Whereas. the City Ccu�cii adoptec� Or�dinance Nc. 174�8 C.F. 87-1377 on
Uctober 9, 3987, est-��ablishing a moratorium on heliports and h��lipads
pending completion t�f a study, and
Where�s. the Council may wish to repeal the moratorium in I-1 Zoning
districts (Saint F'�ul Legislative Code. section 60.614 (2) ) priar to the
moratorium's expiration date of October 9, 1�38E3, if necessary to permit
location of a medic�! heliport f=acility, but the C�uncil at this time does
not have sufficient information to determine what ma,y be appropriate
r_ondit.ion� for zoning of such a heliport facility. now, therefore, be it.
Reso�ved. that the City Council may repeal the moratorium in I-1 zoning
r�istricts prior to Qctober 9, 1988, if al ! the fiollowing steps and
canditions describ�d befow are complied with:
1 . Whiie the mor;�torium is in effect, any applicant for a special
condition use permit agr�es in writing to the procedure outlined in this
re�a)ution and to the use of a $S,OOU consultant fee which will assist the
city in determining what conditions for heliports are appropriate and
within the c9ty's authority. The fee i� to be paid by the applicant.
2. 7he applicant then al�piies for a special canditi�n use permit,
according to regular cit.y regulati�ns and procedures.
3. City staff. wtth the a5sistance of the consul�ant and legal cou�sel ,
will study and draft for Planning G�mm�ssion review conditions for issuance
of a special candition use permit. These may be any restrictions within the
city's authority, including but not limited to: number of helicopters, type
of helicopters, hours o� operation for non--emergencv flights, designatio�
��f fiight paths. on-site noise abatement, special building hPight limit�,
and operatic�nai restrictions and their enfarcement.

on the permit application. After the public hearing, the Planning
C�mmission wiil act to approve or d�ny the permit. Planning Commission
action is sub,ject to appeal to the City Council as �rovided in the 5aint
Paul Legislative Code, sectian 6d.2U6.

RE: Agenda Item 4�20, Tuesday, October 18, 1988
Final order of the proposed Smith Avenue NPP Lighting Project �62 is
before the Council for consideration today. This project has been a
matter of lengthy discussion in the community, and consensus in support
of this proposal has not been reached. Since the project remains
controversial with some who would be subject to assessment and there is
sentiment among project supporters not to impose the project without
general consensus, I suggest that the final order be denied with the
proviso that our interest in working with the community on a proposal
that may have more general support remains.
Thank you for considering my comments as part of the discussion.
