99-242OR�lGINAL Presented By Referred to Council File # ` `,� Green Sheet # � RESOLUTION � CITY OF SAINT PAUL, MINNESOTA �� Committee: Date 1 WHEREAS, The State of Minnesota Department of Natural Resources, 2 Office of Management and Budget Services has money available to 3 increase and enhance outdoor recreation facilities through the 4 Local Grants Program, and 5 WHEREAS, the City of Saint Paul is an eligible applicant and 6 desires to submit an application for the Battle Creek Recreation 7 Center Site Development project; 8 NOW THEREFORE BE IT RESOLVED, that the City of Saint Paul act as 9 legal sponsor for the Battle Creek Recreation Center Site 10 Development project contained in the Outdoor Recreation Grant 11 Application to be submitted on March 31, 1999 and that the Mayor 12 and proper City officials are hereby authorized to apply to the 13 Department of Natural Resources for funding of this project on 14 behalf of the City of Saint Paul, and 15 BE IT FURTHER RESOLVED, that the City of Saint Paul has the legal 16 authority to apply for financial assistance, and the 17 institutional, managerial, and financial capability to ensure 18 adequate construction, operation, maintenance and replacement of 19 the proposed project for its design life, and 20 BE IT FURTHER RESOLVED, that the City of Saint Paul has not 21 incurred any costs or entered into any written agreements to 22 purchase property related to the above-referenced project, and 23 BE I� FURTHER RESOLVED, that the City o£ Saint Paul has not 24 violated any Federal, State or Local laws pertaining to fraud, 25 bribery, graft, kickbacks, collusion, conflict of interest or 26 other unlawful or corrupt practice, and 27 BE IT FURTHER RESOLVED, that upon approval of its application by 28 the State, the City of Saint Paul may enter into an agreement 29 with the State of Minnesota for the above-referenced project, and 30 that the City of Saint Paul certifies that it will comply with 31 all applicable laws and regulations stated in the contract 32 agreement and described in the Compliance section of the Outdoor 33 Recreation Grant Program Application, and 34 BE IT FINALLY RESOLVED, that the Mayor and proper City officials 35 of the City of Saint Paul are hereby authorized to execute such 36 agreements as are necessary to implement the project on behalf of 37 the City.
