WHEREAS, the City of Saint Paul, acting through its Right-
, of-Way Engineer, has secured an agreement for the purchase of
that certain property' described as follows:
That part of S.E, 1/4 Section 30, T.29, R. 22 bounded
on the North by the northerly boundary of Sims Street
extended, on the Northeast by the southwesterly line of
the existing Troi�t Brook Interceptor Sewer Easement,
on the Southeast by the northwesterly right-of-way
line of Intersta�te 35E, on the Southwest by the north-
easterly right-of-way line of the Soo Line Railroad.
WHgREAS, the property herein described is necessary for
public purposes in connection with the Jackson/Magnolia Area
Sewer Project; and
WHEREAS, this property was approved for acquisition on
January 26, 1988, by �inal Order, Council File No. 88-118; and
WHEREAS, the prace at which the property may be purchased
is in the amount of $;�24,000.00, it being a fair and reasonable
price for the subject property according to the appraisal
obtained by the Rightrof-Way Engineer; and
WHEREAS, the Right-of-Way Engineer has recommended the
purchase of said prop+erty at the price stated above;
NOW, THEREFORE, �E IT RESOLVED, that the proper City
officials are hereby authorized to pay Burlington Northern, Inc. ,
owner of record, the Sum of $324,000.00 . Said sum to be charged
to Funding Source C88�2T621-0787-29038.
FURTHER� BE IT RESOLVED, that the pond will be developed as a wet
pond with wildlife and lat�dscaping aesthetics provided for in the design,
and the design will be brought to the Council for review before construction

SUBJECT: Stillwater-Nokomis Ponding Area
when planning for combi�ed sewer separation in Saint Paul, the Sewer
Division considers all Ifeasible cost effective methods to complete
this task. In certain �ases it has been determined that certain
existinq large trunk se+wers can be used as stornt sewers after sanitary
sewage has been removed. Such is the case with the East Side of the
city bounded by Interstate 94 , Johnson Pkwy, Larpenteur Avenue and Mc
Knight Road. In the period of 1986 to 1988 , The Metropolitan waste
Control Commission (MWCC) constructed the Middle Beltline Sanitary
Interceptor (Beaver Lak Branch and Lake Phalen Branch) . The
construction of this sa�iitary interceptor now makes it possible to use
the existing trunk sewet for stormwater. Although the trunk sewer
ranges in size from 6 feet to 11 feet 4 inches in diameter, it does
not have sufficient capacity for stormwater from the East Side.
Therefore, the Comprehensive Sewer Plan of 1984, anticipatinq the MWCC
construction, proposed �he use of four ponding areas for stormwater
detention. By temporar�.ly detaining part of the peak stormwater
runoff the ponds will r�lieve the trunk sewer enough to provide
adequate capacity. Water in the ponds will drain away durinq off peak
hours.
The Stillwater-Nokomis Combined Sewer Separation project is consistent
with the Comprehensive Flan. The proposed ponding areas at Haze1 and
Ross are part o� this p�oject scheduled in 1988. The overall - -
separation plan detailinq the pondinq areas and trunk sewer� are shown
on the attached maps.
At the request of the Public Works Committee, I have investiqated the
alternatives to such a proposal and the associated costs. The only
alternative to this ponding area is to build a new storm trunk to
relieve the existing trulnk sewer.

Failure to provide relief by either Case 1 or Case 2 would cause
serious flooding of the' streets and adjoining property. This would
cost nothing for pond or sewer construction but could cause severe
property damage and ill-will. This project would then be ineliqible
for federal and state a'id because it does not meet design standards.
"'' Under this "do nothing" approach local storm sewers would be built '
and drained to the exis'tinq trunk sewer. This would violate
engineerinq standards, icausing potential flooding several times in
a 10 year period. The flooding would center on Hazel Street and Ross
Avenue and overflow ont�o private property and extend for two to three
blocks. We have on rqcord a number of complaints of backups within
this sewer system. '

For discussion purposes, Z have considered the possibility of not
constructinq any of the four ponding areas. As you can see, the other
three lie along the trunk sewer alignment. Again the alternative
would be to build a rel,ief trunk sewer\ T` ponding alternate would
