WHEREAS, the ]icensee Eighth Financial d/b/a Lincoln Pawn & Jewelry, located at 1675
White Bear Avenue in Saint Paul has a Second Hand Dealer and Pawn Shop license (License ID
No. 75094) issued by the City of Saint Paul; and
WHEREAS, Saint Paul Legislative Code § 344.04(a)(6) requires that pawn shop
licensees take a color photograph or color video recording of each customer involved in a billable
transaction and every item pawned or sold that does not haue a unique serial or identification
number permanently engraved or affixed, and that the licensee must keep the exposed
photograph and/or videotape for at least four (4) months; and
WHEREAS, on May 18, 1998, the Saint Paul Police Depariment notified a11 pawn shops
in writing of the requirements contained in Saint Paul Legislative Code § 344.04 (a)(6),
providing a copy of the applicable section of the legislative code; and
WI3EREAS, on December 7, 1493, Phil Chelstrom, an investigator for the Ramsey
County SherifP s Office, requested video tapes from several pawn shops for use in an active
investigation, specifically from Lincoln Pawn & Jewelry, for the dates of October 4, 1998 and
November 1, 1998; and
WIIEREAS, Lincoln Pawn & Jewelry did not have the tapes for either of the requested
dates, in violation of the Saint Paul ordinance; now therefore, be it
RESOLVED, that the Licensee, Eighth Financial d/b/a Lincoln Pawn & Jewelry (License
ID No. 75094), located at 1675 White Bear Avenue in Saint Paul is hereby ordered to pay a fine
of $1,000.00 for the violation of failing to keep the videotape recordings of transacrions made on
October 4, 1998 and November 1, 1998, for the minimum of four months, as required by Saint
Paul Legisiative Code § 344.04(a)(6).

Said fine shall be paid to the O�ce of License, Inspections and Environmental Protection
within thirty (30) days of the adoption of this resolution by the Council and signature by the
Mayor.
This resolution and the action of the Council in tbis matter aze based upon the facts
contained in the Notice of Violation letter to the licensee, the investigation report, and such
azguments as may have been presented to the Council at the public hearing. The facts were not
contested by thelicensee.

Deaz Sir/Madam:
The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On or about December 7, 1998, an investigator for the Ramsey County
Sheriff s Department requested video tapes of pawn shop transactions
occurring on October 4,1998 and November 1,1998. Upon request for the
videotapes, the manager stated that they did not have an adequate supply of
videotapes, so they had taped over the videos from these dates, so they were
not available. This is a violation of Saint Paul Lea siative Code §344.04,
subd. (a)(6) which requires that pawn shops take a color photograph or color
video recording of each customer involved in a billable transacrion and every
item pawned or sold that does not have a unique serial or identification
number permanently engraved or affixed. The photograph andlor videotape
must be kept by the licensee for at least four months.
If you do not dispute the above facts please send me a letter with a statement to that effect. The
matter will then be scheduled for a hearing before the St. Paul City Council to determine what
penairy, if any, to impose. You will have an oppommity to appear and speak on your own
behalf, or to have someone appeaz theze for you.

DATE: December 8, 1998
On May 18, 1998, I notified all pawn shops that Chapter 344.04. Regulations, subd. 6,
required video tapes of Billable Transactions must be maintained for "at least four months."
This letter was a result of a pawn shop being unable to provide a video tape of a
transaction involving stolen property. Failure to provide this tape affected the ability of the
Police Department to prosecute the case. At that time, T provided a11 shops with a copy of
Chapter 344 of the Saint Paul Legslative Code and stated my expectation that all shops
comply with all ordiaances (see enciosures).
On December 7, 1998, Phil Chelstrom, an investigator for the Ramsey County Sheri�s
Office, advised Mary Rubio, 7urisdiction Administrator, that he wanted to pick up video
tapes from several pawn shops regarding an active investigation. Investigator Chelstrom
had previously contacted us for assistance with this investigation. Investigator Chelstrom
needed video tapes from Lincoln Pawn (1) 1675 White Bear Avenue, for October 4, 1998
and November i, 1998.
Mary Rubio contacted the pawn shops involved to notify them that Investigator Chelstrom
would be picldng up the video tapes. After norifying the shops, Donna Megan, Manager of
Lincoln Pawn (1), called Mary Rubio and infocmed her that she did not have either tape.
Ms. Megan explained that Charles Wedemeyer had not provided an adequate supply of
video tapes, thezefore she had taped over the video tapes needed for Investigator
Chelstrom's investigation.

I azn requesting that Administrative Action be taken against Lincoln Pawn (1) for their
failure to comply with Chapter 344.04, subd. 6. Lincoln Pawn (1), as well as all pawn
shops, was notified specifically of the four month requirement in my letter dated May 18,
1998. Management has elected to disregazd this ordinance.

WHEREAS, on May 18, 1998, the Saint Paul Police Depariment notified a11 pawn shops

WI3EREAS, on December 7, 1493, Phil Chelstrom, an investigator for the Ramsey
County SherifP s Office, requested video tapes from several pawn shops for use in an active
investigation, specifically from Lincoln Pawn & Jewelry, for the dates of October 4, 1998 and
November 1, 1998; and
WIIEREAS, Lincoln Pawn & Jewelry did not have the tapes for either of the requested
dates, in violation of the Saint Paul ordinance; now therefore, be it
RESOLVED, that the Licensee, Eighth Financial d/b/a Lincoln Pawn & Jewelry (License
ID No. 75094), located at 1675 White Bear Avenue in Saint Paul is hereby ordered to pay a fine
of $1,000.00 for the violation of failing to keep the videotape recordings of transacrions made on
October 4, 1998 and November 1, 1998, for the minimum of four months, as required by Saint
Paul Legisiative Code § 344.04(a)(6).

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On or about December 7, 1998, an investigator for the Ramsey County
Sheriff s Department requested video tapes of pawn shop transactions
occurring on October 4,1998 and November 1,1998. Upon request for the
videotapes, the manager stated that they did not have an adequate supply of
videotapes, so they had taped over the videos from these dates, so they were
not available. This is a violation of Saint Paul Lea siative Code §344.04,
subd. (a)(6) which requires that pawn shops take a color photograph or color
video recording of each customer involved in a billable transacrion and every
item pawned or sold that does not have a unique serial or identification
number permanently engraved or affixed. The photograph andlor videotape
must be kept by the licensee for at least four months.
If you do not dispute the above facts please send me a letter with a statement to that effect. The
matter will then be scheduled for a hearing before the St. Paul City Council to determine what
penairy, if any, to impose. You will have an oppommity to appear and speak on your own
behalf, or to have someone appeaz theze for you.

On May 18, 1998, I notified all pawn shops that Chapter 344.04. Regulations, subd. 6,
required video tapes of Billable Transactions must be maintained for "at least four months."
This letter was a result of a pawn shop being unable to provide a video tape of a
transaction involving stolen property. Failure to provide this tape affected the ability of the
Police Department to prosecute the case. At that time, T provided a11 shops with a copy of
Chapter 344 of the Saint Paul Legslative Code and stated my expectation that all shops
comply with all ordiaances (see enciosures).
On December 7, 1998, Phil Chelstrom, an investigator for the Ramsey County Sheri�s
Office, advised Mary Rubio, 7urisdiction Administrator, that he wanted to pick up video
tapes from several pawn shops regarding an active investigation. Investigator Chelstrom
had previously contacted us for assistance with this investigation. Investigator Chelstrom
needed video tapes from Lincoln Pawn (1) 1675 White Bear Avenue, for October 4, 1998
and November i, 1998.
Mary Rubio contacted the pawn shops involved to notify them that Investigator Chelstrom
would be picldng up the video tapes. After norifying the shops, Donna Megan, Manager of
Lincoln Pawn (1), called Mary Rubio and infocmed her that she did not have either tape.
Ms. Megan explained that Charles Wedemeyer had not provided an adequate supply of
video tapes, thezefore she had taped over the video tapes needed for Investigator
Chelstrom's investigation.

I azn requesting that Administrative Action be taken against Lincoln Pawn (1) for their
failure to comply with Chapter 344.04, subd. 6. Lincoln Pawn (1), as well as all pawn
shops, was notified specifically of the four month requirement in my letter dated May 18,
1998. Management has elected to disregazd this ordinance.

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On or about December 7, 1998, an investigator for the Ramsey County
Sheriff s Department requested video tapes of pawn shop transactions
occurring on October 4,1998 and November 1,1998. Upon request for the
videotapes, the manager stated that they did not have an adequate supply of
videotapes, so they had taped over the videos from these dates, so they were
not available. This is a violation of Saint Paul Lea siative Code §344.04,
subd. (a)(6) which requires that pawn shops take a color photograph or color
video recording of each customer involved in a billable transacrion and every
item pawned or sold that does not have a unique serial or identification
number permanently engraved or affixed. The photograph andlor videotape
must be kept by the licensee for at least four months.
If you do not dispute the above facts please send me a letter with a statement to that effect. The
matter will then be scheduled for a hearing before the St. Paul City Council to determine what
penairy, if any, to impose. You will have an oppommity to appear and speak on your own
behalf, or to have someone appeaz theze for you.

On May 18, 1998, I notified all pawn shops that Chapter 344.04. Regulations, subd. 6,
required video tapes of Billable Transactions must be maintained for "at least four months."
This letter was a result of a pawn shop being unable to provide a video tape of a
transaction involving stolen property. Failure to provide this tape affected the ability of the
Police Department to prosecute the case. At that time, T provided a11 shops with a copy of
Chapter 344 of the Saint Paul Legslative Code and stated my expectation that all shops
comply with all ordiaances (see enciosures).
On December 7, 1998, Phil Chelstrom, an investigator for the Ramsey County Sheri�s
Office, advised Mary Rubio, 7urisdiction Administrator, that he wanted to pick up video
tapes from several pawn shops regarding an active investigation. Investigator Chelstrom
had previously contacted us for assistance with this investigation. Investigator Chelstrom
needed video tapes from Lincoln Pawn (1) 1675 White Bear Avenue, for October 4, 1998
and November i, 1998.
Mary Rubio contacted the pawn shops involved to notify them that Investigator Chelstrom
would be picldng up the video tapes. After norifying the shops, Donna Megan, Manager of
Lincoln Pawn (1), called Mary Rubio and infocmed her that she did not have either tape.
Ms. Megan explained that Charles Wedemeyer had not provided an adequate supply of
video tapes, thezefore she had taped over the video tapes needed for Investigator
Chelstrom's investigation.

I azn requesting that Administrative Action be taken against Lincoln Pawn (1) for their
failure to comply with Chapter 344.04, subd. 6. Lincoln Pawn (1), as well as all pawn
shops, was notified specifically of the four month requirement in my letter dated May 18,
1998. Management has elected to disregazd this ordinance.
