty of a misdemeanor and upon conviction shall be subject
to the penalty provided for in Section 1 .05 of the Saint Paul
Legislative Code.
Section 7 .
Repeal . Chapter 58 of the Saint Paul Legisla�ive Code
is hereby repealed thirty ( 30) days after this ordinance is
passed, approved, and published and this ordinance shall be
substituted in lieu and in place thereof.
Section 8.
This Ordinance shall take effect and be in force thir�y
( 30) days ai�er its passage , approval and publication.

Dear LeeAnn:
Enclosed herewith please find an Ordinance dealing with the
establishment of the City' s Hard Wired Smoke Detector program
in single family dwellings .
This draft is submitted to you as the previous draft was mis-
titled.
Further, I included an additional section in the enclosed draft
to repeal the existing Chapter 58 of the Saint Paul Legislative
Code dealing with this subject. The reason I did that is because ,
as you may recall , it was illegally enacted and so for the
record I simply wanted to "clear the books" of the existing
language and reenact the Ordinance in the enclosed form.
I believe all concerns have now been put to rest and the Ordinance
only needs to be processed for enactment.
