THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
The Saint Paul Legislative Code, Section 49.02 is hereby amended to read as
follows:
�' Section 49.02. Residential premises; property owner's obligation for
maintenance.
(a) It is the obligation oi the lessor to covenant to maintain leased
' residential premises in compliance with all applicable health and
safety laws of the state and city during the term of the lease, except �
when the disrepair has been caused by the willful, malicious or
irresponsible conduct of the lessee or a person under his direction
and control.
(b) No ep rson shall let to another for occupancy � dwelling or -
dwelling unit without first ig ving to the tenant or lessee written
notice of who is responsible for Paying bills for electricity, as,
water, hot water or steam, or solid or liquid fuel to be used � the
tenant or lessee.
(c) The owner or lessor shall be the bill payer or customer of the
utility:

measures the amount, quantity, or extent of electricity, gas,
water, and hot water or steam consumed on the premises leased �
the tenants or lessee; or
(2) In the absence of a separate solid or liquid fuel heating
system for the premises leased � the tenants or lessee.
(d) The provisions of section 49.02 � not be waived � contract or
otherwise.
Section 2.
The Saint Paul Legislative Code, Chapter 46, as amended by C.F. 88-1256,
Ordinance No. 17580, is further amended to read as follows:
Chapter 46. Utilities - Notice
of Intent to Discontinue Service
and Notice of Discontinued Service.
Section 46.01. Notice of intent to discontinue service to be posted

(a) All utility companies and governmental subdivisions which supply
gas, electric, water, hot water or steam service in the city of Saint
Paul, either through a single meter or to dwellings with two or more
dwelling units which are not individually metered, shall post on or
near the front and rear entrance of a multiple dwelling e� €e�� {4}
��ae����gs e� ate�e a notice of intent to discontinue such service for
failure to pay utility bills. Such notice shall be posted clearly and
conspicuously as to be observable to persons entering or exiting from
the property.
(b) Such notice shall be posted not less than seven (7) nor more than
thirty (30) days prior to the actual discontinuance of the service and
shall state the date on or about which such service shall be

(c) No utility service shall be discontinued until all provisions of
this e�ag�e� section have been complied with.

�e} (d) Any notice of intent to discontinue utility service posted
pursuant to this chapter shall contain the following statement printed
on the face of the notice in a conspicuous manner:
"The removing or defacing of this placard by an unauthorized
person shall be deemed a misdemeanor and conviction thereof is
punishable by a fine not to exceed ���e seven hundred dollars
($�700) and/or by imprisonment not to exceed 90 days."
The notice shall also inform the tenant or lessee of their right to
p� the outstanding bill or portion thereof and deduct the cost from
the rent pursuant to Section 49.03(a) .

Sec. 46.02. Notice of Discontinued Service to be Sent to the City•
All utility companies and governmental subdivisions which supply gas,
electric, water, hot water or steam service in the city of Saint Paul
to � dwelling or building used for residential purposes, including
, single family or duplex structures, shall forward to the city a notice
whenever service has been discontinued for a� reason for a ep riod of
�� � �30) days• The notice shall include the reason for the
discontinuation of service. It shall be forwarded � U.S. mail or hand
delivery to the division of fire prevention for all buildings required
to have a certificate of occupancy and to the division of up blic
health for all other buildings.
Sec. 46.03. Penalties.
A� ep rson who fails to comply with a� provision of this chapter, or
who defaces, removes or otherwise obstructs a notice required � this
chapter shall be ug ilty of a misdemeanor and � be punished as
provided � Section 1.05 of this Legislative Code.
Section 3.
Nothing herein shall affect the validity of a rental agreement, executed on
or before the effective date of this ordinance.

SUBJECT: Amendments to Shared Meter Ordinance.
Enclosed please find a copy of the revised ordinance, which incorporates noti-
fication amendments suggested in the Public Works Committee and reconciles this
ordinance, C.F. 88-1256 (notice of the disconnection) , and the previous posting
ordinance. The changes eliminate the notice to the City prior to disconnection
(since it is obsolete and never used), confirms that violations are misdemeanors,
and clarifies when notices of shutoffs are to be sent to the City.
The shared meter ordinance will have its public hearing at tomorrow's Council
meeting. The testimony presented to the Public Works Committee indicated the
need for and value of this ordinance; the public hearing should reinforce the
need.
