RESOLVED, i�hat the Council of the City of Saint Paul hereby
requests the Saint Paul Charter Commission to review and recommend
for unanimous Council adoption, pursuant to Minnesota Statutes
Section 410. 12, Subd. 7 , the attached City Charter amendments ,
to Charter Sections 6.07 , 8 .05 and 13.03 . 1 ; and, be it
FURTHER RESOLVED, that the City Clerk is hereby directed
to transmit a copy of this Resolution, with the attached ordinance,
to the secretary of the Saint Paul Charter Commission.

Providing complete information under the listed headings enables reviewers to make
decisions on the documents and eliminates follow-up contacts that may delay execution.
The COST/BENEFIT, BUDGETARY AND PERSONNEL IMPACTS heading provides space to explain
the cost/benefit aspects of the decision. Costs and benefits related both to City
budget (General Fund and/or Special Funds) and to broader financial impacts (cost
to users, homeowners or other groups affected by the action) . The personnel impact
is a description of change or shift of Full-Time Equivalent (FTE) positions.
If a CONTRACT amount is less than $10,000, the Mayor's signature is not required,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l .
Pursuant to Mi�nesota Statutes Section 410. 12, Subd. 7 , and
upon recommendation' of the Charter Commission of the City of Saint
Paul , Section 6.07 of the Charter of the City of Saint Paul be

"Section 8.05. � Referendum. Any ordinance, or
resolution passed pursuant to subdivisions 5 or
6 of section 6:03. 3 of this chapter, may be
subjected to r�ferendum by a petition filed
within forty-f�ve days after its publication,
in the case of , an ordinance or within forty-five
days after its passage and approval in the case
of a resolutio . The petition shall state , at
the head of eac�h page or in an attached paper, a
description of �the ordinance or resolution
involved. Any ordinance or resolution upon which
a petition is i�iled, other than an emergency
ordinance, shalll be suspended in its operation
as soon as thelpetition is found sufficient.

RE: Proposed Charter Amemdment Affecting
Publication and Reso�lutions
Dear Mayor Latimer and M�mbers of the City Council :
The City Charter requir�es that ordinances and resolutions shall become
effective after passage, approval and publication. The apparent reason for
the publication of ordi�nances and resolutions is to inform the public of
actions of the City Co�ncil . In the case of ordinances, I feel it is a
necessary and proper requirement because ordinances become effective 30 days
after publication and th�e public is allowed time to circulate a petition of
referendum against an adopted ordinance. In the case of resolutions, they
become effective upon publication with no further action. I recommend that
the Charter be amended;to delete the requirement that resolutions become
effecti ve upon publ i ca�i on but I recommend retai ni ng the provi si on as i t
relates to ordinances, �
Prior to the mid-1960s �advance printed agendas of Council meetings were not
circulated and except i�h the case of hearings, the public was not informed
of items under consid�ration by the Council . The only notice of Council
actions was after adoption and upon publication in the official newspaper.
At the present time agendas are prepared a week in advance of a meeting with
wide distribution to City offices, the news media, citizen organizations,
interested citizens and via cable television.
This action is propose� because I believe the effective date of a resolution
should not be controll�ed by publication and because of rising publication
costs with questiona�le cost benefit. In 1988 publication costs are
projected to be over $�0,000 and in 1989 will be close to or over $100,000.
The vol ume and conten;t of resol uti ons and ordi nances has al so i ncreased.
Ordinances generally recite the entire portion of the code that is being
amended when in fac� many times only a few words are changed. Many
resolutions contain numerous whereas clauses with background information and
the action clause is sometimes only a few sentences. An example of high
publication cost wit,h questionable cost benefit is the annual CIB bond
resolution and the recent Sewer Bond resolution consisting of over 90 pages.

Another area of increased volume is the numerous budget transfer and
amendment resolutions containing numeric data which increases the
publications costs but provides very little information on the nature of the
program being funded.
For the above reasons I recommend that you adopt the attached resolution
requesting the Charter Commission to study and consider this issue and make
a recommendation to the City Council for a Charter Amendment by ordinance.
Your consideration of this request will be appreciated and I stand ready to
discuss the matter and answer any questions at any time.
