RESOLVED, that upon the pet ' tion of Miller and Holmes , Inc.
per Finance File No. 2-1988, tha part of the alley in Block 59,
Arlington Hills Addition to Sa ' nt Paul, bounded by Minnehaha ,
Weide, Reaney, and Arcade Stree s, hereinafter described be and
the same is hereby vacated and d ' scontinued as public property.
All that part of the east-w st alley lying west of a line 20
feet west of and parallel o the east line of lot 3 , block
59; and east of a line 20 eet west of and parallel to the
west line of lot 4 of said lock 59 ; and also
All of the easement in the and necessary for slopes, cuts,
and fills in the constructi n and grading of said right-of-
way lying within or adjacen to said vacated area described
above; and also,
All of the alley as opened cross the west 20 feet of lot 3
of said Block 59, all in A lington Hills Addition to Saint
Paul .
Subject expressly to the followi g terms and conditions :
l. That the vacation b subject to all the terms and
conditions of Chapter 130 , codified March 1 , 1981, of
the Saint Paul Legisla ive Code, as amended.
2 . That the petitioner , ts successors , and assigns , pay
the City of Saint Paul $1,536 as compensation for this
vacation which is due nd payable within 60 days of the
date of publication of this resolution.
3 . That a permanent util ty easement be retained within
the vacated area o protect the interest of
Northwestern Bell Tele hone Company.

4 . That a permanent utili y easement be retained within
the vacated area to pro ect the interest of Continental
Cablevision.
5 . That the petitioner , it successors , and assigns shall
dedicate, by Quit Claim Deed to the City of Saint Paul ,
a permanent easement for right-of-way purposes ,
subject to the approv 1 of the Department of Public
Works , and the City A torney, property described as
follows:
The west 20 feet f Lot 5, Block 59 ,
Arlington Hills Add tion to Saint Paul
6 . That the petitioner , i s successors , and assigns , by
acceptance of the t rms and conditions of this
vacation, agree to ide nify, defend and save harmless
the City of Saint Paul, its officers and employees from
all suits , actions , or laims of any character brought
as a result of inju ies or damages received or
sustained by any per on, persons , or property on
account of this vacati n, or petitioner ' s use of this
property, including but not limited to a claim brought
because of any act of o ission, neglect, or misconduct
of said petitioner o because of any claims or
liability arising fro any violation of any law or
regulation made in acc rdance with the law whether by
the petitioner or any of its agents or employees.
7 . That the petitioner, its heirs, and assigns , shall
within 60 days of the publication date of this
resolution file with e City Clerk an acceptance in
writing of the conditi ns of this resolution and shall

within the period (s) pecified in the terms and
conditions of this reso ution comply in all respects
with these terms and con itions .
That the Council of the City of Sa ' nt Paul hereby authorizes the
proper City officials to convey to the petitioner, its successors
and assigns, by Quit Claim Deed, all of the vacated alley
originally opened and recorded as ocument 2105139 dated January
14, 1981, and described as follows:
A permanent easement for all y purposes over and across the
westerly 20 feet of Lot 3, Block 59, Arlington Hills
Addition, according to the r corded plat thereof, and shall
be subject to the terms and onditions of this resolution.
8. That a permanent utility ease nt be retained within the vacated area
to protect the interests of No thern States Power Company Electric
Division.
