Wf�2EAS, the Division of Public Health has rec�aested the City Cauncil
to hold a public hearirig to consider the advisability and necessity of the
correction or wrecking and removal of a tw�o-story, wood frame,
single-family residexice which is located on property hereafter referred to
as the "Subject Property" coccmonly �own as 2281 Priscilla Street, Saint
Paul, Minnesota and legally described as:

according to the recorded plat thereof, and
situate in Ratn�ey County, Minnesota.
WEiEREAS, based upon the records in the Ramsey County Recorder's Office
on March 22, 1988, the followirig persons are awners, interested parties or
responsible parties of the Subject Property: Meredith Smith, 1457 Western
Avenue North, Saint Paul, NN 55117; Meredith MacKenzie, 1457 Western
Avenue l�rth, Saint Paul, NH�T 55117; Meredith Smith, 2281 Priscilla
Street, Saint Paul, N�l 55108; Meredith MacKenzie, 2281 Priscilla Street,
Saint Paul, NIlV 55108; and
Wf�l2EA.S, the Division of Public Health has issued an order identified as
an "Abandoned Building Notice" dated May 10, 1988 which is attached and
incorporated as part of this resolution by this referer�e. This order was
served on all awners, interested parties and responsible parties of the Subject
Prc��erty lmawn to the enforc�rient officer. 1'he notices and orders
infornied these parties that the tw�o-story, wood frame, single-family residence
located on the Subject Property is an abandoned building and a nuisance
pursuant to Sections 45.01, Subd. 1 and 45.02, Subd. 11 of the Saint Paul
Legislative Code. The May 10, 1988 order also had attached to it a list of
deficiencies regarding the structure on the S�.ibject Property, said list is
attached and incorporated as part of this resolution; and

Wf�REAS, the May 10, 1988 order informed all owners, interested parties
and responsible parties that they mzst either repair the structure on the
Subject Property by correcting the list of deficiencies, or demolish the
structure, either action to take place by May 24, 1988.
WFIEREAS, no action has been taken regarding com�liance with the May 10,
1988 notice and order, and as a result the Division of Public Health requested
that a public hearing be scheduled to take place on Thursday, August 4, 1988
for the City Council to consider the advisability and necessity of ordering the
correction of the nuisance condition or in the alternative consider the
demolition and removal of this stnxcture; and
Wf�REAS, the above referenced owners, interested parties and responsible
parties have been personally served notice of the time and purpose of the
August 4, 1988 hearing before the Council;
VOf�REAS, a hearing was held before the Saint Paul City Council on August
4, 1988 ar�l all testim�ny and evidence was considered by the Council.
NOW TEIEREFORE, BE IT RE90LVED, that based upon all of the testimony and
evider�e presented at the August 4, 1988 hearing, the Saint Paul City Council
hereby adopts the follawing Findings and Order concerning the structure at 2281
Priscilla Street:
1. That in Dec�nber of 1985 the structure located on the Subject Property
was determined to be vacant. The building has remained vacant and has been
either open or boarded since December of 1985.
2. That since December of 1985 the City of Saint Paul has on niunerous
occasions issued orders to the owners to make this structure secure and not
accessable. On several occasions, because of the inaction on the part of the
owners, the City has had to hire a private contractor to make the b�ilding
secure and not open to access.
3. That the awners of the Subject Property have repeatedly failed to
register and pay the vacant bui.lding fee for this structure as required by City
ordinance.
4. That the Division of Public Health of the City of Saint Paul cond�nned
this structure as "Unfit for H�n Habitation under Chapter 34 of the Saint
Paul Legislative Code" in April 1984. The building is still subject to this
condemnation order.
5. That there are now and have been since December of 1985, multiple
exterior Housing Code or Building Code violations in existance at the Subject
Property.
6. That the owners, interested parties and responsible parties of this
structure are as previously stated in this resolution. These individuals have
been properly served notice of the August 4, 1988 hearing concerning this
structure.
7. That on May 10, 1988 an Abandoned Bizilding Notice was sent to the
awners, interested parties or responsible parties ordering these persons to
either demolish the structure or make repairs and cure the list of deficiencies
within (30) days.

8. That the order of May 10, 1988 has been disregarded by the awners,
interested parties and responsible parties.
9. That the tv�-story w�ood frame single-family residence located on the
Subject Property is an abandoned building under Section 45.01, Subd. 1, of the
Saint Paul Legislative Code in that it is "a building or portion thereof which
has stood unoccupied for longer than one (1) year" and during that period of
t�me it has been either "unsecured", "boarded", or has had "m�zltiple exterior
Housing Code or Building Code violations".
10. That the tw�-story wood frame single-family residence located on the
Subject Property is a nuisance as defined under Saint Paul Legislative Code
Section 45.02, Subd. 11, in that it is an abandoned building located in the
City of Saint Paul that has created a dangerous or unhealthy condition or which
threatens the public peace, health, safety or sanitary condition of the City or
which is offensive or has a blighting influence on the coimaanity.
11. That the costs of abatement of this nuisance are estimated to exceed
tw�o thousand dollars ($2,000.00) or the abatement involves demolition of a
building other than a structure accessory to a residential �zilding.
ORDER
The Saint Paul City Council hereby makes the following order:
l. The above referenced owners, interested parties and responsible
parties and their assigns shall make the Subject Property safe and not
detr�mental to the public peace, health, safety, and welfare and remove its
blighting influence on the com�xanity by rehabilitating this building and
correcting those deficiencies set forth in the list previously referenced in
accordance with all applicable codes and ordinances, or in the alternative by
desmlishing the building and filling the site in accordance with all applicable
codes and ordinances. The rehabilitation or d�nolition of the building m�zst be
completed within thirty f30) days of the date of mailing of this resolution.
2. If the above corrective action is not coa�leted within the thirty (30)
day time period, the proper City officials of the City of Saint Paul are hereby
authorized to take whatever steps are necessary to demolish this structure and
fill the site and charge the costs incurred against the Subject Property
pursuant to the provisions of Section 45.08 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the denalition and rgnoval shall be removed fran the building by
the owners, interested parties and responsible parties by the end of the thirty
(30) day time period. If the personal property is not so r�noved, the City of
Saint Paul shall remove and dispose of such property and fixtures as is
provided by law.

This building has stood unoccu�ied for longer than one year and meets one

Inasmich as the orders have not been co�leted to the satisfaction of the
Division and the continued abar�loned condition of the l�ilding contri.butes
a blighting influence and potential hazard to the neighborhood, it is the
recrnm�endation of the Division that the City Council pass a resolution
ordering the owners, interested parties and responsible parties to either
repair or d�nolish the �x.iilding in a timely manner to the satisfaction of
the City.
In the event the awners, interested parties or responsible parties fail to
corr�ly with the Council Resolution, the Division of Public Health should
be authorized to d�tiolish the building and assess all costs incurred in
the d�tolition against the real estate as a special asses�nent to be �
collected in the same manner as taxes.

hearing before the City Council to obtain a Council order for the repair
