18. ORDINANCE - 88-1136 - Amending Ordinance No. 13543
approved January 31, 1967 by adding BIGELOW LANE
southbound from Klainert Street to Timberlake Road, and
KLAINERT STREET from Arlington Avenue to Bigelow Lane as
, one-way streets.
Recommended approval unanimously.
19. RESOLUTION - 88-1158 - Approving revisions to the
residential permit parking area around St. Thomas College
by removing restrictions on the south side of SUNIlrIIT from
Fairview to Prior.
Recommended approval unanimously with amendment to include
both sides of Goodrich between Finn and Cleveland.

§ 429.081, the Chicago and North Western Transportation Company,
by its undersigned attorneys, hereby appeals to the above-named
Court from the adoption by the St. Pau1 City Council on or about
August 9 and 23, 1988, levying special assessments aga�.nst the
property of Defendant-Appellant in the ainount of $53, 192.25. The
alleged benefit giving rise to the assessments are for a storm
sewer and paving and lighting project within the City of St.

1. The alleged improvement fails to benefit in any
amount or to any extent, at the present or at any future time,
the property of Defendant-Appellant.

special benefits resulting to the property from such
improvements, such excess constitutes an unconstitutional taking

violation of the constitutions of the State of Minnesota and the
United States. •
4. Plaintiff-Respondent arbitrarily, capriciausly, :and
unreasonably adapted the assessment in disregard af the lack of
special benefit to Defendant-Appellant's property.
5. Plaintiff-Respondent, on information and belief,
