An ordinance amending section 410 . 05 of
the Saint Paul Legislative Code prohibiting
certain sexual conduct in or viewable from
the licensed premises.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
The Council of the City of Saint Paul finds and determines that
adult uses which feature or provide obscene performances and explicit
sexual conduct as entertainment or as a stimulus to commercial pur-
poses, including the sale of alcoholic beverages, have a blighting and
deleterious effect on neighborhoods, neighborhood institutions and
businesses, and the quality of urban life. Studies indicate a corre-
lation between the concentrations of adult uses and the higher inci-
dence of crime, diminution in retail trade, decline in property
values and a decline in the quality of surrounding neighborhoods and
commercial districts. The provision of explicit sexual conduct and
entertainment in such alcohol-related adult uses increases the viabi-
lity of such uses and a furthering of the undesirable effects on
neighborhoods. The purpose of this ordinance is to ameliorate and
lessen conditions which promote civil disorder and crime, hinder nor-
mal retail trade, adversely affect property values, and contribute
to the decline of quality of life in residential neighborhoods and the
commercial areas serving those neighborhoods. The commercial exploita-
tion of sexual conduct in adult uses selling alcoholic beverages is
found by the Council to be a particularly strong factor among all
factors contributing to the problems described.

Section 2 .
The first paragraph of section 410 . 05 of the Saint Paul Legis-
lative Code is amended to read as follows:
"The following acts or conduct which either ( a) take place
on the licensed premises, or (b) can be viewed from the
licensed premises and take place ( i) on premises adja-
cent or in close proximity to the licensed premises, or
( ii) on premises located within the same building or
structure as the licensed premises, are unlawful and
shall be punished as provided in Section 1 . 05 of the Saint
Paul Legislative Code: "
This ordinance shall take effect and be in force 30 days follow-
ing its passage, approval and publication.
