WHEREAS , the Council f the City of Saint Paul , by
resolution 271062, approved May 17 , 1978, vacated a 10-foot
utility easement described as follows:
Vacate the 10-foot tility easement centered on
the common lot lines f Lots 1 and 2, Block 1, lying
between the South 1 ne of Nebraska Avenue and a
point 93 .28 feet Sout westerly of said South line as
measured along said c mmon lot lines, all in Roth' s
Phalen View.
WHEREAS , condition numbe two of resolution 271062 required
the petitioner, Melvin Rot , to furnish the City with an
indemnity bond in the amount f $2,f600; and,
WHEREAS, the City is willing to accept a Covenant of
Indemnity from the petitio er , Melvin Roth, in lieu of the
original indemnity bond.
THEREFORE BE IT RESOL ED, that the requirement of an
indemnity bond in condition wo in resolution 271062 be deleted
and replaced with a coven nt of indemnity as described in
"Exhibit A" which is attach d hereto and made a part of this
resolution; and,
BE IT FURTHER RESOLVE , that in all other respects,
resolution 271062 shall remai in full force and effect; and,
BE IT ALSO RESOLVED, tha the City Clerk shall record a copy
of this resolution in the of ice of the County Recorder, Ramsey
County, Minnesota.

To the Honorable, the City uncil
of Saint Paul, Minnesota
Melvin Roth and Ruth M. Ro h, husband and wife, owners of the
property previously vacated by resolution C.F. 271062 approved
May 17, 1978, agree on beha f of themselves, their assigns, and
their successors in inter st to indemnify, defend, and save
harmless the City of Saint P ul, its officers, and employees from
all suits, actions, or cl ims of any character brought as a
. result of injuries or dam ges received or sustained by any
person, persons, or prope y on account of this vacation, or
owner's use of this proper y, including but not limited to a
claim brought because of any act of omission, neglect, or
misconduct of Melvin Roth nd Ruth M. Roth, or because of any
claims or liability arisin from any violation of any law or
regulation made in accordanc with the law whether by Melvin Roth
and Ruth M. Roth, or any of heir agents, employees, assigns, or
successors in interest.
This indemnification is ffered in lieu of the bonding
requirement set forth in C ndition 2 of the above referenced
vacation.
