THE COUNCIL OF THE CITYIOF SAINT PAUL DOES ORDAIN:
Section 1 .
That 5ection 73.061of the Saint Paul Legislative Code be and is hereby

Dear, Mayor Latimer:
The Heritage Preservatio�h Commission has adopted criteria to be considered by
the HPC in reviewing andlcommenting on proposed street name changes. The
criteria were adopted inlresponse to a 1987 City Council resolution which
requires HPC review of a�d comment on any proposed name change for a Saint Paul
city' street which has haqi its current name for fifty years or more prior to
acti'on on the name chang� by the City Council. The criteria are listed in the
attached Heritage PreserYation Commission resolution.

WHEREAS, the Saint Paul He�itage Preservation Commission is authorized by Chapter 73
of the Saint Paul Legislative �ode to protect places, buildings and other objects having
specia� historical, community r aesthetic interest or value, and to enhance and promote the
heritage of the City of Saint �aul; and
WHEREAS, many street name's reflect elements of the city's rich cultural, social, oconomic,
or political history and help t{u enhance and promote awareness of the city's heritage; and
WHEREAS, the City Council,lon June 9, 1987, passed a resolution requiring HPC review
and cpmment on any proposec� name change for a Saint Paul city street which has had its
current name for 50 years or �niore prior to action on the name change by the City Council,
and placed a moratorium on �treet name changes until the HPC has adopted guidelines for
HPC teview of and recomme�dations on street name changes;
NOW, THEREFORE, BE IT I�ESOLVED, that based on the above findings the Heritage
Preservation Commission adolpts the following criteria for HPC review of and
reconfinendations on street n�me changes:
I. The relationship of both�the existing and proposed names to the city's cultural, social,
economic, and political hlistory;
2. The significance of bothl the existing and proposed names and their relationship to the
location and prominencel of the street; and
3. The representation of bdth the existing and proposed names in the names of other
places, buildings, and obpects in Saint Paul.

WHEREAS, the City of Saint Paul is made up of three officially desigaated
historic districts and about 50 officially desigaated historic buildings;
and
WHEIkEAS, Saint Paul is a City of rich history and tradition; and
WiiEREAS, changing tradi�fonal street names may cause a loss to the City's
history and confusion and disruption to property owners along the street;
and
WHEItEAS, changing stree names could, on the other hand, enhance and
highlight the City's hi�tory;
NOW, THEREFORE, BE IT �SOLVED, any proposed name change for a Saint Paul
City street, which has ad its current name for 50 years or more, shall
be �eviewed and commented on by the Saint Paul Heritage Preservation
Com�ission prior to acti{on by the City Council; and
BE IT FURTHER RESOLVED, the Citq Council shall have a moratorium on any
street name changes unt�l the Heritage Preservation Commission has �adopted
guidelines for their re iew and reco�endation on street name changes and
until the City Council has approt�ed any necessary amendments to Section 73
of the Legislative Code.i

Section l .
That Section 310.03 of th� Saint Paul Legisla-tive Code I
is hereby amended to read as iollow� :
', Sec. 310.03. Investigation and review of new
�pplications, etc.
(a) The insp ctor shall determine �che sufficiency
and accuracy f each new application and obtain such
criminal history information as may i�e used under
Minnesota Statutes , Chapter 364, and is otherwise
available by law. The inspector shall make reasonable
and appropriate investigation of the premises or
personal prop rty, vehicles or facili�cies , as may
be involved i or related to the license� activity,
and shall req es��, wnere appropriate , the assistance
of other cit�r divisions or departments in making
additional investigatiions for the purpose of determining
wnether the applicanL is or will be in compliance I
with all app icable ordinances and statutes. The
approval of ucn other divisions or departments is
not required f r issuance of a license unless otherwise �
required by specific sections in these chapters.
Al1 new applications shall be reviewed by the zoning
administ-rator or his designee for compliance with
all requirements of the Saint Paul Zoning Code , and �
no new license shall be granted without full compliance

department of fire and �afety services and to the building official for
invest�.gation and recom�►endation.
� C1ass III Licenses ,� For all original and renewal applications for
Class III licenses the ins ector ma obtain from the Police De artment
the cra.minal history fo all individuals who own the licensed business.
Applicants may be requested by the division to provide the name, birth
date, address , fingerpri�nts and written consent for the release of their
criminal history from al�l persons who own the business and on such forma
as ma be re uired b the ins ector the F.B. I . and the B.C.A. The
Police Department sha 1 provide the criminal history information
obtained from its own r�cords, and, to the extent permitted by state or
federal law, from the r�cords of the Federal Bureau of Investigation and
the State Bureau of Criminal A rehension. For the ur ose of this
section "criminal histo " shall mean records of convictions for felon
gross misdemeanor and isdemeanor offenses for which a .iail sentence
can be imposed, durinpt the five year period preceding the date of
application; provided, ; however, that "criminal history" shall not
inclu e convictions w ich have been ursuant to law annulled or
expun ed. Criminal his ories mav be considered by the City Council only
to the extent permittled by Minnesota Statutes , Chapter 364. The
inspector, with the �,dvice of the city attorney, shall prepare
administrative guideli,nes to follow in determining under what
circu stances a F.B. I . criminal histor re ort will be obtained which
guide�ines may applv to applicants who ( 1 ) have not resided in the state
of Minnesota during th� past five years; ( 2 ) have state of Minnesota
convictions and/or arre�sts during the previous five years ; { 3) based on_
information obtained f om warrant searches ive indications of havin
been i�nvolved in crimi al activity from out-of-state .iuriadictions; or
( 4 ) in those situation� where such a criminal history report is deemed
necessary based on othe$� information developed by the Police Department,
Licen�e Division or Cit Attorne ' s office. An FBI criminal histor
re ort shall not be r ared for an license a licant under rovision
(b) ( 4) above without he advice and consent of the city attorney.
