An ordinance amending section 409 . 09 of
the Saint Paul Legislative Code prohibiting
certain sexual conduct in or viewable from
the licensed premises.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
The Council of the City of Saint Paul finds and determines that
adult uses which feature or provide obscene performances and explicit
sexual conduct as entertainment or as a stimulus to commercial pur-
poses, including the sale of alcoholic beverages, have a blighting and
deleterious effect on neighborhoods, neighborhood institutions and
businesses, and the quality of urban life. Studies indicate a corre-
lation between the concentrations of adult uses and the higher incidence
of crime, diminution in retail trade, decline in property values, and
a decline in the quality of surrounding neighborhoods and commercial
districts. The provision of explicit sexual conduct and entertainment
in such alcohol-related adult uses increases the viability of such
uses and a furthering of the undesirable effects on neighborhoods.
The purpose of this ordinance is to ameliorate and lessen conditions
which promote civil disorder and crime, hinder normal retail trade,
adversely affect property values, and contribute to the decline of
quality of life in residential neighborhoods and the commercial areas
serving those neighborhoods. The commercial exploitation of sexual
conduct in adult uses selling alcoholic beverage is found by the
Counci to be a particularly strong factor among all factors contri-
buting to the problems decribed.
