Z'he notices and orders informed these parties that the two-story, vaood frame, trulti-family structure located on the Subject Property is an abandoryed bwailding and a nuisance pursuant to Sections 45.01, Stiabd. 1 ar�l 45.02, Subd. 11 of the Saint Paul Legislative Code. WHEREAS, no action has been taken regarding cocrQliance with the July 14, 1987 and May 13, 1988 notices and orders, and as a result the Division of Public Health requested that a public hearing be scheduled to talce place on Thursday, July 28, 1988 for the City Council to consider the advisability and necessity of ordering the correction of the nuisance condition or in the alternative consider the desnolition and re�noval of this structure; and �, the above referenced o�mers, interested parties a�rO�he1Ju1 parties have been personally servecl notice of the tim�e and purpo Y 28, 1988 hearing before the Council; Wf�REAS, a hearing was held before the Saint Paul City Council on July 28, 1988 and all testimony and evidence was considered by the Council. NOiW THE�tEFORE, BE IT RESOLVED, that based upon all of the testimony and evidence presented at the July 28, 1988 hearing, the Saint Paul City Council hereby adopts the following Findings and Order concerning the structure at 736-38 E�.iclid Street: l. That in February of 1986 the stn�cture located on the Subject Property was determined to be vacant and open to access. The building has remained vacant and has been either open or boarded since February of 1986. 2. That since February of 1986 the City of Saint Paul has on niac�erous occasions issued orders to the owners to make this structure secure and not accessable. On many occasions, because of the inaction on the part of the aaners, the City has had to hire a private contractor to make the building secure and not open to access. 3. That the owners of the Subject Property have repeatedly failed to register and pay the vacant building fee for this structure as required by City ordinarice. 4. That the Division of Public Health of the City of Saint Paul condemned this structure as "Unfit for Htunan Habitation under Chapter 34 of the Saint Paul Legislative Code" in February of 1986. The l�uilding is still subject to this condemnation order. 5. That there are now and have been since February of 1986, mnzltiple exterior Housing Code or Building Code violations in existance at the Subject Property. 6. That the owners, interested parties and responsible parties of this structure are as previously stated in this resolution. These individuals have been properly served r�tice of the July 28, 1988 hearing concerning this stru�cture. 7. That on July 14, 1987 and May 13, 1988 Abandoned �.iilding Notices were sent to the awners, interested parties or responsible parties ordering these persons to either d�nolish the structure or make repairs and cure the list of deficiencies within (30) days. - , ; � �-�-��� 8. 7.'h�at the orders of July 14, 1987 and May 13, 1988 have been disregarded by the awners, interested parties and responsi.ble parties. 9. That the two-story w�ood frame m�zlti-family stnnLCCture located on the Subject Property is an abarxioned l�uilding under Section 45.01, Subd. 1, of the Saint Paul Legislative Code in that it is "a building or portion thereof which has stood unoccupied for longer than one tl) year" and during that period of time it has been either "unsecured", "boarded", or ha.s had "multiple exterior Housing Code or Bu.ilding Code violations". 10. That the tw�-story w�ood frame multi-family structure located on the Stiabject Property is a nuisance as defined under Saint Paul Legislative Code Section 45.02, S�abd. 11, in that it is an abandoned Y�.iilding located in the City of Saint Paul that has created a d,angerous or unhealthy condition or which threatens the public peace, health, safety or sanitary condition of the City or which is offensive or has a bliqhting influence on the coar�nanity. 11. That the costs of abatement of this nuisance are estimated to exceed tw�o thousand dollars ($2,000.00) or the abat�nent inv�lves demolition of a building other than a stn�cture accessory to a residential building. OiRDER The Saint Paul City Council hereby makes the follawing order: l. The above referenced owners, interested parties and responsible parties and their assigns shall make the Subject Property safe and not detrimental to the public peace, health, safety, and welfare and rernpve its blighting influence on the com�nity by rehabilitating this building and correcting those deficiencies set forth in the list previously referenced in accordance with all applicable codes and ordinances, or in the alternative by demolishing the l�uilding and filling the site in accordance with all applicable codes and ordinances. The rehabilitation or de�lition of the building must be c�leted within thirty (30) clays of the clate of mailing of this resolution. 2. If the above corrective action is not conpleted within the thirty t30) day time period, the proper City officials of the City of Saint Paul are hereby authorized to take whatever steps are necessary to demolish this structure and fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Section 45.08 of the Saint Paul Legislative Code. 3. In the event the b�zi.lding is to be demolished by the City of Saint Paul, all personal property or fixtures of any kind which shall unreasonably interfere with the demolition and rem�val shall be r�aved fro�n the building by the awners, interested parties and responsible garties by the end of the thirty (30> day time period. West side - t�ao windaws are boarded. Repair or replace these windows. 7. Southwest corner - the stucco veneer has fallen off the walls. The sheathing is decayed. Replace all decayed �aood and replace the missing siding. 8. South side near the west corner - the sill plate for the wall is decayed. Replace all decayed wood and repair the wall. 9. Rear windows and doors are boarded over. Rep�ir or replace doors and windaws and r�nove boards. 10. West side - lst floor open porch has decayed wood on the outside wall. Replace all decayed �aood and repair the wall. 11. East side rear porch - the stucco is b�zlged and pulling away from the 2nd floor. Remove all loose stucco and repair the wall. 12. The masonry chimney has cracks and is leaning out of pliunb. Repair the chimney. 13. The second floor rear porch deck has decayed wood. Replace all decayed wood and repair the porch. 14. There is evidence of roof leakage above the rear porch. Repair all roof leaks. 15. C�.itters are rusted and lack downspouts. Al1 sides - the wooden trim board at the second floor level is decayed, loose and warned. Repair or replace this trim board. 21. The sewer connections for the do�nmspouts are uncapped. Seal the open sewer connections. 22. West side - the stucco is bulged, cracked and partially missing. Repair the stucco. 23. West side - windaws are boarded and/or vandalized. Repair all wir�lows and resnove the boards. 24. Rear porch - the colLUnns, decks, steps and roof are decayed and in a hazardous condition. Repair or remove this porch. 25.
