An ordinance amending Section 409. 12 of the
Saint Paul Legislative Code pertaining to
intoxicating liquor.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
5ection 1 .
That Section 409. 12 of the Saint Paul Legislative Code as
amended, be and is hereby amended to read as follows :
409.12. Revocation; suspension; fine. Any license or
permit under this Chapter may be either suspended for up to
60 days or revoked or a civil fine imposed not to exceed
$2, 000 for each violation on a finding by the Council that
the license or permit holder has failed to comply with an
applicable statute, rule or ordinance relating to alcoholic
beverages . No suspension, revocation or fine shall take
effect until the license or permit holder has been afforded
an opportunity for a hearing under section 310.05 of this
Code.
Section 2.
This ordinance shall take effect and be in force 30 days from
and after its passage , approval and publication.

Dear Council Member Sonnen:
Phil Byrne has advised me that you called his attention to
a drafting error in Section 409. 12 of the Legislative Code.
The City Council amended Section 409.12 by Ordinance No. 17522
adopted December 24, 1987 to be consistent with the existing
State legislation regarding penalties for violations of liquor
provisions by liquor license holders. I am attaching a copy
of Ordinance No. 17522.
The City Council later adopted amendments to Chapter 409 providing
that Council license hearings would be held before a committee
rather than the full Council and inadvertently changed Section
409. 12 and I am enclosing a copy of the April 19, 1988 amendment
to 409.12.
I believe it was the intention of the City Council to retain
the version of Section 409. 12 as adopted on December 24, 1987
and to clarify this , I have prepared an ordinance with would
re-enact the language adopted by the Council on December 24,
1987. If you have any questions , please feel free to call

Code and providing for the licensing of persons
who lease property to others for the operation
of certain gambling activities.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
Gambling Hall
.Ol . License required. No person, being the
oTS;ner, manager or in control of any building as defined
iiz section 60. 202 of the Saint Paul Legislative Code,
shall rent or lease a building or portion thereof
to any other person or organization for the purpose
of conducting lawful gambling in the form of pull-tabs ,
tipboard, raffles , and/or paddle wheels without firs�c
obtaining a license as provided in this chapter.
.02. No license is required if the lawful gambling
is to ?�e conducted in the building or portion thereof
12 or fewer days in any calendar year; in a bin�o
i�all licensed pursuant to the provisions of Chapi��,
403 ; in an on-sale liquor establishment license:::
purs�aant to section 409.21 ; or in a private clut�
lic�nsed pursuant to Chapter 404.
.03. Fee. The annual license fee for a gambling
hall is $290. 00.

shall contain, in addition to other information
required by the inspector, the name and address
of the owner of the property, the names and ad-
dresses of all shareholders and officers if the
owner is a corporation or other association,
the names of all tenants of the building, and
which tenants will be conducting the lawful gambling
on the premises .
(b) Inspection, etc. Prior to the issuance of
the license the building shall be inspected by
the appropriate officials from the department
of fire and safety services , the division of
housing and building code enforcement, and the
division of public health. No building shall
be licensed unless it complies with the requirements
of the zoning, fire , building, health and sanitation
codes of the city and of the state .
(c) Restrictions. The license applicant or licensee
shall have no financial interest whatsoever in
the operation of the lawful gambling, except
for any rent to be received from the tenant organi-
zation. The amount of rent to be charged shall
not exceed the rental limits established by the
State Charitable Gambling Control Board.
(d) Inspection. The licensed premises shall be
open to inspection by officials of the city during
normal business hours . The licensee shall maintain
written records of all lease transactions , including
rental receipts and tax records , and shall make
them available to city inspectors upon reasonable
notice. Failure to permit city officials access
to such records or access to the premises shall
be cause for adverse action pursuant to the pro-
visions of section 310. 05 of this code.
(e) Only lawful gambling permitted under the
provisions of Minnesota Statutes , Chapter 349,
and Chapter 402 of this Code , shall be allowed
on the licensed premises . It shall be the obli-
gation of the gambling hall licensee to investigate
and assure that the organization conducting the
gambling event has obtained the required state
license or city permit .
