Council File # `-` � �'� 1� 0 R 1 G1 N A L Green Sheet #�` � O � RESOLUTION CITY OF SAINT PAUL, MINNESOTA ' n /��.�t � , Presented By 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 Referred To Committee: Date Preliminary and Final Plat Approval for Phalen Village Subdivision WHEREAS, the Saint Paul Housing and Redevelopment Authority has submitted the attached preliminary and final plat for six lots and a segment of Phalen Boulevard located at the former Phalen Shopping Center site (bounded by Bazclay, Magnolia, Prosperity, and Rose) for City Council approval; WHEREAS, the appropriate City departments have reviewed the plat and found, as explained in the staff report to the City Council, that it meets the requirements of Chapter 67 of the Zoning Code; WHEREAS, the Phalen Village Subdivision is an implementation step in the Phalen Village Smail Area Plan, which was adopted by the City Council as a part of the Comprehensive Plan; WI�REAS, notice of a public hearing before the City Council was duly published in the official newspaper of the City and notices were mailed to each owner of affected property including all property situated within 350 feet of the subject property; WHEREAS, the City Councit held a public hearing on the proposed plat on February 24, 1999, where all interested parties were given an opportuniTy to be heard and the Council considered all the facts and recommendations concerning the plat; 23 NOW, THEREFORE, BE IT iZESOLVED, that the City Council accepts and approves the attached preliminary and 24 final plat for the Phalen Village Subdivision subject to the condition that the developer shall file a copy of this Council Resolution with the Ramsey County Recorder's Office and on each property deed within the development. ZONIlVG CODE CITATION: Section 67301 says that platting is required when a subdivision requires paved streets and other public improvemenYs. The Phalen Village Plat includes a new street section for Phalen Boulevazd and the restoration of a public pond to be known as Ames Lake. Section b7.406 gives criteria for the review of subdivision applications. These criteria are covered below in the findings section of this staff report. F. HISTORY/DISCUSSION: This plat reflects decisions made in the Phalen Village Small Area Plan and redevelopment projects pursuant to the plan. 3erry's New Mazket, a supermarket, will remain on Block 2, Lot 1. They also control the property across the proposed Phalen Blvd. from their store, which will be for commercial redevelopment on Block 1, Lots 1 and 2. The southeast part of the site will become a restored Ames Lake on Block 2, Lot 2 and part of Lot 3. The easterly part of Lot 3 will either become parkland or will subsequently be divided off as a new housing site. In the northeast corner, Lot 4 will be attached to property north of Rose Ave. and will become part of the new BCA site fronting on Maryland Ave. G DISTRICT COIINCIL RECOIVIMENDATION: No recommendation w�as received bv the time of this staff report. H REQUIRED FINDINGS: • 1. All the applicable provisions of the Legislative Code are complied with. This findina is met. City staff have reviewed the proposed preliminary and final plat and have � determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be detrimental to the present and potenfiat surrounding land uses. This finding is met. The restoration of Ames Lake and the prepazation of land for commercial and office redevelopment are an investment by thz city and the developers in the improvement of the azea. There has been a great dea] of public participation in redevelopment plans for the area, which w•as the Phalen Shopping Center. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordinatiom and compatibility with the proposed subdivision. This findin� is met. Several recent or proposed developments surround the site, such as the new Prosperity A��e. connection to the north flanked by the new Phalen Clinic and the proposed BCA building. On the south, the HRA has acquired a vacant site for housins. 4. The subdivision is in conformance with the Comprehensive Plan. The subdivision preserves and incorporates the site's important ezisting aaturat • features, wherever possible. All land intended for building sites can be used safely without endangering residents by peril from flood, erosion, continuovsly high water table, severe soil conditions or other menace. This finding is met. As part of the Phalen Village Small Area Plan, drainage needs were analyzed. The Iowest land is now proposed for the restored lakz. The rest of the site can be developed without endangering residents. The development can be economically served with public facilities and services. Tlus finding is met. The Phalen Village Plat includes a new street section for Phalen Boulevazd and the restoration of a public pond to be known as Ames Lake. Section b7.406 gives criteria for the review of subdivision applications. These criteria are covered below in the findings section of this staff report. F. HISTORY/DISCUSSION: This plat reflects decisions made in the Phalen Village Small Area Plan and redevelopment projects pursuant to the plan. 3erry's New Mazket, a supermarket, will remain on Block 2, Lot 1. They also control the property across the proposed Phalen Blvd. from their store, which will be for commercial redevelopment on Block 1, Lots 1 and 2. The southeast part of the site will become a restored Ames Lake on Block 2, Lot 2 and part of Lot 3. The easterly part of Lot 3 will either become parkland or will subsequently be divided off as a new housing site. In the northeast corner, Lot 4 will be attached to property north of Rose Ave. and will become part of the new BCA site fronting on Maryland Ave. G DISTRICT COIINCIL RECOIVIMENDATION: No recommendation w�as received bv the time of this staff report. H REQUIRED FINDINGS: • 1. All the applicable provisions of the Legislative Code are complied with. This findina is met. City staff have reviewed the proposed preliminary and final plat and have � determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be detrimental to the present and potenfiat surrounding land uses. This finding is met. The restoration of Ames Lake and the prepazation of land for commercial and office redevelopment are an investment by thz city and the developers in the improvement of the azea. There has been a great dea] of public participation in redevelopment plans for the area, which w•as the Phalen Shopping Center. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordinatiom and compatibility with the proposed subdivision. This findin� is met. Several recent or proposed developments surround the site, such as the new Prosperity A��e. connection to the north flanked by the new Phalen Clinic and the proposed BCA building. On the south, the HRA has acquired a vacant site for housins. 4. The subdivision is in conformance with the Comprehensive Plan. The Phalen Village Plat includes a new street section for Phalen Boulevazd and the restoration of a public pond to be known as Ames Lake. City staff have reviewed the proposed preliminary and final plat and have � determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be detrimental to the present and potenfiat surrounding land uses. This finding is met. The restoration of Ames Lake and the prepazation of land for commercial and office redevelopment are an investment by thz city and the developers in the improvement of the azea. There has been a great dea] of public participation in redevelopment plans for the area, which w•as the Phalen Shopping Center. The plat will be beneficial to surrounding land uses. 3. The area surrounding the subdivision can be planned and developed in coordinatiom and compatibility with the proposed subdivision. This findin� is met. Several recent or proposed developments surround the site, such as the new Prosperity A��e. connection to the north flanked by the new Phalen Clinic and the proposed BCA building. On the south, the HRA has acquired a vacant site for housins. 4. The subdivision is in conformance with the Comprehensive Plan. This finding is met. As part of the Phalen Village Small Area Plan, drainage needs were analyzed. The Iowest land is now proposed for the restored lakz. The rest of the site can be developed without endangering residents. The development can be economically served with public facilities and services. Tlus finding is met. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval of the preliminary and final plat submitted by the HRA for Phalen Village at the site of the former Phalen Shopping Center (bounded by Bazclay, Magnolia Prosperity, and Rose) provided that the developer shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's Office and on each property deed within fhe development.
