U1�?ER.��S , the P�Zetropoli an Airports Commission (MAC) has proposed
to the Federal Aviation �,�e cy (FAA) that FAA institute a six month
Noise Distribution Test at inneapolis-St . Paul International Airport
which test would substantia ly increase commercial air craft flights
over and attendant noise in the Highland Park neighborhood of the
City with.out at the same ti e significantly reducing the air craft
noise problem in other area within the main airport runway corridors ;
and
WHEREAS , the Noise Dis ribution Test is a governmental action
which may have potential fo si�nificant environmental effects and
which is subject to the Min esota Environmental Policy Act (MEPA) ;
and the St. Paul Airport No se Coalition (S�'�?`TC_;) , an association
of Saint Paul residents , fi ed a peti�ion with the Environmental
Quality Board (EQB) for an rder requiring MAC to prepare an
Environmental Assessment Wo ksheet (EAW) and Environmental Impact
Statement (EIS) on the Nois Distribution Test ; and
[�IEREAS , MAC first det rmined that it could not comply with the
directive of the EQB to dec de whether an EAW was necessary under
MEPA on the ground that the FAA controlled flights at the airport
and that the Minnesota Act nd Rules adopted in pursuance of the Act
have no obligation to the N ise Distribution Test to be undertaken
by FAA then made a determin tion that an EAW was not necessary upon
the ground that the Noise D stribution Test does not have the potential
for significant environment 1 effects , and filed its request to
FAA that FAA institute the oise Distribution Test ; and
WHEREAS , SPANC institu ed a suit against MAC in State District
Court challenging MAC' s fai ure to follow the requirements of the
P��PA and Rules and seeking n order restraining MAC from requesting
�'!�A to implement the Noise istribution Test until an adequate
Environmental Assessment wa completed; and

WHEREA5 , under the Nat onal Environmental Policy Act (NEPA)
and FAA Regulations regardi g consideration of environmental impacts
under NEPA, FAA has respons bility for environmental assessment and
nreparation of an Environme tal Impact Statement (EIS) or a Finding
of No Significant Impact (F NSI) in connection with the Noise
Distribution Test , and has ndicated that it is reviewing MAC' s
request to institute the te t without assurance regarding an
environmental assessment ; a d
WHEREAS , it appears th t the Noise Distribution Test could have
significant environmental e fects impacting the City of Saint Paul ,
its citizens and property v lues and that the test should not be
undertaken without an adequ te assessment of potential environmental
effects of the test; now th refore, be it
RESOLVED by the Counci of the City of Saint Paul that the
City Attorney is authorized and directed to monitor the activities
of MAC and FAA regarding im lementation of the Noise. Distribution
Test and to take such actio s on behalf of the City of Saint Paul
as he determines is necessa y or desirable to protect the rights
and interests of the City, ts residents and property owners against
implementation of the Noise Distribution Test without compliance
with MEPA, NEPA or other ap licable law.
