An ordinance amending Chapter 162 of the Saint
Paul Legislative Code pertaining to parking
and traffic violators .
WHEREAS , the existing parking and traffic ordinances have no
provisions directed towards motor vehicles which accumulate
numerous outstanding citations ; and
WHEREAS , on February 8 , 1988 , there were over 120 individuals
who had eight or more warrants issued to them for unpaid parking
and traffic citations ; and
WHEREAS , the normal process when there has been no response
to a citation is inadequate regarding vehicles registered to
an address outside of the metropolitan area even though the
driver routinely accumulates citations in Saint Paul ; and
WHEREAS , the Ramsey County Traffic Violations Bureau and
the Saint Paul Police Department have requested legislation
to address this growing problem;
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l .
That Section 162. 01 of the Saint Paul Legislative Code
is amended so as to add the following:
162.01(c) . A motor vehicle shall be removed and impounded
if the motor vehicle or its owner ha _ts�hree or more parking
or traffic citations which have gorie into warrant
or are over sixty (60) days old. This shall not
be construed to authorize seizure of a vehicle without
a warrant where a warrant would otherwise be required.

Sec. 162.06 shall not apply to this section.
(d) . In the event that a motor vehicle is towed
under Sec . 162. 01(c) , the owner of the motor vehicle
shall receive notice of the right to an informal
hearing. The hearing will only determine the validity
of the tow, impoundment, and associated fees. The
hearing will not determine or adjudicate any citation
issued relative to the motor vehicle towed under
Sec . 162. 01 (c) . The owner of the vehicle or his
agent , must request such a hearing of the Traffic
Violations Bureau within fifteen days of the vehicle ' s
tow and impoundment. The hearing must be held within
two (2) working days of the request and shall be
conducted by a Traffic Violations Bureau hearing
officer.
Section 2.
That Section 162.03 of the Saint Paul Legislative Code is re-
numbered to 162. 03(a) :
Section 3 .
That Section 162. 03 of the Saint Paul Legislative Code
is amended so as to add the following:
Sec . 162 .03(b) . Notice of a vehicle ' s impoundment
under Sec . 162.01 (c) shall be given in accordance
with the procedures set out in Sec . 162.03(a) except
that notice shall be given within two (2) business
days of such impoundment.
Section 4.
That Section 162. 07 of the Saint Paul Legislative Code
is amended so as to add the following:
162 . 07(c) . When a motor vehicle is towed and impounded
under Sec . 162. 01(c) , the vehicle shall be released
to its owner or agent only af ter : 1 ) satisfactory
evidence of his identity, proof of valid insurance for

said vehicle is furnished, 2) the associated fees
for towing and storage are paid, and 3) all citations
which have gone into warrant or are over sixty (60)
days old, which list to the motor vehicle or its
owner, are either paid, bail or bond is posted, or
are dismissed by a court of competent jurisdiction.
Section 5.
This ordinance shall take effect and be in force thirty
days from and after its passage , approval , and publication.

August 31, 1988:
1. City Council Agenda 7/12/88, Item No. 3: Appeal of Dick Warwick to a decision of
the Truth in Housing Board pertaining to his cancelled license. (Laid over froirt
August 17, 1988, as requested by Dick Warwick.)
Under advice of the City Attorney's Office, this item should be heard by the fu11
City Council. Transcripts available at City Clerk's Office, similar to adverse
hearings. Public hearing date needs to be set at an official Council Meeting
(to be approximately two weeks after it appears on the City Council agenda).
2. City Council Agenda 7/28/8.8, Item No. 56: Resolution - 88-1253 - Suspending Qn Sale

Within the past couple of months there have been some problems with
• habitual violators who do not pay their parking tickets. These
. vehicles many times have out of state plates and the Traffic
� Violations Bureau is unable to issue warrants to these violators. �
Many municipalities have enacted "Scofflaw" Ordinances to handle this
type of violation. _ �
For our purposes, I would define a Scofflaw as the owner or person in
control of a vehicle which has accumulated and failed to respond to
five or more tickets which are at least 30 days old, An ordinance
which would allow a Police Officer or Parking Enforcement Officer to
impound vehicles which have received these tickets would enhance
compliance and return what would otherwise be lost revenue.

Enclosed is a copy of a Scofflaw Ordinance which was enacted by
Minneapolis. '
With the enactment of such an ordinance Z would work with T.V.B. to
set up a system for identification and verification of these vehicles.

St. Paul has a somewhat unique situation in that we are located close I
to our state border. There are many Wisconsin residents .who work in i
. Minnesota, violate St. Paul parking rules and return to Wisconsin. �

This situation also exist with college students from out of state and -
