RESOLUTION AUTHORIZING PLACEMENT
OF ADVERTISING DISPLAY PANELS IN
THE PEDESTRIAN SKYWAY SYSTEM
WHEREAS , pursuant to Chapter 170 of the Saint Paul Legislative
Code, Skycom, Inc. , and the City have entered into a Display Permit
Agreement dated July 27 , 1987 , under terms of which four computer
controlled visual display panels have been installed in the skyway
level of Town Square Park by Skycom, Inc . ; and
WHEREAS , pursuant to Section 140. 07 (a) (3) Skycom, Inc . , has
made application for a franchise to install additional display panels
in other locations in the pedestrian skyway system; and
WHEREAS , the Skyway Governance Committee has reviewed the
franchise application and supporting documents including building
o�mer consents and contracts and supports the grant of a franchise
by the City Council to Skycom, Inc. ; and
WHEREAS , a nonexclusive franchise ordinance has been introduced
and is under consideration by the Council and Skycom has requested
permission to install five or more panels in the public easement
area of the skyway system at ris�c of removal all at Skycom' s cost
should the ordinance not be adopted; now therefore, be it
RESOLVED by the Council of the City of Saint Paul that upon
site plan approval by the Skyway Governance Committee and Department
of Public ��Torks and upon issuance of necessar_y building permits ,
Skycom may place certain advertising display panel fixtures in the
skyway system subject to the following conditions :

1) That the franchise fee established by the franchise
ordinance shall apply and be payable from the date of
first placement and operation of an advertising display
panel fixture within or at a location viewable within
the skyway system.
2) That Skycom shall at its expense remove these fixtures
and restore the property to its former condition upon
receipt of notice from the City Council to make sucl�
removal ;
3) That Skycom defend and indemnify the City and the owner
of any building containing a skyway easement in which a
display fixture is placed against any claim or damage
award arising out of its placement, operation or removal
of these fixtures ; and
4) That Skycom post with the City Clerk a performance bond
in form satisfactory to the City Attorney in amount of
$50 , 000 conditioned upon its prom�t and satisfactory
performance of the conditions of this Resolution.

This Advertising Rate Card applies to the advertising display locations shown on the attached location
map which are owned and operated by SkyCom, Inc. as of the above date. SkyCom Inc. reserves the
right to substitute other eomparable locations for the locations shown on the location map or to reduce
advertising rates as compensation for any lost locutions.
� Advertising is exhibited at such locations for one minute spots during prime time (i.e., 50 seconds with
a 10 second sweep) and for two minute spots during standard time (i.e., 110 seconds with a 10 second
sweep). Prime time is 10:00 a.m. - 2:00 p.m., Mondays through Saturdays, and 4:00 p.m. - 6:00 p.m.,

t1HE�EaS, the l��rector of the Department of Human Rights has
receiv�d a cotnplair�t from James Flowers alleging that he was dis-
criiainated against by the Public Housing Agency in the area of
employment because of his race, the alleged violation of the St.
Paul Human Rights Ordinance has been investigated and the Director
has determined the probable cause exists to believe that a violation
has occurred; and
WHEREAS, the City Attorney represents the Public Housing Agency
of the City of Saint Paul on a regular basis; and
WHEREAS, the Director of the Department of Human Rights has
been advised by the City Attorney that the City Attorney cannot,
because of a potential conflict of interest, represent both the
Human Rights Department and the Public Housing Agency; and
WHEREAS, that Director of the Department of Human Rights has
requested that the City Attorney appoint outside counsel to re-
present the Department of Human Rights from a list of attorneys
prepared for such contingencies, as well as a hearing officer;
and
WHEREAS, it appears that this is an appropriate case for the
appointment of outside counsel; now, therefore, be it
RESOLVED, that Linda A. Miller is hereby appointed to represent
the Department of Human Rights in the complaint of James Flowers vs.
the Public Housing Agency of the City of Saint Paul at a rate of
$75 . 00 per hour, said fee to be charged to Activity Code 09073
provided however the total fee shall not be in excess of a reason-
able fee having reference to the Code of Professional Responsibility
and counsel shall submit monthly itemized statements; and, be it
