99-211ORIGINAL Presented By Referred To �mev.�a� — '��,r�h �o , \`1�l°� RESOLUTION CITY OF SA�NT PAUL, M Committee: Date ( o� 1 WFiEREAS, the City of Saint Paul, on February 23, 1998, received a Notice of T� Z Liability from the State of Minnesota stating that Jazzville, Inc. d/b/a Jazzville, owes delinquent 3 taxes to the State of Minnesota; and 4 5 WFIEREAS, Jazzville, Inc., dlbla Jazzville, located at 486 N Rabert Stteet, holds a 6 L'aquor On-Sale and Sunday On-Sale Liquor license at that location; and 8 WHEREAS, Minn. Stat. §270.72, subd. I(1994) requires the revocation of any license 9 for the conduct of a profession, occupation, trade or business held by an applicant who owes 10 more than $500 or more in delinquent taxes or has not filed returns; and 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 WHEREAS, under said statute the State of Minnesota must notify the applicant of the intent to require revocafion of such license, and of their right to a heazing; and WHEREAS, a hearing under this statute is expressly provided to be in lieu of any other hearings ar other proceedings required by law, which would include the hearing provisions of Saint Paul Legislative Code §310.05; and WTIEREAS, the Ci17 has agreed with the Department of Revenue that the definition of °revoke" as used in the statute is procedurally the same as the process used by the City of Saint Paul for a license suspension; and WHEREAS, the license suspension must be implemented within thiriy (30) days of receipt of the Notice of TaY Liability, and is in effect unril the Commissioner issues a tax clearance certificate;and WHEREAS, no tax clearance certificate has been forwarded to the City of Saint Paul, Office of LIEP, by either the applicant or the Commissioner of the Minnesota Departrnent of Revenue; now, therefore, be it Council File # q � � � Green Sheet # b35� c1 � 2 3 4 5 6 q�-a�1 RESOLVED, that the Liquor On Sale and Sunday On-Sale Liquor licenses held by Jazzville, Inc., dfbla Jazzville, 48 ``� treet, be and hereby aze suspended effective at 12:01 a.m. on Mazch 17, 1944, and will not be reinstated until such time as the City of Saint Paul has received a taa� cleazance certificate from the Commissioner of the Minnesota Department of Revenue, and has given written notice to the licensee of the lifting of tlus suspension.
