RESOLVED, that the on-s le intoxicating liquor license and all
other licenses held by Two D, Inc . dba North End Depot for the
premises at 1638 Rice Street in Saint Paul , are hereby suspended
for a period of three (3�onse utive days , commencing and ending on
the dates specifi-`e�--�ierein: Jul 1 ul 2 Jul 3 1988
This Resolution and the action taken are based upon the facts
contained in the attached po ice report which support the allegation
contained in Notice of Heari g dated May 23 , 1988 , also attached to
this Resolution. Such facts are not contested by the licensee, as
evidenced by the attached le ter of counsel . The action taken
herein is also based upon th facts , circumstances and arguments
presented by and on behalf o the licensee.

We have received notice of he administrative hearing which you
have set for July 14 , 1988 . The purpose of this correspondence
is to advise you that my cli nt wishes to waive all right to this
proceeding , and further , wi hes to appear before the City Council
on;���:="��'8, for the pu pose of presenting mitigating facts

which might be considered b the Council before the imposition of
penalty.
As we have discussed, my c ient has implemented significant pro-
cedural changes to prevent a y recurrence of the incident in ques-
tion, and since we have chos n not to contest the facts in contro-
versy, would you kindly arra ge to have this item placed on the
City Council agenda?

' T�e Council of the City of Saint Paul has the. authorit� to
provide for hearings concernin licensed premise-s , and for action ��
against such licenses , under Chapter 316 , incl �ding sections
310. 05 and 316. 06 , of the Sai t Paul Legislative Code. In th� .
case of licenses foz intoxicating and non- intoxicating liquor ,
author�ity is also conveyed by section 340A.415 of the Minnesota
•• Statutes. •
Evidence will be presented to he judge which may lead to adverse
action against the license or icenseholder as follows :
On March 31, 1988, a bart nder in the licensed establishment
sold an alcoholic bevera e (a shot of Peach Schnapps) to a
person under the age of 21 years in violation of section
409.08 (2) of the Saint Pa 1 Legislative Code and Minn. Stat.
1986 , section 346A. 503 , � s bc� . 2.

You have the right. to be rep esented by an attorney before and
during the hearing if you so choose , or you can repzesent
. yourself. You may also have a person of your choice represent
you , to the extent `not prohibited as unauthorized practice of
law.
The hearing will be ccnducted in accordance with the requirements
of sections 14. 57 to 14. 62 of the Minnesota Statutes , and such
parts of the proceduzes unde section 310. 65 of the Saint Paul
' Legislative Code as may be ap licable.
At hearing , the Administrati e Law Judge will have all parties
identify the:nselves for the record. Then th� City will present
its witnesses and evidence, e ch of whom the licensee or attorney .
may cross=examine. The lice see may then offer in rebuttal any .
aitnesses or evidence it may wish to present , each of whom the �
City attorney may cross�exam ne. The Administrative Law Judge
may in addition hear relevant and material tesLimony from persons
not presentcd as wi tnesses wh have a substantial i�terest in the
ou�come of the pzoceed ing; for example, the owners or occupants
of �roperty located in close proximity to the licensed pr�mises
�ay have su�stantial interes in the outcome of the proceeding.
