The developer sha11 file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's Office. The developer shall file a copy of the Council Resolution on each property deed within the development. PURPOSE: To consider an application for a Combined Preliminary and Final Plat to create 32 lots--30 are for individual townhomes, one for the homeowners' common space, and one for a property management office. B. PARCEL SIZE: 216,549 sq. ft. (5.0 acres) with 45 feet of frontage on the W. Cottage Ave. cul-de-sac. In addition, about 12,000 squaze feet of W. Ivy Ave. aze proposed to be vacated and added to the site. EXISTING LAND USE: Has been vacant land; now townhouses are under construction. C. SURROUNDING LAND USE: � North: East: South: West: City-owned bluff land along Wheelock Parkway in an R-2 zone. Apartment buildings in an RM-2 zone. BN-Santa Fe railroad and marshlands beyond in R-2 and RM-2 zones. City-owned bluff land along Wheelock Parkway and single-family homes in an R-2 zone. � 1 E. ZONING CODE CITATION: Section 67301 says that platting is required when a subdivision creates five or more lots. Section 67.406 gives criteria for the review of � subdivision applications. These criteria are covered below in the fmdings secrion of this staff report. F. HISTORY/DISCUSSION: Until the townhouse developmenY proposal, there were no zoning cases concerning this properry. The townhouse development is being builT at the same number of housing units that would be permitted as detached houses in the R-2 zone, but attached townhouses aze being built under the terms of special condition use permit 98-163 issued by the Planning Commission on 8125l98. The Planning Commission held a public hearing on the proposed development The pernrit was approved by a unanunous voice vote with four conditions: a landscaped island in the cul- de-sac; expert advice on mitigating railroad noise; vacation of W. Ivy Street right-of way; and townhouse platting. The City Council considers a resolution for the vacation of W. Ivy Street on 2/24/99. As of February 1999, four of the townhouses aze under construction. G DISTRICT COiJNCIL RECOD�Il�'IENDATION: Last July when the Planning Commission was considering the special condition use permit, the District 6 Planning Council recommended approval of the development with four conditians, which were incorporated into the Planning Commission's approval resolurion. H. REQUIRED FINDINGS: � All the applicable provisions of tfie Legislative Code are complied with. This fmding is met. City staff have reviewed the proposed preliminary and final piat and have reviewed the site pIan. They have determined that all appIicable provisions of city codes aze met. 2. The proposed subdivision will not be detrimentai to the present and potential surrounding iand uses. This $nding is met. The townhouses are surrounded by an apartment complex, railroad tracks and city-owned btuff 1and. The traffic increase on W. Cottage Ave. wilt be similar to the increase if the site were built with singte-family houses. The effects on surrounding property were taken into consideration by the Platuting Commission when it approved the special condition use permit. 3. The area surrounding the snbdivision caa be p2anned and developed in coordination and compatibility with the proposed subdiv4sion. This findiag is met. If any of the large bluff-side lots to the west are ever subdivided, they would probably get streei access from the west by an extension of Cohanssey Street, not through a Cottage Street ea�tension due Yo the sTeep topography. 4. The subdivision is in conformance with the Comprehensive Pla�►. This finding is met. 2 � aq.�43 The Housing Chapter of the Comprehensive Plan currenfly under discussion by the City • Council calls for new housing developmettt to attract the empty nester mazket that will grow rapidly during the next two decades. 5. The subdivision preserves and incorporates the site's important eaListing natural features, wherever possible. This finding is met. The site is at the base of the Wheelock Bluff. It wi11 have two retaining walis along the steepest segments of the western side of the development, but more than rivo-thirds of the westem side will have graded slopes without any retaining walls. The development will be landscaped to attract home buyers. 6. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuousty high water table, severe soii conditions or otber menace. This finding is met. The special condition use permit inciudes conditions about noise insulation and emergency vehicie maneuvering. No unsafe conditions were uncovered in the stafPs site plan review process. 'The development can be economicatly served with public facilities and services. This finding is met. The public utility issues were worked out in the site plan review process. Street access to the townhouses wi11 be from Conservatory Court, which wi11 be a private street maintained by the homeowners' association. � I STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval of the preliminary and final plat for Wheelock Pazkway Cottages at 1310-1368 Conservatory Court (between Cottage Ave. and Western Ave.) by Better Living Homes, Inc. with the following conditions: 1. The townhouse development is being builT at the same number of housing units that would be permitted as detached houses in the R-2 zone, but attached townhouses aze being built under the terms of special condition use permit 98-163 issued by the Planning Commission on 8125l98. The Planning Commission held a public hearing on the proposed development The pernrit was approved by a unanunous voice vote with four conditions: a landscaped island in the cul- de-sac; expert advice on mitigating railroad noise; vacation of W. Ivy Street right-of way; and townhouse platting. The City Council considers a resolution for the vacation of W. Ivy Street on 2/24/99. As of February 1999, four of the townhouses aze under construction. G DISTRICT COiJNCIL RECOD�Il�'IENDATION: Last July when the Planning Commission was considering the special condition use permit, the District 6 Planning Council recommended approval of the development with four conditians, which were incorporated into the Planning Commission's approval resolurion. H. REQUIRED FINDINGS: � All the applicable provisions of tfie Legislative Code are complied with. This fmding is met. City staff have reviewed the proposed preliminary and final piat and have reviewed the site pIan. They have determined that all appIicable provisions of city codes aze met. 2. The proposed subdivision will not be detrimentai to the present and potential surrounding iand uses. This $nding is met. The townhouses are surrounded by an apartment complex, railroad tracks and city-owned btuff 1and. The traffic increase on W. Cottage Ave. wilt be similar to the increase if the site were built with singte-family houses. The effects on surrounding property were taken into consideration by the Platuting Commission when it approved the special condition use permit. 3. The area surrounding the snbdivision caa be p2anned and developed in coordination and compatibility with the proposed subdiv4sion. This findiag is met. If any of the large bluff-side lots to the west are ever subdivided, they would probably get streei access from the west by an extension of Cohanssey Street, not through a Cottage Street ea�tension due Yo the sTeep topography. 4. The subdivision is in conformance with the Comprehensive Pla�►. It wi11 have two retaining walis along the steepest segments of the western side of the development, but more than rivo-thirds of the westem side will have graded slopes without any retaining walls. The development will be landscaped to attract home buyers. 6. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuousty high water table, severe soii conditions or otber menace. This finding is met. The special condition use permit inciudes conditions about noise insulation and emergency vehicie maneuvering. No unsafe conditions were uncovered in the stafPs site plan review process. 'The development can be economicatly served with public facilities and services. This finding is met. The public utility issues were worked out in the site plan review process. These criteria are covered below in the fmdings secrion of this staff report. F. HISTORY/DISCUSSION: Until the townhouse developmenY proposal, there were no zoning cases concerning this properry. The townhouse development is being builT at the same number of housing units that would be permitted as detached houses in the R-2 zone, but attached townhouses aze being built under the terms of special condition use permit 98-163 issued by the Planning Commission on 8125l98. The Planning Commission held a public hearing on the proposed development The pernrit was approved by a unanunous voice vote with four conditions: a landscaped island in the cul- de-sac; expert advice on mitigating railroad noise; vacation of W. Ivy Street right-of way; and townhouse platting. The City Council considers a resolution for the vacation of W. Ivy Street on 2/24/99. As of February 1999, four of the townhouses aze under construction. G DISTRICT COiJNCIL RECOD�Il�'IENDATION: Last July when the Planning Commission was considering the special condition use permit, the District 6 Planning Council recommended approval of the development with four conditians, which were incorporated into the Planning Commission's approval resolurion. H. REQUIRED FINDINGS: � All the applicable provisions of tfie Legislative Code are complied with. This fmding is met. City staff have reviewed the proposed preliminary and final piat and have reviewed the site pIan. They have determined that all appIicable provisions of city codes aze met. 2. The proposed subdivision will not be detrimentai to the present and potential surrounding iand uses. This $nding is met. The townhouses are surrounded by an apartment complex, railroad tracks and city-owned btuff 1and. The traffic increase on W. Cottage Ave. wilt be similar to the increase if the site were built with singte-family houses. The effects on surrounding property were taken into consideration by the Platuting Commission when it approved the special condition use permit. 3. The area surrounding the snbdivision caa be p2anned and developed in coordination and compatibility with the proposed subdiv4sion. This findiag is met. If any of the large bluff-side lots to the west are ever subdivided, they would probably get streei access from the west by an extension of Cohanssey Street, not through a Cottage Street ea�tension due Yo the sTeep topography. 4. The subdivision is in conformance with the Comprehensive Pla�►. The subdivision preserves and incorporates the site's important eaListing natural features, wherever possible. This finding is met. The site is at the base of the Wheelock Bluff. It wi11 have two retaining walis along the steepest segments of the western side of the development, but more than rivo-thirds of the westem side will have graded slopes without any retaining walls. The development will be landscaped to attract home buyers. 6. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuousty high water table, severe soii conditions or otber menace. This finding is met. The special condition use permit inciudes conditions about noise insulation and emergency vehicie maneuvering. No unsafe conditions were uncovered in the stafPs site plan review process. 'The development can be economicatly served with public facilities and services. This finding is met. The public utility issues were worked out in the site plan review process.
