WF�EREAS, Citizen 3ervice Office, Division of Code Enfarcement has requested the City
Council to hold public hearings to consider the advisability and necessiry of ordering the repair or
wrecking and removal of a twastory, wood frame dwelling located on property hereinafter refened to
as the "S�bject Properry" and commonly known as 382 Dewey Street. Tlris property is legally
described as follows, to wit:
The Southeasterly 1 /z of L,ot 54, Union Pazk.
VJHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before September 1, 1998, the following aze the now
known interested or responsible parties for the Subject Property: (SEE ATTACHED)
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated October 8, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by November 9, 1998; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition bas not been conected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the I.egislative Heazing Officer of the
City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose
of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, March 2, 1999 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this structure in

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, March 10,
1999 and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore

5 BE IT RESOLVED, that based upon the testimony and evidence presented at the above
6 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
7 Order concerning the Subject Property at 382 Dewey Street:

That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
That the costs of demolirion and removal of this building(s) is estnnated to exceed three
thousand dollazs ($3,000.00).
That there now e�sts and has existed multiple Housing or Building code violations at
the Subject Properry.
That an Order to Abate Nuisance Building(s) was sent to the then l�own responsible
parties to conect the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Off'ices, Division
of Code Enforcement, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties st�all make the S�bject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this siructure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or

2 Office, Division of Code Enforcement is hereby authorized to take whatever steps are

necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the S�bject Property pursuant to the provisions of Chapter 45 of the Saint Paul
L,egislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal shall
be removed from the properry by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such properry as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L.egislative Code.

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On November 17, 1998 you agreed to certain conditions being placed on your
license as a result of a shooring outside of Jazzville. One of the condirions
was that all customers would pass through a metal detector to determine the
presence of any weapons. On December 28, 29 and 30,1998, officer checked
the licensed premises for compliance with the conditions. On December 28,
1998 at approximately 9:30 p.m. the police were inside the premises and
observed at least one customer enter the bar without a metal detector being
used. An additional condition R•as that exterior video surveillance cameras
would be installed to monitor outside activity in front of the licensed
premises. No video cameras were installed as of December 30, 1998.
If you do not dispute the above facts please send me a letter �ith a statement to that effect. The
matter will then be scheduled for a hearine before the St. Paul Ciry Council to determine what
penalty, if any, to impose. You � iil have an opporlunity to appear and speak on your own
behalf, or to have someone agpeaz there for you.

1. The back entrance to the establishment shall remain locked to prevent entry
to the escablishment at all times, exczpt for daytime (7:00 a.m. to 6:00 p.m.)
deliveries, and emergency exiting. A sign shall be installed on the inside and
outside of [he rear door that reads, in large letters, "Emer�ency Exit Only--No
entrance except for daytime deliveries".
2. No employees or patrons of Jazzville shall use, occupy, or loiter in or on any
space in the Rossmor Building, outside of the licensed premises.
3. A metal detector shall be used by the establishment to prevent the
introduction of weapons on the licensed premises. Every customer sha11 be checked
prior to entry, and reentry, no exceptions.
4. The manajement of the establishment must caIl police for assistance when
there are altercations between patrons or between patrons and empioyees of the
establishment. If patrons are ejected from the establishment for threatening or
violen[ behavior, the police shall be called immediately. No exceptions.

Guy Willits reported the owner asked for this fee to be cut in hal£ The owner was out of town
during the assessment. Mr. Willits was working with the manager of the building who gave the
wrong information to Code Enfarcement, and Code Enforcement made a mistake with the dates.
The owner is willing to pay half the fee.
Getry Strathman recommended the assessment be reduced by half plus the cost of the service
chazges, which brings it to a total of $125.
900 Marvland Avenue East
Chuck Votel reported the owner could not be found, it was important to get the building secured,
and a contractor was called. If this conuactor is already on the road when the matter is canceled,
Code Enforcement pays the contractor $200. The owner showed up with his own contractor.
There was a glitch in the paperwork that assessed this amount against the property; however, no
work was done.
Gerry Strathman recommended deleting the assessment.
� Resolution ordering the owner to remove or repair the building at 382 Dewev Street. If the
owner fails to comply with the order, Code Enforcement is ordered to remove the building.
Chuck Votel reported this buiiding has been vacant since August 1998 and condemned since
February 1998. The owners aze Edwazd and Joanne Soltau and the State of IvIinnesota Trust
Exempt. The owners have not discussed their intentions with Code Enforcement. The City has
issued five summary abatements. The City has boarded the building to secure it against trespass.
The registration fees are due. Ramsey County has es6mated the mazket value to be $35,000.
Code Enforcement estimated the cost to repair is $50,000, the cost to demolish, $6,Q00 to $7,000.
7ames Gilliland, 1920 Roblyn Avenue, appeazed and stated he is surprised to heaz the City would
teaz down a building which looks repairable when there are enough vacant lots in the City.
Ramsey County has made a decision to put the house on their April 29 auction. Mr. Giililand
suggested letting the auction take place. Ae walked through the house, and feels there is nothing
structurally wrong with the foundation. A lot of labor needs to be done on the inside walls. Mr.
Gilliland may be interested in purchasing the home at a later date. Even if the home is sold for $1
to a contractor to repair, the home would stay on the tas rolls and everyone will be better off.
Gerry Strathman asked has Code Enforcement heazd from Ramsey County. Chuck V otel
responded he has no notes in the file about this. Mr. Strathman stated this property is an eyesore

and numerous complaints have been received. One of the criticisms from neighbors is that the
City moves so slowly on properties.
Gerry Strathman recommended approval of the resolution. Without the owner and the tax
exempt property personnel coming forwazd, it would be problematic to let this matter sit for a
while. Tas Exempt properties will be notified of Mr. Strathman's decision, and they can come
forward with a plan to the City Council.

Chuck Votel reported that at the meeting on February 16, the attomey for the mortgage company
intended to convey this ptoperiy to HUD. Code Enforcement has not heard from the attomey; no
bonds or pemuts have been posted.

Chuck Votel stated this is state owned land. The buiiding is an old Quonset. It is an eyesore, and

Council to hold public hearings to consider the advisability and necessiry of ordering the repair or
wrecking and removal of a twastory, wood frame dwelling located on property hereinafter refened to

VJHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before September 1, 1998, the following aze the now
known interested or responsible parties for the Subject Property: (SEE ATTACHED)
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated October 8, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by November 9, 1998; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property declaring

requested that the City Clerk schedule public hearings before the I.egislative Heazing Officer of the
City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose
of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, March 2, 1999 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and

I.egislative Code, Chapter 45.
That the costs of demolirion and removal of this building(s) is estnnated to exceed three
thousand dollazs ($3,000.00).

the Subject Properry.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal shall
be removed from the properry by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such properry as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L.egislative Code.

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On November 17, 1998 you agreed to certain conditions being placed on your
license as a result of a shooring outside of Jazzville. One of the condirions
was that all customers would pass through a metal detector to determine the
presence of any weapons. On December 28, 29 and 30,1998, officer checked
the licensed premises for compliance with the conditions. On December 28,
1998 at approximately 9:30 p.m. the police were inside the premises and
observed at least one customer enter the bar without a metal detector being
used. An additional condition R•as that exterior video surveillance cameras
would be installed to monitor outside activity in front of the licensed
premises. No video cameras were installed as of December 30, 1998.

2. No employees or patrons of Jazzville shall use, occupy, or loiter in or on any
space in the Rossmor Building, outside of the licensed premises.
3. A metal detector shall be used by the establishment to prevent the
introduction of weapons on the licensed premises. Every customer sha11 be checked
prior to entry, and reentry, no exceptions.
4. The manajement of the establishment must caIl police for assistance when
there are altercations between patrons or between patrons and empioyees of the
establishment. If patrons are ejected from the establishment for threatening or
violen[ behavior, the police shall be called immediately. No exceptions.
�. Manajement �vill ban people from the establishment who were previously
arrested, or asked to leave the establishment, due to their involvement in fights or
altercations.
6. Management wi11 provide the names and birth dates of all employees and
security personnel to the LIEP Office so that criminal back�round checks can be
conducted on these individuals.
7. Exterior video surveillance cameras shall be installed to monitor outside
activaty in front of the licensed premises.

Guy Willits reported the owner asked for this fee to be cut in hal£ The owner was out of town
during the assessment. Mr. Willits was working with the manager of the building who gave the
wrong information to Code Enfarcement, and Code Enforcement made a mistake with the dates.
The owner is willing to pay half the fee.
Getry Strathman recommended the assessment be reduced by half plus the cost of the service
chazges, which brings it to a total of $125.
900 Marvland Avenue East
Chuck Votel reported the owner could not be found, it was important to get the building secured,
and a contractor was called. If this conuactor is already on the road when the matter is canceled,
Code Enforcement pays the contractor $200. The owner showed up with his own contractor.
There was a glitch in the paperwork that assessed this amount against the property; however, no
work was done.
Gerry Strathman recommended deleting the assessment.
� Resolution ordering the owner to remove or repair the building at 382 Dewev Street. If the
owner fails to comply with the order, Code Enforcement is ordered to remove the building.
Chuck Votel reported this buiiding has been vacant since August 1998 and condemned since
February 1998. The owners aze Edwazd and Joanne Soltau and the State of IvIinnesota Trust
Exempt. The owners have not discussed their intentions with Code Enforcement. The City has
issued five summary abatements. The City has boarded the building to secure it against trespass.
The registration fees are due. Ramsey County has es6mated the mazket value to be $35,000.
Code Enforcement estimated the cost to repair is $50,000, the cost to demolish, $6,Q00 to $7,000.
7ames Gilliland, 1920 Roblyn Avenue, appeazed and stated he is surprised to heaz the City would
teaz down a building which looks repairable when there are enough vacant lots in the City.
Ramsey County has made a decision to put the house on their April 29 auction. Mr. Giililand
suggested letting the auction take place. Ae walked through the house, and feels there is nothing
structurally wrong with the foundation. A lot of labor needs to be done on the inside walls. Mr.
Gilliland may be interested in purchasing the home at a later date. Even if the home is sold for $1
to a contractor to repair, the home would stay on the tas rolls and everyone will be better off.
Gerry Strathman asked has Code Enforcement heazd from Ramsey County. Chuck V otel
responded he has no notes in the file about this. Mr. Strathman stated this property is an eyesore

and numerous complaints have been received. One of the criticisms from neighbors is that the
City moves so slowly on properties.
Gerry Strathman recommended approval of the resolution. Without the owner and the tax
exempt property personnel coming forwazd, it would be problematic to let this matter sit for a
while. Tas Exempt properties will be notified of Mr. Strathman's decision, and they can come
forward with a plan to the City Council.

Chuck Votel reported that at the meeting on February 16, the attomey for the mortgage company
intended to convey this ptoperiy to HUD. Code Enforcement has not heard from the attomey; no
bonds or pemuts have been posted.

Resolution ordering the owner to remove or repair the building at 995 Kennard Street. If
the owner fails to comply with the order, Code Enforcement is ordered to remove the
building.
Chuck Votel stated this is state owned land. The buiiding is an old Quonset. It is an eyesore, and
has been a neighborhood hangout for kids.

Chuck Votel reported the owner has not discussed their intentions with Code Enforcetnent. The

issued. Real estate taaces are unpaid in the amount of $3.56133. Code Enforcement estimates the
cost to repair is $40,000.

Council to hold public hearings to consider the advisability and necessiry of ordering the repair or

VJHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before September 1, 1998, the following aze the now

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal shall
be removed from the properry by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the Ciry of Saint
Paul shall remove and dispose of such properry as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested

The Director of the Office of License, Inspections and Environmental Protection is
recommending that adverse action be taken against your license. The basis for the adverse action
is:
On November 17, 1998 you agreed to certain conditions being placed on your
license as a result of a shooring outside of Jazzville. One of the condirions
was that all customers would pass through a metal detector to determine the
presence of any weapons. On December 28, 29 and 30,1998, officer checked
the licensed premises for compliance with the conditions. On December 28,
1998 at approximately 9:30 p.m. the police were inside the premises and
observed at least one customer enter the bar without a metal detector being
used. An additional condition R•as that exterior video surveillance cameras
would be installed to monitor outside activity in front of the licensed
premises. No video cameras were installed as of December 30, 1998.
If you do not dispute the above facts please send me a letter �ith a statement to that effect. The
matter will then be scheduled for a hearine before the St. Paul Ciry Council to determine what

1. The back entrance to the establishment shall remain locked to prevent entry
to the escablishment at all times, exczpt for daytime (7:00 a.m. to 6:00 p.m.)
deliveries, and emergency exiting. A sign shall be installed on the inside and
outside of [he rear door that reads, in large letters, "Emer�ency Exit Only--No
entrance except for daytime deliveries".
2. No employees or patrons of Jazzville shall use, occupy, or loiter in or on any
space in the Rossmor Building, outside of the licensed premises.
3. A metal detector shall be used by the establishment to prevent the
introduction of weapons on the licensed premises. Every customer sha11 be checked
prior to entry, and reentry, no exceptions.
4. The manajement of the establishment must caIl police for assistance when
there are altercations between patrons or between patrons and empioyees of the
establishment. If patrons are ejected from the establishment for threatening or
violen[ behavior, the police shall be called immediately. No exceptions.
�. Manajement �vill ban people from the establishment who were previously
arrested, or asked to leave the establishment, due to their involvement in fights or
altercations.
6. Management wi11 provide the names and birth dates of all employees and
security personnel to the LIEP Office so that criminal back�round checks can be
conducted on these individuals.
7. Exterior video surveillance cameras shall be installed to monitor outside
activaty in front of the licensed premises.

Guy Willits reported the owner asked for this fee to be cut in hal£ The owner was out of town
during the assessment. Mr. Willits was working with the manager of the building who gave the
wrong information to Code Enfarcement, and Code Enforcement made a mistake with the dates.
The owner is willing to pay half the fee.
Getry Strathman recommended the assessment be reduced by half plus the cost of the service
chazges, which brings it to a total of $125.
900 Marvland Avenue East
Chuck Votel reported the owner could not be found, it was important to get the building secured,
and a contractor was called. If this conuactor is already on the road when the matter is canceled,
Code Enforcement pays the contractor $200. The owner showed up with his own contractor.
There was a glitch in the paperwork that assessed this amount against the property; however, no
work was done.
Gerry Strathman recommended deleting the assessment.
� Resolution ordering the owner to remove or repair the building at 382 Dewev Street. If the
owner fails to comply with the order, Code Enforcement is ordered to remove the building.
Chuck Votel reported this buiiding has been vacant since August 1998 and condemned since
February 1998. The owners aze Edwazd and Joanne Soltau and the State of IvIinnesota Trust
Exempt. The owners have not discussed their intentions with Code Enforcement. The City has
issued five summary abatements. The City has boarded the building to secure it against trespass.
The registration fees are due. Ramsey County has es6mated the mazket value to be $35,000.
Code Enforcement estimated the cost to repair is $50,000, the cost to demolish, $6,Q00 to $7,000.
7ames Gilliland, 1920 Roblyn Avenue, appeazed and stated he is surprised to heaz the City would
teaz down a building which looks repairable when there are enough vacant lots in the City.
Ramsey County has made a decision to put the house on their April 29 auction. Mr. Giililand
suggested letting the auction take place. Ae walked through the house, and feels there is nothing
structurally wrong with the foundation. A lot of labor needs to be done on the inside walls. Mr.
Gilliland may be interested in purchasing the home at a later date. Even if the home is sold for $1
to a contractor to repair, the home would stay on the tas rolls and everyone will be better off.
Gerry Strathman asked has Code Enforcement heazd from Ramsey County. Chuck V otel
responded he has no notes in the file about this. Mr. Strathman stated this property is an eyesore

and numerous complaints have been received. One of the criticisms from neighbors is that the
City moves so slowly on properties.
Gerry Strathman recommended approval of the resolution. Without the owner and the tax
exempt property personnel coming forwazd, it would be problematic to let this matter sit for a
while. Tas Exempt properties will be notified of Mr. Strathman's decision, and they can come
forward with a plan to the City Council.
Resolution ordering the owner to remove or repair the building at 1099 Wakefield Avenue.
If the owner fails to comply with the order, Code Enforcement is ordered to remove the

Chuck Votel reported that at the meeting on February 16, the attomey for the mortgage company
intended to convey this ptoperiy to HUD. Code Enforcement has not heard from the attomey; no
bonds or pemuts have been posted.

the owner fails to comply with the order, Code Enforcement is ordered to remove the
building.
Chuck Votel stated this is state owned land. The buiiding is an old Quonset. It is an eyesore, and
has been a neighborhood hangout for kids.

Chuck Votel reported the owner has not discussed their intentions with Code Enforcetnent. The
property has been vacant since Mazch 1998. There have been 9 summary abatement notices
issued. Real estate taaces are unpaid in the amount of $3.56133. Code Enforcement estimates the
cost to repair is $40,000.
