WH�REAS, Wayne Cardes, Sigma Surveying Services, submitted the attached
prbposed Registered Land Survey for City Council approval ; and
WH�REAS, the appropriate city departments reviewed the proposed R.L.S. and
deltermined that it met the requirements of Section 67 of the city's
Zoning Code; and
WH�REAS, notice of public hearing before the City Council was duly published in the
of!ficial newspaper of the city on April 30, 1988 and notices were duly mailed
to each property owner situated wholly or partly within 350' of said R.L.S. ;and
WHIEREAS, a public hearing before the City Council was conducted on May 26 and June
16, 1988 where all interested persons were heard, and the Council having considered
al'1 the facts and recommendations concerning said R.L.S. ;
NOIW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves this
R�gistered Land Survey for Wayne Cardes as indicated on the attached survey.

A. PURPOSE: To consider a Registered Land Survey to simplify an existing
lengthy and confusing legal description.
B. SITE � AREA CONDITIONS: The parcel contains an existing single family
residence; no physical land configuration changes are anticipated as a
result of this R.L.S.
C. FINDINGS:
1. The existing property configuration resulted from a condemnation
procedure for Lower Afton Road.
2. Chapter 67.000 Subdivision(d) states that parcels resulting from the
acquisition by governmental agencies for public improvements or uses
are not considered nor regulated as a subdivision; therefore, no
platting is required.
3. Appropriate city departments reviewed the proposed R.L.S. and found
that it conformed to the intent of Chapter 67.00.
D. STAFF RECOMMENDATION: Based on findings 1 through 3, staff recommends
approval of the Registered Land Survey as submitted.
